  2. I am struggling to reply to Halifaxs response. Could anyone please help? The document headed "Credit Card Agreement regukated by the consumer credit act 1974" Firstly headed "Parties" with my name and address (my new one -not the one I got my credit card at intially) It goes on to say it will let me know my credit limit . Under the heading "other fiancial information" 3.1 states - total charge for credit is £188.72 consisting of £188.72 interest. This is based on credit of £1500 being borrowed at the start of the aggreement over one year at the standard interest rate for purchases set out in condition 3.2. Under heading 4.1 It sayd it will charge £12.00 each month when a minimu payment remains outstanding. £12.00 each month if ou go over your credit limit etc - all my charges previously were £25 . It has no signiture either though I don't believe that is required? This looks like a new credit card agreement but i do not know how to word it in a reply. I am struggling to get my head round the CCAs . Thanks in advance
  3. I wrote to Halifax requesting a copy of my credit agreement. In their reply they claim to have sent me a copy of my executed agreement, current terms and conditions and a signed current statement. What I actually appear to have been sent is a printed CCA which has my current address printed on the top (not the address I was at when the credit card was opened); current interest rates and current charges for outstanding payments (when I took the card out those charges were £25 each, this CCA says that they are £12). It also has a date at the bottom of the document which I think may have been when the document was created, it says T94R TEASER 01/10/08. This new CCA is not signed and is not on Halifax headed paper. It just seems that they have printed off a current CCA and sent me that instead of a copy of my original agreement. In the cover letter it also says that 'by providing you with the documents attached to this letter, we have satisfied our obligation to provide a copy of the executed agreement under Section 78. As such the agreement you have with us is fully enforceable and we shall continue to treat it as such. We will not be entering into any further correspondence with you regarding the requirements relating to the provision of the copy agreement.' I would like to know if I have recieved the correct documentation as they say I have, and if there is further correspondence that I can have with the Halifax re: my original CCA? Where do I stand with it? Many thanks for your time abi113
  4. Firstly I made a HUGE mistake and let him in and he listed items (a walking possesion I think??). I made the first payment on time and I am now late with a payment . I willl make the payment up to date tonight but even if I keep up to date with other payments can they still claim possesion as i once defaulted?? I am in a wild panic now and expecting them to turn up at any point. My mum is paying it all off for us (we are paying her back) in about 2/3 weeks as the agreement is unmanageable . How soon after you have defaulted might they turn up for possesion?!? I am absolutely terrified. To clarify - Payment was due on 26/11 and I will only be paying tonight. I haven't heard anything from them. PS Also I imagine a full and final settlement with a baliff is not possible? With Thanks
  5. ..stuck again. They have sent a cheque for £1336 and won't send a letter confirming what they verbally offered which was the above cheque + all the negative charges cleared and no longer persued and the default removed off the credit record. Can anyone point me in the right direction for the next letter to send? Also do I send the cheque back or accept it as part payment even though they said it was a FULL AND FINAL offer With thanks

  7. I wonder if anyone can help, I am rubbish at this kind of thing but begrudge paying it but don't know what to put in my letters and where to send it. I ordered a phone in August and the company,onestopphoneshop, sent it to the wrong address. The person who recieved it (another number on the street) sent it back to them saying unknown at this address as they didn't know it was for us. Onestopphoneshop refused to resend us, the correct address ,the phone so basically we have been paying for a phone that we don't have. I have paid £50 so far for the first month and the rest of £150 has been sent to debt collection agency. I have spoke to carphone warehouse(who the contract is with) - they basically think its not their problem and onestopphoneshop should be sorting this out - but they aren't. DCA said if we don't pay we go to court, they have also already put a default on my credit record. At least it seems they are not continuing to persue money every month for the contract, tho I may be wrong - the debt with the agency hasn't increased. Where do I go from here? They are still sending post to the wrong address but also sending the same letters to our address. Any advice appreciated abi113

Thanks ab123uk I have spoken to Halifax and they said their offer was on top of clearing the £500 current neg charges and he also said he would ensure the default was removed from my credit rating ( I didn't even know their was one) I asked for this in writing confirming the default removal and bit about the negative charges , purely so I can reject it and go for the furthur 300-400 . The letter didn't mention clearing neg charges and removing the default so shall await the new one to reject! Feeling really confident about it all at the minute. Fingers crossed!

Hello I obtained all my statements and wrote my intial letter for request of refund of charges, this was 14 days ago and I have recieved my first offer of £1330 when my original claim was £2260 BUT I was claiming partially for charges which were still currently on my account but not paid ( ie - charges) . They have now closed my account so it appears the - charges have gone with it, if that is the case the offer is only approx £100 off the charges I have paid for. I have tried to contact the bank to find out what has happened to the negatove charges but noone can get my account details now it is closed. Would my best bet be to ring the claims department and ask them more about this? I dont want to hold out for the full whack if I am not owed it all and then I don't know where to repay the negative charges since no one recognises my account details. I hope this has made sense. I want to get it all sorted and begin the next stage but this has put a spanner in the works!! Thanks

  12. I have listed on a spreadsheet all the charges I am claiming for and wrote the letter but we currently have £-450 on our account, all of which are unpaid charges. Can I add this to my letter asking for them to be taken off? I have stopped using the bank as obv as soon as I put money in the charges swallow it! Thanks
  13. Yes I am getting 16% interest on the charges of £275 - not sure how I work out what the total interest will be though? Thanks again!!
  14. Excuse me for jumping on your thread but how do I calculate interest on the charges I have had (£275) at a rate of 16% interest since October 05? I have searched FAQ's and made another post but I am still abit lost Thankyou in advance.
