  1. Hi all Sadly my mother in law passed away in December my wife her only child is dealing with the estate. Unfortunately we've found she had run up large debts with catalogues and a huge credit card balance (£4,000 for someone on benefits!) It gets complicated as my wife's aunt died in October and the mother in law was dealing with her Estate and as such had her life insurance paid into her account and unfortunately she died before settling that Estate. she had a credit card with her bank and the bank are claiming all the money in her account to pay the credit card off. As there won't be enough money to pay every creditor what they're owed can the bank legally lay claim to everything? I thought we'd gather everything together then work out a % to offer creditors if the bank holds onto the current account money there will be less money for other creditors. I have CCA'd everyone and not one has sent the info back times up on weds. Any advice would be great thank you
  2. Hi Quick bit of advice please. We live in a housing association house and have done for 8 years now. We have a normal front garden but as our house is built onto a hillside our back garden is in fact kind of like a large balcony/sun terrace as it's built above garages. We've had a couple of occasions now where this has happened and I want to check the legal position before I make a formal complaint. We've had notice that a company was to come round to tidy up guttering and paint where needed, no problem thought nothing more of it. However on the day the company didn't knock and ask to come into the "back garden" they just stuck a ladder up and climbed up and over the wall to gain access. The properties affected are 2 bungalows (semi detached), my wife was naked in the bedroom at the time getting dressed and more disturbingly the mother in law next door was in the middle of having her catheter changed when this man was then basically looking in the window. Now my issue is that you wouldn't throw a ladder up and climb over a fence normally into someone's back garden so why is it acceptable to do it to us? Secondly our German Shepherd is normal loose out there as it's very secure she can't escape what would have happened had she been out there and gone for this man. Also lastly they disposed of all their waste in our household waste bin, now perhaps being a bit vindictive but surely this isn't legal either? Surely they should be a registered waste carrier with EA and dispose of their waste properly? It wasn't much a load of paint and cleaning chemical soaked rags and an empty pot containing dried black paint. Before I make an idiot of myself i'd be grateful for any advice on the law etc to the above before I complain. Thanks so much in advance
  3. Turns out fuel is ok but high pressure fuel pump is faulty which means engine out at main dealer. Only had the car since June and only done 31,000 miles don't know what to do now it's gonna cost thousands to put right and just don't have it. Might just have to get finance Co to take away and negotiate paying it off and go buy a banger to run around in instead. Can't believe it 3 years old 31,000 miles and needs a repair around 40% of car value. Just going to go hide in bed and cry I think
  4. Hi everyone Last Thursday after coming out of hospital stopped at morrisons in cromer and filled the tank up £70 worth of fuel. Friday morning engine management light came on left car alone till my mechanic could look. They came out last night put a reader on fault code was low pressure or some such. Anyway they dipped the tank said fuel was evaporating from his finger and smelt very much like petrol. At the time I remember picking up the black handled pump, looking up to see it said diesel, then after £20 or so had a little panic attack so checked again black, diesel and large bore pump all ok so filled to the brim. I'm 100% convinced it wasn't me (I've always owned diesels too). I've filled in a form for Norfolk trading standards, what else do I do? Help Don't know if car is wrecked or not yet am so upset and depressed. Thanks
  5. Had an email from them this morning saying cosmetic problems are your problem. I'll follow it up with what has been posted so far. Stupid thing is the bathroom one will just rust thru and then pop and they'll have to fix it, stupid idiots Thanks
  6. Not yet they only came out this morning. I'll ask the HA for it in writing whether they expect tenants to sand and paint radiators because if I don't chase that'll be it now as heating engineer will close the job
  7. Hi 3 years ago we had central heating put in, 2 of the radiators now have enamel peeling off of them and the bathroom one is merrily rusting away as a result. Had a guy out from the heating contractor on behalf of the HA and he said yes we had a batch of them around 3 years ago that were faulty and paint peeled off of them they were under warranty but because so many went faulty they're now no longer covered (wtf???) Long story short he said we're not doing anything as the rads are working normally if you want it sorted buy enamel paint and sand/paint them yourselves! Is that right? I've never been told to paint radiators in all the property ive rented in the past. I understand decorating and minor plasterwork is our responsibility but stripping and painting radiators because of an admitted fault??? Any advise please? I'm not painting them myself anyway as im off sick at the moment and can't bend over that far, it's not going to get better anytime soon as dr and hospital still dont have a diagnosis for me and we're living on the bread line anyway so my initial response was well let them stay like that until rust breaches radiator but I don't want to cost more money than necessary and I don't want to get into trouble either Cheers
  8. Thanks, yeah I wondered that too. I did try that I found that made it worse, had a nice warm bath last night then ended up curled up in bed in agony. Came close to calling an ambulance in fact. Fingers crossed I hear from hospital in next day or so, she did want it done urgently and that was Friday so... Cheers

Yeah I thought it'd be something like that which was why I was very upset they didn't do it whilst I was an inpatient was bizarre one Dr would come round and order an ultrasound then the next would order a ct scan then the next would say let's just go in with a laparoscopy. Oh well going to phone Dr in morning see if I can get something stronger for the pain in the meantime

