Hi anyone see the article in Daily Mail - 14.10.09 (u can also view online in their Money Section) about people who use the "unenforceable debt" phrase because lenders cannot supply agreements etc. Anyone know any more about this or the judgment? or how we are able to find out more info.   3. Hi Default Notice etc is correct. Finance is VW Have just been reading SU76's saga with VW and all your assistance there! Perhaps I should apply for a Time Order (to change terms of hp agt) - although had been waiting for VW to reply to my offer of reduced instalments. What do u think? As I am now in receipt of disability living allowance will not have to pay court fees etc for the Time Order application.
  4. Hi both The dca is the chicken farmers - dlc direct legal collections or (hillesden) thier other name. How do u mean I would be entitled to all payments. Default and Termination has been served. So going to fire complaints off tomorrow!
  5. Hi Have car on HP but more than a third paid - so they cannot reclaim car without court order. No court action yet to my knowledge. However, it would DCA has instructed agents to call at my home address with transporter! to collect vehicle. Called for SECOND time today! What are they playing at. Intimidation and Harrassment comes to mind. Have offered reduced repayment plan to car finance company - but no response as yet. Any ideas folks - I would love to get the DCA in court!
  6. have u checked out about "Time Orders" which can vary the instalment on a HP agreement - which I mentioned to you before. National Debtline will be able to tell u about them tomorrow - or just google the phrase and do some research
  7. Just a suggestion. Are you abe to make any monthly payments to MBenz? If so You could check out a legal scheme called "Time Orders" - google it etc where you would apply to the local Court to have the terms of the hp agreement varied - as long as u could provide evidence you needed vehicle and were able to pay the new figure. or You could try & negotiate with MB and state that if MB repossessed car - it would go to auction - and in today's market it would be sold for a low price - and you would be laible for difference. Would you they agree a lower repayment plan? Makes sense for both sides. Just some thoughts for you

  9. Hi Have received from AEGIS a postcard ! - saying they are going to call on me between 8.0am and 9.0 pm.!! Shall I bake a cake?! You know these DCA's should NOT be allowed to send out correspondence like this - I can imagine that someone with no knowledge of this site or their rights - would really be harrassed by such correspondence. I have reported AEGIS and MBNA to Consumer Direct and the Office of Fair Trading and submitted my complaint. Do the same if you get hassled by them!
  10. Hello I have had a similar postcard from AEGIS. Do not panic. These cards are sent out to harrass people - and this tactic is not allowed by the Office of Fair Trading who are supposed the licensing authority for debt collection agents. They are NOT allowed to call without an appointment. IF they do turn up - just shut the door. Do not be frightened by these people. I am submitting a complaint to the Office of Fair Trading and Consumer Direct about this company. Just continue with your token payments if that is the arrangement you have come to.
  11. Hello Received arrears letter from AEGIS Ltd on behalf of AEGIS BPO SERVICES LTD in a MBNA envelope from Chester. It states on the letterheading that the Registered Office is in Mumbai, India - ( part of a large Indian based Group) but states please do NOT send payments or correspondence there!?! - But of course to fone them! So where do you write to? I thought it was against company law not to have a registered office address and company number on a letterheading - or is this just an example of a DCA flouting the law. I am reporting them to Office of Fair Trading. Anyone else had correspondence from them or tel calls? What do MBNA /Abbey think they are up to !! Just not acceptable.
  12. Also, Metropolitan and DG Solicitors (if it gets to them) are in house collections departments of HSBC Group - and not external companies as they like you to think!
  13. Not sure but think a TV Licensing Enquiry Officer called at front door today. Had been paying my £5 per week but fell behind. Will not be opening my door next week. How far will these people go?!!! - Sunday calling! anyone had similar? Be good to hear
  14. Hey anyone know how these guys deal with things? I cant cancel the cheques because they have written cheque guarantee card details on back? Any advices greatly appreciated! Got to deal with it by Monday !
  15. Have payday loan of £500 due next week at ....% interest!(too high to mention - but needed funds at the time) - now circumstances have changed. Will they still bank the 4 cheques totalling £500 which they hold with my cheque guarantee details on back - or how do they deal with people who dont pay. Any advices would be appreciated - just need to be prepared on how to deal with them and my bank. Many thanks and Happy Christmas:)

  17. Have £500 of payday loans due on 30 Dec. They hold several cheques totalling £500(or have passed them on to a third party or Head Office). Due to change in employment Cannot continue with them or afford to pay them the £60 to roll over for another month. - at whatever interest rate it is!! Will they bank the cheques they hold ( then my bank will bounce them or pay them as guaranteed by cheque card ) - what alternatives are there? What do you think they will do or offer. any ideas? anyone know? your advices much appreciated.

  20. Even more of your personal data to be added to your credit file info! Experian will advise the balance each month on your credit card/store card and the amount you repay each month and the number and total value of cash advances you take on your cards Where is all this personal data info going to end!!?? What privacy are we entitled to? Does this breach our human rights? All food for thought!
  21. Hi I've scanned document - but it really is not worth uploading. As the loan was in 1995 did they at that time have to supply all the info. The so called flexible loan worked on the basis of a credit limit - and you paid 3% each month - and you received a statement each month like a credit card statement - but you could not withdraw any further funds - it was on a reducing basis. Started 13 years ago and still a balance outstanding- makes you realise if you just make min payment each month.!! As I said there may be some charges on my account for late payments etc.- bu thought best not to rock the boat so havnt SAR,d them On the copy sujpplied by the DCA - there are no terms etc - e.g if you missed a payment etc - unless they were on the back of the document - but not supplied. (But perhaps they did not have to state these in 1995) Also, on the document some areas are quite clear, such as my name and address, loan amount required, and the rate of interest - and if I wanted Payment Protection Plan (just noted - here it says details on reverse) but reverse not supplied -the rest is just smudgy - a bit odd! There is also a section where it states "Your Right to Cancel" and I have signed in a signature box and there is a date. Also, oddly - there is a box for "Bank Use Only" which has been signed by them and dated and a loan account number inserted - but nowhere does it even state its the Coop Bank - just "The Bank" - on any part of the form as far as I can see. Hope this helps!
  22. hi thanks for reply its the dear old Coop Bank I will try photobucket - but copy is quite illegible - in places anyway! balance is now about £260 - but there may be a lot of charges and I havnt SAR'd Coop. Thought best left alone. A good idea or not? thanks for your help

Have received what appears to be copy of Loan agreement dated from 1995 - which appears to be an application form - but in the box where I have signed states "This is a Credit agreement..... but not very legible on copy sent to me. also it mentions "loan amount required" ( Ihave put £3K) and mentions the apr bUT THERE ARE NO TERMS NO THE INFO SENT TO ME, for example, does not say how much each month etc Shall I just write back to DCA saying illegible Advice please - many thanks

Hi Have been waiting for copy CCA agreements from a DCA - but should I also SAR the credit card companies as accounts also included arrears charges which perhaps I could reclaim, and form part of the balance. Or will this open a can of worms! And if so , for example, Do I go back 6 years from today? Your advices would be appreciated.
  25. They have already got a charge on your property through the mortgage - so do not know why they are getting stroppy. Go to the CAB - HSBC have supposed to have changed their procedures and be more understanding about these things. The guys troubling you on the phone are commission based - so just ignore them - deal in writing only.
