Hi Shadowdog I know its hard but please try not to worry.If you indeed got nothing of value and not a home owner and unemployed or on a low wage or benefits I would be very surprised if they issued court prooceedings!They can not get blood out of a stone! In your case i am sure it is a just a scare tactic and if they were silly enough to take you to court what is there to take! A judge would only order you to pay what you could afford which in your case is nothing and as you not a home owner they can not put a charging order on your home ,so please stop worrying ! There is nothing for them to take !

Hi Folks I Will send Cit B letter,However as i see Halifax seem to have at last taken of the small payment i made to them back in March as balance seems to have reduced very slightly by the small payment i made back in March I was thinking of making another monthly payment to them to cover Julys payment and then inform them that when they have acknowledged Julys payment and agreed that they will send regular statements showing other payments that go in so i can see balance going down and can see progress being made and that no other charges being applied i will pay installments for April May and June and agree a new reasonable affordable montkly repayment plan with them .As I do think it is important to be seen as being reasonable and to be attempting to reduce and edventually clear my debt with Halifax so that if they still insist in draging it all into court Judge will see i am attempting to reduce debt ,I do realise though that notifying me and acknowledging any payments i madw via pre litigation letter and threatograms not an acceptable way of acknowledging payments and will poinrt that out to them!
  3. Hi pdaddy I am glad they giving you some peace now, Once these DCAs know you will stand your ground and they can not intimidate you they will often eventually back down !I hope you have success in your SAR and default removal campaign!

Hi CitB Thanks for letter1 will send them that It is mazing they write me a letter offering to look into my issues and then dont! iif they had agreed to countinue sending me regular statements detaling any payments made so i can see progress being made and that no other charges being applied i would have been happy to keep up with affordable regular payments to reduce my debt but was not happy to see them going down a big Halifax hole!
  5. i could also argue the fact and defend on the basis that parts of the signed cca is of poor quality ,not easily legible and so does not comply with the requirements of regulation 2 consumer credit (cancellation notices and copies of Documents ) Regulations 1983 (s1 1983/1557) which provides that any copy of the executed agreement provided under any provision of the act shall be easily legible!

As i quoted in a previous letter to them that they have ignored I trust that you will accept my offer, however, if it is your intention to pursue this via the courts then I must make you aware that I will defend any action vigourously and issues of unfair relationship pursuant to s140 (a) of credit act 1974 will be raised.
  7. Hi Gaz Thanks for confirming you had a similar letter! anyway if they did take me to court i believe i would be able to put in a defmce about irrespomsible lemding and the tact that my cca is not verly legible in places!

Hi Zingy The only thing about my Halifax dispute is apart from not being very legible they appear to have a correctly executed cca:( I was wondering if this letter does mean court for me as not all Halifax victims get this letter.I am trying to find other Halifax threads where this letter been sent.

They ignored my letter i sent them telling them i was concerned that my payments were not being taken off and i was not getting regular statements showing my progress,However the sum on this letter does show they deducted an amount i paid them since last threatogram !i will write to them again pointing out they ignored my last letter and that i do wish to make regular payments i can afford on condition i will be sent regular statemens showing progress in future

  14. Hi fred Aegis! That was the first DCA MBNA set on me .I thought Aegis was one of MBNAs internal inhouse debt collectors!they normally set on people at very beggining ! They certainly going the full circle with you ! LOL.How many DCAS has your MBNA accont been passed through!

  17. Hi Dotty I am glad to see you giving robinson way a hard time and I am sure you will see them off!! I just found another letter where they put my credit limit up without me asking them!I am keeping them all as an example of irresponsible lending!

Hi Monty Thanks for all the information ,My doctor did tell me that i had quite a bit of bad cholesterol in addition to god cholesterol so assume that is another reason he thinks i neeed statins ,But your explanation makes it a lot clearer the explanation between good cholesterol and bad cholesterol!
  19. Hi PF Thanks for links! Will read them later when i get home! I So sorrry you have had bad health problems and in your case i suppose that is why you on such a highg dose of statins,My doctor wants me to take 40 mgs of simstatin a day which is a middle dose i assume.

Your blood pressure similar readings to mine:eek: The argument my doctor is using is that i should be on them because i am at increased risk of health problems if my choleserol is not borught down to at least 5! because of very high blood pressure which he argues causes my risk to be doubled of having health problems if i dont take statins! My blood pressure,unmedicated is often something like 220 over 130 which i suppose is quite high for a 51 year old:eek: well i was in my 40s when Doctor got those readings,
  21. Hi all Thanks for all your comments and links ! I will read up on them all when i get home from work today! There seems so much controversary over statins ! Trouble is i did ask my doctor about them and they tend to be very dismissive of anything negative about them and seem to think they the best thing since sliced bread and will not even consider any adverse publicity about them,.One doctor was so blinkered that she accused me of reading the gutter press! LO,l and got quite annoyed with me for daring to question her! and saying that i was implying she not good at her job! LOL which was not my intention! but doctors dont like patients reading reports and questioning them! typical doctor!
