Appeared in court where the case was put back due to bank not supplying defense, they have now responded offering full payment + costs of action but no interest. My only query is their final liner - " I accept the offer of ***** in full and final settlement of my claim against the bank " - is that statement if signed with regard only to this claim or to all claims against the bank -

Checked with court CB have notified of their intention but have not lodged or supplied me with any defence. Case comes up in a couple of days what is recommended procedure? and how should I approach? -
The following punishments can apply: Fly-tipping fines are up to £20,000 and/or 6 months' imprisonment. Fines are unlimited if the case goes to the Crown Court or up to 2 years' imprisonment, and up to 5 years if hazardous waste is dumped. All householders have a “ Duty of Care” to ensure their waste is disposed of properly and to take reasonable measures to ensure their waste is passed to contractors registered to transport and dispose of waste and to ensure that bins or bags are only placed out on collection day. I find it astonishing that in five years you do not know your collection day! Waste placed out for collection on “ refuse collection day” should be placed in your bin or appropriate bag, side waste beside a bin waste will be treated as “ fly tipping”.

Small claims up next week bank have offered difference between fees and the OFT £12.00 . I have yet to check whether this is in addition to cheque already received or in place of it. Banks letter is written without prejudice and states that it may not be referred to without written consent but then states that if offer is not accepted that the bank will refer the court to this letter when deciding the expenses to be awarded - surely without prejudice is a two way thing -

Sent letter back saying would accept as partial payment they came back with the encasment taken as full and final crap - Think I'll just hold onto cheque and let the small claim rumble on. Secondly I have another seperate claim calculated, LBA'd and refused second LBA sent with no response - this claim will require quite a few small claims what would folk reckon Do I make the small claim and wait for a result then put the next in or do I just start a series of small claims a couple of weeks apart? -

Response back stating that if the cheque is cashed, it will be taken as full and final settlement, and taken as acceptance of this. ???????? -
YORKSHIRE BANK CHARGES

You can change these to four weekly Standing Orders the banks will do everything to avoid telling you but they are possible to get set up. Remember you will be making thirteen payments in a year rather than twelve - keep at existing level of payment to avoid underpayment -
Listened to this and the banks representative was full of umms and ahhs and didn't want to talk about specific charges but thought that we should be discussing generic charges.

That's what I'm doing - preparing the paperwork to take them to court for the remainder of my claim. -
Account maintenance charges not claimable possibly

Clydesdale have a maintenance charge of £7.50, on overdraft accounts, which is chargeable whether account is in credit or debit. This is an agreed charge and cannot be claimed back service charge which is made in the weeks following an alleged misdemeanour is a penalty! and should be claimed back. -

Well as expected another refusal to my first LBA, second one is now heading out. They must have some customer relations section up there I have rarely got an answer from the same person. -

They are bluffing, if he takes them to court using the small claims procedure he is not liable for any costs apart from the initial cost involved in starting the action (£39) which he will get back when he wins. This lot will stall, squirm and use any tactic to put you off - don't back down but be prepared to follow through to the end. -

That figure is just for initial request, fully expect to have to go through the procedures again whilst they stall at every opportunity! -

Due to work pressures I had been unable to get to the court but finally managed it today. So that's another one to court. Additionally I have now requested repayment of approx £2500 on my current account , so lets see how things go? -

On my account I have £22.50 irregular penalties and £22.50 service charges and I have claimed everything apart from any agreed costs. Claim the lot and let them prove whether they are justifiable charges -

Well thats the LBA totally ignored so its now time to visit the local sheriff court and get the claim entered -
Sounds to me like contaminated bins or alternatively the wrong bin out for collection. A couple of days outwith your collection day really shouldn't be that much of a hardship for a bin containing garden waste and cardboard , and is nothing to do with your black bin for residual waste being full. Most councils run a pick up with alternative vehicles to avoid contaminating large loads. Additionally most have amenity sites where extra rubbish can be taken. If you feel you cannot wait it is your option to hire a skip but you cannot expect any council to pay for it. I would suggest you call back and without being objectionable explain your situation and ask for a solution.

My account is a silver account which charges me £7.50 a month for ????, this I accept as a charge but everything else, late fee, irregular fee, card misuse, bounced d/d or s/o and service charge are as far as I am concerned all penalties. You get a service charge in the month following alleged misdemenour so for exceeding your limit you are charged £45 for a bounced d/d £55.50 -- reasonable no way! -

First request for charges back sent in and first letter refusing same back from CB. Will leave for the fourteen days and issue an LBA. Think I am going to be busy for the next six months -
Any info on the relevence of these cases?
