  1. Thanks for yr messages. I was also paying £! per month till June last year. I have disputed the balance. So they have passed the account to Moorcroft - which has now been passed to Capquest. Under the OFT (when they existed) it was bad practice to pass from one dca to another! So do the FCA now consider this to be bad practice? Who knows?

  3. Hello Have a debt with NATWEST which is being passed from one debt agency - they give up and then NATWEST pass to another debt agency. In the old days under the OFT this practice was against their guidelines. Now the OFT is no longer there - do I complain to Financial Conduct Authority? Your advices would be appreciated. Iam 71 years old and have several serious health conditions and this is driving me mad.
  4. Hello I have old credit card debt on a NatWest credit card. I had been making nominal £1 payments a month for the last 4 plus years or more until last June 2015 and they passed to Moorcroft. The balance is £1200 but I dispute £700 of it - mostly interest and charges. Nat West have now passed the debt from Moorcroft to Cap Quest. I am totally fed up with the whole thing. What is the best thing for me to do. I am fed up with all this harassment. I am 71 years old and have heart problems etc. How do I draw this thing to a conclusion? Your advices would be appreciated.   5. Hello After a long time The Financial Ombudsman instructed NatWest to pay out on my ppi claim. However, Nat West have sent the payment to their Credit Card Centre as there is approx £400 outstanding which is all DISPUTED interest and fee charges. I know about the right of set off etc - but as the £400 is disputed I believe their action to be unfair as they propose to deduct the £400 from claim. any advices would be appreciated.
  6. Hello Just some advice please. A friend has a debt with Lloyds who have passed the collection to Bryan Carter solicitors. she has received papers from her local county court to take part in a mediation (?) telephone call in connection with the debt. Is this a new procedure through the county court? What happens if she chooses not to take part? Is this just a form of intimidation. The debt is approx 4K - she has asked for copy agreement etc from Bryan Carter and Lloyds - but no response. Your views would be most appreciated. Thanks

  8. Had a cheque account with Cahoot now Santander - then financial problems back in 2007/8 - Cahoot issued Default Notice in 2009. I found my copy of the agreement for the bank account and it states it is a consumer credit agreement?! Also havnt paid into the account since 2007 so is it now Statute Barred? Made a complaint to FOS about all the interest and charges they had added to my account - and FOS ombudsman said Santander had to refund £1500 worth of interest and charges to the account - which happened in 2011. Santander have now passed to a DCA. As the payment from Santander of £1500 was in 2011 - does this affect the Statute Barred position? The monies were not from me. The balance still outstanding is £1200. Your advices please on how to proceed. Many thanks
  9. Hello Coop sold my credit card debt to Lowell 12 months ago. Since then I asked Coop for copy statements under SAR - and have told Lowell that have been waiting for the copy statements. Have now discovered that the last payment of £1 was paid to Coop in Dec 2007. What do you advise ? Shall I tell Lowell it is Statute Barred? - What is their usual reaction? I have several serious health problems including heart failure and 69 years old. I cannot keep dealing with these matters = it does not help my health. Your opinions appreciated. p.s Coop never wrote to me for the last 6-7 years.

