The Origonal judgement was £5357.19 dated 9th June, apparently the solicitor applied for high court enforcement on the 16th June Payment made 3rd July £5357.19 Bailiff attended looking for £6380.70 on 6th Aug I recieved no letter from anyone, the solicitors said they sent a letter on the 16th of june by normal post but i never recieved it, I got a copy from the company that we owed the money to, I was oblivious to the fact that there was an outstanding balance i thought i had settled the judgement. You would think they would send it by registered post if it was so important, if i had recieved it I would have been on the phone straight away.
  2. Hi there I hope someone out there can offer a little advice. I recieved a county court judgment against my company on the 9th June, I called the court and asked about the judgement and the said that if I settled the judgment within 30 days then it would be removed from the record. on day 23 I sent a cheque off for the full amount of the judgment. End of story as I thought, 34 days after sending off the cheque I get a visit from a High Court Enforcement claiming to be there to enforce a judgment, I explained that we had paid the debt on the 3rd July he made a call and confirmed that the cheque for £5357.19 had been recieved and banked but that it was not full and final payment as because the solicitors had sent the judgment to high court for enforcement there was outstanding interest of £101.75, but he was there loking for £1023.51 which included his fees. We told him to leave. He handed a yellow peice of paper a notice of seizure and inventory. I called High court Enforcement and explained that I had paid the amount of the judgment on the 3rd july, she asked me to forward on a copy of all my correspondance along with a copy of the bank statement showint the payment had been taken, I did all this on Aug 6. I heard nothing back until on the 18th Aug the bailiff called again looking to collect the balance of £1023.51 but this amount was now £1239.34 due to the second visit. He called me on the phone and I asked why he was making a second visit when I was waiting for a call or letter explaining what was going on and a breakdown of the costs, he said he would call me back after calling the office (give him his due he did) he called back saying that the office would write to me and that I should give him a call when I recieved the letter. I recieved the letter with the following breakdown. Cost of Execution £101.75 Accrued Interest £81.02 TOAL due to claimant £182.77 Poundage £165.67 Officers Costs £890.90 TOTAL due to High Court Enforcement £1056.57 I called him back and asked who I should speak to concerning this he gave me a number and I called them, after 1 week and many calls waiting for a reply I spoke so someone who gave me another breakdown of the costs. Mileage £59.00 Seizure £2.35 I &V £13.77 Enforcement costs (revisit) £235.00 Additional Administration fee £117.50 SO12 £146.87 Poundage 9.00 I dont understand what any of this means, I know according to theaa.com their office is 6.5 miles from my premises. Can anyone help me out here I am losing sleep over this it is worrying me to death.
