  1. Thanks guys. Am i right in saying that I can request the interest on top of the full fee's paid?? In my case do i need to send letter number 4? They havent sent me a cheque or payment to my account, can i still say i accept the figure they have offered as a part payment but would like the rest in x amount of days?

  3. Hi I recieved my reply from halifax. A brief summary of the letter. I am delighted to offer you a payment of £297. Whilst not agreeing with the analysis of default fees in the office of fair tradings statement in April 2006, nevertheless we reduced tehse fees to £12.00 with affect from 1st aug 2006. Therefor a gesture of goodwill this offer is equal to the difference between the amount you were originally charged and £12. The briefly go onto explain when opened the acount you agreed to our terms and conditions which explained when charges would be applied to the account. From time to time we have also sent you information about the current level of charges. This information formed part of your agreement with us and we have applied them strictly according to the terms agreed. We apply these charges because when customers fail to make a payment on time or exceed their credit limit this means additional work for us. As a result we feel it reasonable to charge for this service. Please be advised that refunds of interest will not be considered. Following my investigation of your complaint i am satisfied that the charges have been correctly applied to your account. Therefore I am sorry to advise you I am declining your complaint. However my offer of £297.00 is a gesture of goodwill and without admission of liability to resolve your complaint. Basically my claim was for a figure of approx £826 including interest, what they are offering from what i understand is the charges i have paid over £12 but will not offer any interest back. What do you think my next step should be?

  5. I sent the below lettwer last week via post which they recieved on Thursday 31st July. How long do you think i should give them to reply? Ref: 4049 I am writing to question the default charges applied to my Halifax Classic Visa Card, amounting to £828.26 I sent you the details below on sunday 27th July. You responded saying I need to call in, I have called 3 times, each time being told different things. 1st time i called i was told somebody would ring me. 2nd time i called i was told the department i need to speak to had closed (even though your email said i can call 24hrs a day 7 days a week!) 3rd time i was called i was told i need to rewrite the information to you! I am therefore resending this information to you and wish it to be RESOLVED ASAP! I do not believe these costs reflect the true cost to Halifax and would like the charges to be repaid in full. The Office of Fair Trading ruled in April last year that default charges shouldn't be above £12. I look forward to your response. Yours faithfully

Yes they are definately threats. didn't think solicitors would speak to people like that. i think my friend as now dealing with everything via post, i've told them to keep a record of each letter and send recorded deliver so that the solicitor has no way of saying they didnt recieve it as they dont seem to be playing by the book. Where can we see the civil procedure rules?
  7. if i complain about my recent 35 charge will that affect any claim i make for charges in the last 6 years?
  8. Hi, Not sure if this is the correct forum to put this on but here goes... Somebody is making a personal injury claim against a friend of mine, basically stating that they were scarred due to a piece of equipment falling on her - the customer (when in actual fact the customer actually knocked the machine by moving slightly which caused it to fall on her). The customer basically consulted a solictor and they are tryin to make a claim for compensation. The solicitor basically wrote to my friend advising them that a claim is being made against them and that their client had been to see a doctors, opticians etc. When my friend called the solicitors asking to see some documentation from the doctors, opticians etc...the solictors wrote to them with copies of photos of the small burn from the customers mobile phone. My friend then called them asking them AGAIN for copies of documentation from the doctors, opticians the customer had supposedly seen. Again the solictors sent the SAME photos again..no documentation that had been requested. Each time my friend called they had not admitted any liability as they believe the customers movement caused the equipment to fall. Again my friend called the solicitor requesting the documentation (now 3rd time this has been requested)...no reply from the solicitors. 5 months on...my friend recieved a letter stating how much compensation they required and stated that they had 7 days to pay it or court proceedings will start...without even sending my friend anything they had requested 3 times!! The quantams which were in the letter giving samples of previous cases and saying thats how they arrived at the compensation figure, were not event relevant to this case...the quantams had sample cases of children injured in different scenarios :S Upon recieving this letter demanding the compensation money in 7 days. My friend calls the solictors once again....they speak to the secretary stating that this letter was recieved but each time previously when requesting the doctors, opticians documentation my friend hasnt recieved them..the secretary said they will get something in the post but advise my friend to get a solictor (she was very rude on the phone to my friend). My friend recieved something in the post as mentioned by the secretary saying..thanks for your call and we look forward to hearing from your solicitor....again NO DOCUMENTATION recieved that was requested... Once again they call the solicitors now saying why have you sent me this letter stating you look forward to hearing from my solictor when all i asked for was the documentation on the doctors/opticians findings which for some reason they dont seem to send....so this time my friend said that they would like a medical expert report...the solictors response....you know you did it..why dont you just admit it....you know you did it....just admit it...you said you did it...i know you did it....?? my friend replied at no point have i admitted liability...solictor HUNG UP! it seems as thought the solictors are trying bully tactics... My friend now wrote to them as not getting anywhere by phone, requesting a medical expert report, also they stated that the quantams were irrelevant that the solictor had enclosed, and until my friend recieves the medical expert report they see this matter as finished as they dont seem to be able to offer any valid documentation apart from some photos from a mobile phone which are not very clear. The solictors reply to the letter again didnt answer any questions and basically said that they will not be replying to any further letters from my friend and if the do not admit liabilty they will basically start court proceedings. Sorry for the long message..but my questions are... 1. can a solictor speak like that basically saying you know you did it...why dont you admit it etc...? 2. is my friend within their right to see some kind of documentation to see what the customer is claiming for instead of poor quality mobile phone photos? 3. doesnt the solicitor need to have a medical expert report to get a true idea of how much they are claiming for instead of just writing to my friend demanding an amount without a medical expert report? 4. isnt a medical expert required to take the matter to court? From what i can understand the solictors firm is just trying to bully my friend to get money out of them easily and not going through the correct procedure?

