  1. I have received the following letter from CapQuest along with a Form 6.1 Statutory Demand under Section 268(1)(a) of the Insolvency Act 1986, reproduced below. As far as I know I have not been taken to Court over the alleged debt (£1426.53 which includes £114.16 accrued since the assignment of the debt). I got the Capital One credit card in 2002 but serious ill-health in 2004 meant I fell behind with the repayments. I can't afford to pay this amount of money, which I dispute anyway, and am worried sick that I will lose everything. I do have other debts. Capital One refused to provide a breakdown of their costs and an explanation for them being levied. They were only willing to provide statements for their claim if I was willing to pay for the statements. This was during a telephone conversation with them a few years ago. Furthermore, the amount of debt and accrued interest penalty charges would have meant the debt would have only been a three figure sum. The amount has been in dispute since that time. I believe the debt may have been sold on several times. I have been harrassed on the telephone to such an extent that I changed my telephone number to stop the harrassment and now let my answerphone monitor any incoming calls. Please tell me what I can do. Letter from CapQuest: CAPQUEST DEBT RECOVER Dated 29th July 2008 (Received Friday 15th August 2008) Dear Mr XXX Enclosed with this letter is a Statutory Demand for Bankruptcy which you will need to read and review. This action is unfortunate, however necessary to bring this matter to a conclusion. All the relevant information and how to deal and respond is on the Statutory Demand document which we would ask you to read very carefully and action by the dates stipulated. If you need help or clarification we would suggest that you seek the advice of a solicitor or reputable financial adviser. Alternatively contact our insolvency department immediately on 0870 084 2565 quoting Ref.: XXX where you can discuss the best option available to you and stop this process. In addition if you have access to the internet you can go to the Government website Guide to Bankruptcy by logging on to (won't let me put the URL to the government's insolvency website) We trust this can be resolved without the need to proceed to the bankrupcy stage.
