  2. No Section S136, whatever that is! Anyone have any idea what I can do and how to get it set aside?

  4. I just received the Stat Demand from Arrow delivered through my letterbox today. Signed by Head pf Litigation on 16 Dec 09. Particulars of Debt: For a Credit Card agreement dated 05/04/02. Assigned to Arrow Global on 16/12/06 (Is this when they bought it for a fraction of the cost)Cannot remember having a credit card with HBOS ever!! I will Scan this stat demand and post it on here tomorrow as I have no clue what to do now, any help is much appreciated.

  6. Did have an account with the Halifax but that was closed over 6 years ago and didn't accrue any debt with them. Dont have the statements now as so long ago.
  7. As far as I can tell the Original Debt is for about £4800. The Account is HBOS, but I cannot tell you anymore as they haven't suppied me with the original paperwork regarding it as yet. Only been 7 months since I asked for the CCA? When they sent me the paperwork back in May this year I immediately sent a CCA as was curious as to what it was myself.

Hi I received a letter from Arrow Global stating the following: 16/12/09 We refer to our letter dated 05/05/2009 (responded with a CCA on 07/05/09 and they signed for the following day, still not received anything from them) and note you have failed to respond meaningfully or at all. I still do not have a reply. Please do not send further correspondence until this matter is addressed. Have proof that is was signed for on 23/12/09 as sent by Special Delivery. So we arrive back from Xmas Holiday and find a rather tatty letter in our letterbox stating the following: Dear Sydneythecat (handwriting) 30/12/09 We have been asked to contact you urgently by Arrow Global and ask that you call me as soon as possible on (Mobile number). You may call me anytime during the day, weekends included, up until 9pm. I have an urgent legal document for you. Thank you. Yours faithfully xxxxxxx I stupidly rang the number and was told by the man on the other end of the phone that we has to deliver a document from Arrow Global but wouldn't give me a reference number when I asked for one. He just said he had to deliver it and that the law of the land is his authority, I then asked what law and he got tongue tied and said could he deliver it and I said no, probably not the best thing to say but wasn't thinking at the time. Can anyone help as starting to have a little wobble at what they can do? Any help would be very much appreciated. Syd

Hi everyone, I received this letter back from Robinson Way & a £1.00 Postal Order which was sent to them back in June 2008 but not the original one, this one was dated August 2008: Letter Dated 21 August 2008 Dear Sydneythecat RE: ACCOUNT REFERENCE NUMBER ********** We refer to the above account and acknowledge your letter. We advise that this dept has been legally assigned to us and that our assignment ia an assignment of rights and not the duties of the creditor under section 189(1) of the Consumer Credit Act. Our assignment gives us the rights to collect the debt; but we ourselves are not lenders, and we are not obliged to provide you with any copy documentation. You are however within your rights to Contact Abbey directly. As legal assignee under section 136 of the Law of Propert Act 1925, we are entitled to pursue you for the sums due under that assignment. In addition we are also entitled to process your data. Even if you were to demonstrate that there was a failure under the Consumer Credit Act by Abbey, rendering this account unenforceable, this does not mean that you do not owe the sum due. We note that since our assignment in December 2001 you have never disputed ownership of the outstanding debt and paymnets totalling £1989.87 have been made. If you feel you do not owe the account you will need to forward written documentaion to show this. When I first started receiving calls from them I asked for proof of where this came from and they said they didn't have the original documentation so I sent the CCA hoping that it stop them from harrassing me anyway I received this letter and what should I send them back? We also went to the HSBC and tried to find out what the account was for and they said that they have no information to give us and to ring the company.