  10. Thank you, it sure was quick. The letter they wish my to sign says the following. I accept a goodwill payment of £527.80, the equivalent to a 100% refund of default charges plus contractual interest, in full and a final settlement of my claim against the bank. Then i just need to sign and date it and send it back.
  11. Thanks, I think halifax will be long winded... If a card company says they'll refund on basis i dont claim again...should i think twice if i have an open card with them?
  12. True, the thing with my mastercard is that the account is closed? So if i decide to open one at later stage would it cause a problem?
  13. Thank you...I thought i wasnt going to have any luck what so ever!!! I though HSBC were going to pro long it as much as possible but no they were very quick to respond!! Halifax on the other hand seem to be the 1's which will take longer....and they owe me a lot more money!!!!!!
  14. For the barclays bank charges do i simply request statements from the last 6 years and then calculate charges, and then submit my claim...which will get put on hold due to the oft case?
  15. oh my GOD!! I recieved this letter from them today!! I am so surprised! Letter gave some waffle about the OFT's case..a bit further down in the letter as i am a loyal customer they are refunding 100% of my claim, as long as I dont make any further claims... Good result and speedy response.
  16. Thanks. I sent them a letter template requesting a refund of charges with interest, and the reply i got was that there was a letter sent yest which i should recieve soon...they said This letter will provide you with all information and actions the relevant department wish to undertake

Initially I recieved the email saying that I should call in to discuss the charges on the number they gave, they said they are open 24 hrs a day 7 days a week, I have called them 3 times now!! 1st call - The associate at halifax said she will email the 'relevant department' and get them to call me back. 2nd call - I called in the evening and the person i spoke to said that I shouldn't have been told somebody will call me back, they can transfer me to speak to somebody...but the department has closed for the day and asked me to call back between 9am - 5pm. 3rd call - I called this morning, and was told that i was given wrong information, i should have been told to write in??
  18. morning, i just recieved this secure message.... 'Thank you for your e-mail dated 28 July regarding the concern you have raised. I notice a letter was forwarded to your statement address on 28 July 2008. This letter provides you with all information and actions the relevant department wish to undertake. You will receive it within 10 working days at your statement address.' do you think they require further nformation?

  21. Hi, I sent a secure message to request statements for the last 6 years statements for my hsbc mastercard..which they were quite quick to send out.. I have now sent a message using the letter template requesting a refund of charges + interest from the last 6 years, which i think totalled approxomately £500. I recieved a reply saying that it had been forwarded on to the relevant department. How long do you think I should wait for a reply?

  24. Hi, Due to a mistake on my part i had a direct debit which was due out, but the balance in my account, was a few pounds less than it needed to be, due to this i was charged £35 by barclays. This has happend to me a few times in the past. Even though i had a positive balance in my linked account, its just i transferred the monies just after midnight when the direct debit had already been called for. Can i claim these charges back as i think £35 is outrageous just as I was a few pounds under what i needed?
