  2. Hi. I need some advice. I am a landlord of a 2 bedroom apartment in Ealing, London. I was late paying my service charge so I recieved a letter from a solicitor that my managing agents had gone to and they had set a court date. I spoke to the solicitors, they said pay x amount which was the outstanding service charge fee + 250 pounds or so court fee and that will cover everything. So I paid it and the court was dropped and everything was sorted. A month later I recieved a letter from my managing agents demanding 610 pounds to cover legal fees that they had inccured from the solicitor. I wrote a letter to the managing agents refusing to pay this amount. I then recieved a letter from the solicitors stating that I am liable to pay for the 610 legal fees. So I paid it. A month later I recieved a letter from the managing agents AGAIN demanding another 600 of legal fees they had encured from the solicitors for my refusal to pay letter. The manging agents have sent me a copy of the solicitors invoices. What do I do here? I need some advice? this seems a ridiculous amount of legal fees to be paying. Where do I stand. Any advice would really be much appreciated. Thank you
  3. Hi guys need some help here. I got a ticket from westminister council. I wrote in an appeal and never heard back. a few months later I got a bailiff letter, so I filed a stat dec with northampton county court. I then recieved a letter from parking and traffic appeals service saying that westminister never recieved my appeal and they would like me to make a copy of it and sent it to them. I did that and now I recieved a letter from the traffic appeals serrvice saying that the adjudicator has rejected my stat dec . They said "you did not acquire a right of appeal to the Adjudicator because you made no written reply to the local authority's NTO within the statutory 28 days limit' I never recieved any NTO. what can I do at this stage? I want to appeal this.
  4. HI My car was towed by bailiffs that work for TFL for a congestion charge pcn and was sold while a statutory decleration was going on. TFL sent the original PCN to the wrong address (different to what was on logbook) and I have proofe of this from them in writing. Bailiff came and towed my car even though I told them it was used from my employment ( I am self employed). I wrote to bailiff to tell them I am self employed and I need my car but no response. I had signed a statutory decleration Out of time and this was being proccessed and while the pcn was suspended tfl gave the green light to the bailiff to sell my car. Tfl have done everything wrong, I spoke to them and they told me yea sorry the car was sold. They told me to write to them and tell them what I want them to do about it. What shall I put in writing to them. I want to claim money for my car back and claim damages. What advice can you guys give to me. shall I get a solicitor, If so do you know of any in London that have experience dealing with TFL. Any advice would be more than welcome. Thanks

Hi well its not a normal stat dec, its an out of time stat dec, whats happens is that the TEC process the out of time stat dec, its sends it to TFL and then TFL have 3 weeks (20th August)to accept it or contest it, In this case TFL contested it (14th August) and they sent it back to TEC to accept or reject TFL's decision, if TEC accpet it then the case will go into the next stage of the appeal proccess. if they reject TFL's contest then the whole matter is dropped. I spoke to Bailiff, they said they recieved instruction from TFL on 18th August to sell the car. TFL has made this big mistake and now my car is sold. The law states that the while a stat dec is being processed that the whole matter is to be put on hold. I spoke to TFL they said they will get back to me to see whats happened but have not done. my question is what are my options now? Do I file to take TFL to court and claim charges and expenses? If so how do I do this? who can I speak to about Legal advice. Ive spoken to loads of solicitors but none of them deal with this, and the ones that do charge a fortune. where can I go, any recommendation? At the moment its still with the TEC and they said the judge usually takes around 3 weeks to come out with a decision.

I moved to Acton in late january and changed the logbook over to my new address in Acton. Last month I was woken up at 6am by a bailiff who had clamped my car at my new address ( they hunted me down) and was demanding £500 or he will tow my car, he said it was for a conjestion charge penelty issued by TFL in middle of febuary THAT I DID NOT RECEIVE. I didnt have money to pay so he towed my car. I filed a Statutory decleration and an out of time stat dec to northampton county court, they send to the stat dec to TFL and TFL rejected it and now its with the court to accept it or deny it. I spoke to TFL and got it in writing from them that they sent the PCN to number 7 of my previous address where I was living at number 1. So they clearly sent the pcn to the wrong address and I have this in writing. so theres no way I could have received this PCN. now the stat dec case is with the court but I just found out that the DKB bailiff has sold my car. what the hell do I do. 1st they take my car without me even knowing about the ticket and now they sold my car while the stat dec is still getting processed. TFL said that as I signed the stat dec after they car was towed that they are within their right to sell my car. Im absolutely furious. Ive been without a car for about a month now and none of this is my fault. I tried to speak to a few solicitors but no one deals with this kind of case and the ones that do want to charge £2000. I NEED SOME SERIOUS ADVICE, please thanks

Hi I got a knock at 6am today by a bialiff, claiming that I owe them £500 there apparently has been a congestion fine for the car but it was being sent to my old address, I did not receive any fine whatsoever. He clamped my car and towed it not negotiating at all about payment. now my car is gone. and they want £700 for recovery. who can I speak to about this.??? what advice can you give me ive called about 100 solicitors. none of them seem to deal with bailiff issues, then ones that do said they want £2000 up front. help please
