  1. I know I should gave chased it up sooner but I have been I'll and in hospital, still recovering so don't really feel up to getting into a dispute with them. Did vauxhall demand the £245 upfront? Or would they have invoiced you?
  2. I have just checked my agreement and it states under charges ' goods collection fee on voluntary termination of the agreement by you-£70' I have returned a car previously about 6 years ago to Santander and they did charge me £60 to collect it.

  4. Thanks for your reply. The finance company is FGA capital. My work hours have been reduced by 75% so money us so tight at the moment and the cheapest I could find for an MOT is £45 unless it's done with a service. The car is a fiat. I think it could be Manheim auction house as when I googled it the nearest one is just over 18 miles away. If they have to collect on a low loader do you know how much they will charge me? Do I have to pay it upfront? Or do they invoice me. The latest car payment came out 5 days ago so I've no spare cash at moment till next payday. Thanks
  5. Due to drastically reduced hours at work I am doing a termination on my HP agreement as I have paid over 50% of the amount due and can no longer afford the repayments. I sent a letter 2 weeks ago, 1st class they claim they never received it so sent another one last Friday by 1st class recorded delivery which according to royal mails website was delivered today (Monday). Rang them today and they haven't got it yet was told it could still he in the mail room. Advised to ring back tomorrow. I am told I have to return car to auction house 18 miles away from my home. They seem to be dragging their feet. My problem is the MOT expires on Wednesday and I simply can't afford to get it done. They said if will have to be put through as a non runner now ( the car us in mint condition with new Tyres, no marks or scratches and no known faults). Could anyone advise me where I stand if they don't process it by weds. They said they will have to puck it up on a low loader but will charge me for it. Any idea how much it will cost me if it comes to this? I have taken plenty of photos of the car to prove it's excellent condition. Also they say I will be liable for any costs to get the car roadworthy. Is this true? Car has only done just over 24000 miles with both mots (it's an 07). Company I'm dealing with is Fga capital. Any advice or comments much appreciated.
  6. Hi, I booked a holiday for myself and my family and invited a good friend to come along. She accepted and paid her share of £311. Then my sons school informed me that he could not have the time off school due to it clashing with his Sats exams. I informed my friend and advised that she could claim off her travel insurance. Then today her sister came round to my house ramming on the door and my windows. I couldn't answer as I was in the bath and my children were downstairs watching television. I only realised who it was when she posted a note through my door saying 'the next step is the small claims court'. Please could anyone advise me on how to proceed and where I stand. I do not want to go to court and get a bad name but my hands are tied as I have not got any money to pay her as I paid it off the holiday. Am I liable to pay her the money? Would she succeed in her claim as I have not actually kept the money?? Please help me as I am worried sick about this. Thanks.
  7. I today received a reply to my letter asdking for costs and this site even got a special mention. It goes: Dear Madam, Re:*********Phoenix recoveries We are in receipt of your letter dated **th September and note its contents. We do not believe that you have incurred any costs in connection with this matter. Proceedings were issued on **th Aug and discontinued on **th Aug. During that thirteen day period the only action you took was to file a defence which appears to have been taken from a debt internet forum and would require little 'research' on your part. No letters were sent and we fail to see how you can possibly expect the Court to believe you have spent £*.** on printing, stationery and postage or spent one and a half hours letter writing. The costs you claim to have incurred are neither reasonable nor proportionate to the size of the claim. Proceedings were discontinued for commercial reasons and the debt remains outstanding. To dispose of this matter we enclose a cheque in the sum of £18.50 in settlement of your claim for costs. Yours faithfully Bryan Carter and co. Any thoughts, suggestions of comments much appreciated. Oh and still no CCA so they are still in default.
  8. Just a quick update. Sent a letter to Capquest requesting the costs of £42 by return of post made payable to .....[us]. And lo behold a cheque arrived by special delivery this morning!! Seemed very easy so it better not bounce now!!!
  9. Yes I made it clear that the payment was for the CCA and nothing else. Will try the letter by recorded delivery today.
  10. I received a letter from Moorcroft stating I owe £1900 to Choice catalogue [more like £1550]. I sent them a CCA request and enclosed the £1. Ignored so I sent again recorded delivery and received a letter back. They told me they were in receipt of my £1 payment. No mention of CCA request but they needed to have a payment plan in effect immediatley. If no arrangement was forthcoming in 48 hours they may start legal proceedings. I have not paid or acknowledged this debt in over 6 months. Any advice on next step much appreciated
  11. Hi, Just as you predicted I received the notice of discontinuance this morning from Bryan Carter. Where should I go next? What costs can I go for now? Still no CCA.
  12. Don't worry. I know that is easier said than done but the judge was very nice. She said 'Hmmmm, Capquest well they've not shown up'. Didn't seem like she was too surprised. Funny thing is we still don't actually know what the 'debt' is for!! I wish she had ruled than they HAD to give us more information as we are still in limbo really! Good luck for tomorrow.