Hello Have Coop credit card debt - requested SAR and copy statements - but COOP still charged full interest and charges when they knew I was in financial hardship and sometimes EVEN WHEN I WAS MAKING TOKEN PAYMENTS. i HAD NOT REALISED AT THE TIME. SO HERE IT GETS CONFUSING THE OFT GUIDANCE STATES THAT CREDITORS SHOULD CONSIDER REDUCING OR STOPPING INTEREST IF SOMEONE IS IN FINANCIAL DIFFICULTY. THE IMPORTANT WORD BEING "consider" I SUPPOSE. THE FOS I UNDERSTAND ARE NOT UPHOLDING COMPLAINTS CONCERNING REFUNDS OF INTEREST ETC. SO WHERE TO NOW? THE AMOUNT OF INTEREST ALONE I HAVE CALCUALTED IS TO BE SOME £800. SO I MAKE TOKEN PAYMENTS - YET THE COOP STILL GET THEIR MONEY PLUS INTEREST AT THE FULL RATE. IS THAT JUSTICE? I DID NOT INTEND FOR THIS TO HAPPEN WHEN I TOOK OUT CREDIT CARD - BUT SERIOUS ILLNESS AND NOT BEING ABLE TO WORK CAUSED FINANCIAL HARDSHIP. ANY IDEAS HOW TO APPROACH THE NEXT STEP?? THE ACCOUNT GOES STATUTE BARRED IN 30 DAYS! MANY THANKS:-)
  11. Hi Have had payment plan for TV Licence. My current licence on plan starts 1 June 2013 to 31 May 2014!! There is a plan to cover this period - but as the amount for the TV Licence is for a FUTURE PERIOD - How can they pass to DCA? Am I missing something? Any advices will be appreciated:|:roll:
  12. Hello Yes I have asked for copy of credit card agreement started 1997. They state they do not have a copy. I am currently paying £1 per month - £1300 to go! The default ends May 2013 I want to see the statements for the years 2000 to 2006 and what arrangements were entered into to make the fixed payments per month back in 2006 to 2008 - also I am sure that I had ppi - although Nat West Insurance services say no. I was seriously ill at the time and cannot remember all the details. I am getting fed up with the whole thing its been draging on for years! Advices appreciated.
  13. Hello I requested SAR on NatWest credit card - they sent me copy statements for the last 6 years and a few typed notes going back a couple of years. That's all. I have been making nominal payments. Trouble is I want to see older information to clear up some queries I have in my mind - namely PPi and why I was paying a fixed amount each month some 5 to 6 years ago - e.g £40 per month - BUT they charged interest of £26! I was in financial difficulties at the time. NatWest say I did not have ppi when i TOOK OUT CARD - but cant provide copy of application form. How can I trust them? Are they obliged to provide this older information? Or can I raise specific queries? Any advices greatly appreciated.
  14. Hello Lowells purchased some old credit card debt from Coop in December - along with a lot of other people it would seem! Anyway - on checking my credit file - (which they must like!) - they have made 7 unrecorded enquiries with Experian since December 2012. Is this abuse? Who do they think they are? Who do you think I should complain to - Lowell's and ICO
  15. Many thanks for your replies. Lowells have searched my credit file FIVE times in the last month. Is it all neceassary? How do u complain about this? Also, Coop SHOULD have sent ANNUAL STATEMENTS - but have not. Is this a breach of Consumer Credit ACt? Anyone know when this came into force under the Consumer Credit Act? Your advices appreciated.
  16. Hello I had credit card debt with Coop. In 2008 I wrote to Coop and advised copy agreement they supplied was unreadable and requested ppi information. I never received reply or any other correspondence. That is until now - as the debt sold to Lowells - and they now require payment. I thought under the Consumer Credit Act that an annual statement should be sent showing the outstanding balance. So is this a breach? - or just a tecnicality. Any advices guys how I should proceed? I still need to get response from Coop about the ppi.
  17. Hello They have been charging monthly interest and some fees. Both are on credit card debts. I have not worked due to ill health and they are aware of this - and my income has dropped and receive Disability Living Allowance and pension only. So I complained - both basically responded by saying that they were able to charge interest and charges as that is what the Terms & Conditions of the cards state. So no concessions. Would you consider that to be fair? On other credit cards they have stopped interest etc - but NatWest and MBNA refuse. Do the OFT or the banking regulations have any guidelines in this respect?
  18. Hi Seems to me that the banks are making a stand about NOT refunding interest and charges even when you are in financial hardship. They state that the charges/interest etc applied to my account are in line with the Terms & Conditions of Use which I agreed to when I signed application form. Are they trying to fob us off? Also, the FOS seem to adopting a similar stance in that they state it is the bank's decision and not theirs. Who do the FOS receive their income from - is it from the banks? Or am I being too cynical here. Anyone any suggestions about my next step here. Many thanks
  19. So what happens when "LIBOR" has been "manipulated" by the likes of Barclays/NatWest/HSBC etc. And we end up paying more for our mortgages than we should do? - because the LIBOR rates are higher then they should be. Who do we take action against - or make a group claim?
  20. Hello I have received a default notice dated April 2009 and Sept 2010 for the same debit- both from the same lender. How do I get the Sept 2010 default notice removed?. My credit file shows the Sept 2010 default notice.
  21. Hi Where can I find the info about dealing with DCA chasing overdrawn balance including charges? I think it is not covered by Consumer Credit Act? and they have to serve enforcement notice etc - Any help greatly appreciated.
  22. Or Is it the debt collection indistry just riding roughshod over consumers in general? Who do we complain to? The OFT? They do not deserve a licence. The BBC reported on this company - lets revive the adverse reporting on this group.
