Hi Maddyrose-i`m in the same boat-i`ve got my claim against halifax stayed too... can anyone tell me how long this will last? i`ve going through old posts and it seems some lasted for 3 months or so...is that still the case? i`m struggling as it is , the thought of having to wait until the court case is decided-well who knows how long that will take...
  2. hello- i have also posted this on the general but i think here might be more relevant! I have made a claim online and have got a letter today from northampton court saying "it is ordered following the filing of a defence the claim shall be stayed pending judgement in OFT case. it also says that a party affected by this order may apply to have it set aside, varied or stayed within 7 days. I take this to mean my claim has been automatically stayed and i have 7 days to have it set aside.(please correct me if i`m wrong) so...i live nowhere near northampton-i`m outside london and my local court (kingston) is on the list of courts that seem to be taking each case as it comes. should i ask for it to be transferred? or is it too late? (i never knew i could have it heard locally!) would i have to do this within this 7 days also?? apologies for the long post! there are so many questions! its a minefield:confused:
  3. i`m completly confused!the letter from Northampton County court says : 1.it is orderd that filing of a defence or holding defense the claim shall be stayed pending judgement in the OFT case. 2. liberty to apply with an explanation note: a part affected by this order may under rule 3.3 apply to have its et aside, varied or stayed within 7 days of this order. what does all this mean ? all this is so new, i know nothing about legal matters:confused: this letter came with the banks letter saying they will defend etc. since i wrote the above i `ve been looking at other posts and it looks to me like it has been stayed...(answered my own question!) but now should i get my claim sent to my local court? (i did my claim online)i don`t live anywhere near northampton! i live in kingston upon thames -do i have to do that in 7 days too? and how would i go about it? what would my chances of having the stay lifted or should i just leave it but i`m not really sure what happens next aswell... i`m on benefits due to illness ....sorry for all these questions but it is so confusing! with grateful thanks in advance!