  14. UPDATE! The set aside hearin was this morning and was successfully set aside!! Capquest didn't bother to turn up, told the judge we didn't have a clue what it is and she said as they haven' bothered to show it will be now set aside and awarded us £42 in costs. Are we also able to to claim back other fee we have incurred such as petrol, car park, time spent preparing for this, etc? She said they may try again with this but they have not provided any evidence in the 28 days stated in their letter dated 2nd of Aug. To anyone else who is going through this at the moment I hope this information has been useful to you. The hearing lasted less than 5 mins. Thanks to everyone for all the help and advice to enable us to take it this far. Just looking for some advice with claiming costs and the covering letter to Capquest. Thanks again.

  16. We were given a copy of the credit agreement showing the right to cancel but nothing from their contract which he claimed they filled in at the office. We have still not had any copy from this.
  17. We wanted a price for a conservatory so we had a salesman call round to give us a quote. How do we regret it now? We told him what we wanted and he gave us a quote then after a lot of pressure we agreed a price and signed a credit agreement in our home. Then he asked us to sign their contract which he had not put our specifications on. When we questioned this he said 'oh, we do that back at the office, I have all the requirements here'. They rang us later than evening to confirm we had the credit check ok. That was the Friday. Fast forward to the Monday the surveyor finally turned up 4 and a half hours late! He informed me that a wall in our garden was unsafe to build against and we would have to pay another £1295 on top of the original price. Also when he showed me the plan the conservatiry was significantly different to what we ordered, 1.No brick at the bottom but plastic panels!!??, 2.A plastic instead of brick side panel which we specifically asked for 3. The conservatory was shown as 10x9 instead of the 11x9 we agreed. I contacted consumer direct and they advised me to send cancellation notice to both the company [Homeshield]and one to the finance company which I did by 1st class recorded delivery. Now Homeshield write back to us and say we have no right whatsoever to cancel and we should refer to our contract with them. They have not even provided us with their contract!!!! And they now say they will build the conservatory without rebuilding the wall which is unsafe!! But if we do cancel we have to pay £500 admin fee and £1305 survey fee, the surveyor was here for 35 minutes!!!!!! Also he phoned the original salesman about the wall issue and I heard him say 'Well you should have spotted that problem straight away you know it would have been an issue'. Has anyone else had any experience of this? And any advice on how to proceed with the cowboys? Consumer Direct have now redirected me to Trading Standards who will phone me next week but I am sick with worry over this and cannot sleep. I can't believe how we have been conned and taken for a ride. Please help. Any advice much appreciated.

  19. No it states that the credit limit will be decided if my application is successful and no APR stated whatsoever. Basically it has my name, address and date of birth [which is wrong], my occupation and it states I am 'on maternity leave and not returning to work. My partners name, date of birth and income and my bank details and signed by me. I don't have a scanner so can't upload it. Terms and conditions cannot be read as the page is blurred and dark and writing too small.
  20. I CCA'd Collect Direct about a old M&S store card and enclosed my £1 postal order. They have now sent me back my application form and terms and conditions. Is this now enforcable? The copies are barely readable but I believe it shows my date of birth as incorrect [it is a day out] and my husbands surname is spelt wrong. I did not fill in the application, it was done by a girl in the shop and I just signed it. It was in my maiden name. Is this an enforcable agreement? What letter do I now write back to them? Also they have offered me to repay a reduced sum of £550. They claim full amount is £683. Thanks in advance.
  21. Thank you Martin. I have been dealing with this atrocious company and a SD from them for a debt I actually know nothing about and from 1998 and will now certainly report them to Trading Standards