Solpadol is 500mg paracetamol and 30mg codeine it's just a brand name for it, that's what I had before this pain started and the dihydrocodeine is supposed to be for that as it's about 1.5 times stronger than codeine apparently. No in really boring don't smoke nor drink don't go out at all either tbh too tired and in pain for that. Thanks for reply
  11. Hi Have suffered from fibromyalgia for about 10 years now resulting from a 3 week stint in hospital with glandular fever. I've tried all the usual stuff they offer antidepressants, pregabalin, tramadol and at present am on top whack cocodamol 8 tablets a day. Anyway that's been stable for awhile with painkillers although I had to buy an auto as couldn't face gear changes anymore and I use a walking stick. 4 weeks ago came down with abdominal pains, saw GP who poked me and gave me antacids. Week later went back as pain much worse and was referred to emergency assessment unit at hospital (took an hour to get thru on phone) I spent 4 days in hospital 2 on nil by mouth (with no drip) they did 4 blood tests and on the Sunday said you don't have appendicitis go home despite no other diagnosis just have a weeks worth dihydrocodeine and we can't always explain abdominal pain we think it'll go away on its own. So went home, phoned GP Monday morning he was horrified, didn't believe me at first that they hadn't done any scans etc until he had seen discharge paperwork. Ordered emergency ultrasound which had a week later (after chasing hospital). Ultrasound showed fatty deposits on my liver but gp doesn't think that's the problem. Saw different gp Friday who was again flabbergasted that hospital did nothing, she's hand picked a non-surgical consultant to refer me to and ordered up CT scan and endoscopy (all of which could have been done during hospital stay and we're discussed in front of me, no idea why they weren't done). I know I've got to wait now but how long does a referral take, ct scan wait? I'm in constant pain, on 30mg of dihydrocodeine 4 times a day. If I get out of bed for more than an hour or so I'm in incredible pain despite painkillers. GP has signed me off till Christmas which doesn't inspire me with much hope. I've lost about 5kg in last month and I'm only eating one solid meal a day too. I've tried asking for more/different painkillers but was refused. Anyone have any thoughts or suggestions? I'm going to put a PIP application in tomorrow as been thinking about it for awhile due to the fibromyalgia I know that's a long uphill battle as a separate issue. I also have a complaint in with hospital due to the way I was treated when there. My dad had non-hodgkins lymphoma when he wasn't much older than me (I'm 38 now)and in his late 50s had a kidney removed due to a deep tumour in it. So have the cancer thing running thru my mind 24/7 too. If anyone has any suggestions or thoughts I'd be really grateful as stuck in bed fearing the worst.

    Ahh so the original entry should be marked satisfied as they've sold it and effectively been paid for it and the active one belonging to the dca. Given its about to be 6 years do you think I should just leave it till June and let it drop off my file? Anxious about potentially making things worse.

    Appreciate what you are saying but I'm just repeating what Equifax are saying on my credit report: 2 defaults worth £1300. Not 1 default worth £650.

    Ok I think i'll let sleeping dogs lie until after June as it's only a months difference between the two dates. What bothers me most is that Equifax list this as being two separate defaults so have doubled it up to two defaults totalling £1300 instead of one for £650. So they're definitely viewing the entries as two different events. Oh i've just realised they have my name wrong on them both as well not to publish my name but as an example if my name were: Frank James Wilbur They have my name down twice as: Frankjames J Wilbur It's not much and it probably doesn't make any difference to anything but it both amused and annoyed me in that they couldn't even get that right - mind you this was from Satander (deliberate typo) formerly Abbey so no suprise there either. Oh and neither are marked satisfied as they never were

    The original abbey one is dated May 2007 for the default then says updated June 2009 next to that entry The one under Hoist portfolio holding is then dated June 2007 then says updated June 2009.

    Hi everyone I've just been checking my credit file and i see the only bad thing on there is from an old Abbey debt from an overdraft i disputed. Amount was for £600. I see a default registered by abbey in 2007 no problem the it says updated 2009 and there's another default entry from April 2009 from a debt collection co. Is this right, can a debt collection register a fresh default when they buy a debt? As obviously its 6 years this year from 2007 the original debt, but not 2009 (assuming that's right?)
  18. Right will have a read thru all of that and see what I can put together. Am also putting a complaint to the court as we phoned them twice and both times were told it hadn't been cancelled even though it had been so the court aren't blameless here either
  19. Hi Stu I've just started detailing the complaint. I think you've missed a link on that last part I presume it's something from charity commission website? If you could point me in the right direction there i'd be really grateful. Cheers PS still nothing in writing from them confirming no further court action despite asking on the day......
  20. Well well well. Went to court thus morning despite being away on holiday, came back especially arranged childcare. We went to sign in with the court usher and...... there's no case listed. Usher goes off to investigate finds another member of the HA staff and asks her she phones the lady dealing with our case who is just walking in the building. After a chat with her we go down to the court office and she's told by a rather annoyed supervisor/manager that the case was withdrawn by the HA on 8th Oct AND he said (looking at us) this happens a LOT with thus HA. The HA have no individual logins to the court system so they can't trace it back. On the plus side the HA rep was so embarrassed by the whole thing that she's not going to reschedule to go for costs after all. My thoughts are given the circumstances I don't believe they would have gotten them anyway. Formal complaint will be instigated next week over this but it appears to be a huge mess! Anyone have any further thoughts on this, whole thing seems a joke to me
  21. Yup already got the letter ready to go off to the HA instigating formal complaints procedure. Funny how they have said to us today that they are going to have to change their advice/procedures after this. Seriously are we the first people to have gone through this situation? Will keep this thread updated with what happens. I feel quite prepared now so lets get it over and done with... Thanks
  22. Court papers now all done and in the post tomorrow along with copies of all emails and payment receipts, all marked up for the court
  23. Spoken to them again, they're adamant that they have to go to court to get costs awarded (although they did admit that the judge might not award them anyway). We're going to file a defence and we're going to attend.
  24. Still no further forward. No one knows what's going on. The court have no clue why the above says withdrawn they say it isn't Haven't managed to see cab or shelter as they're too busy will try again at drop in this week. can't file a defence online for above reason will now have to post and hope they're OK with that despite it being way after the 14 days. Might get my MP involved today see if that helps Still making phone calls..... .

Will find out more tomorrow.
