  2. Cheers again for the advice jonni2bad. I'll get onto the court this morning. This must be the banks new tactic. Hide you're head in the sand and no one will see us.
  3. Thanks again for that Jonni2bad for the advice and support. I suppose it is a case of just holding on but i still have not heard anything from the bank and there 3 weeks are up on Monday. One more thing please. If the banks do not get back to me and then the 3 weeks are up, do you know what the next stage will be. What i mean is, will the court contact me or what will happen ?

I've been reading a few posts here and i have not sent any correspondence to the bank after i filed my claim at the court.Should i have sent some correspondence to the bank as well as the court as i thought that by filling a cliam at the court would have been enough. Maby this is what is holding things up. Once again any help would be most appreciated.
  5. It is now over 2 weeks (3/7/06) since my claim was recorded with the Glasgow Sherrif court and i have not heard a thing from the bank. This is concerning as other people seem to have been paid very quickly from HBOS. I feel a wee trip to the court is coming on. Either that, or the banks are holding out right to the end of the 21 days that the court have given them to respond. This is no good for the nerves i tell you !!!!!!

  8. Thanks for the response jonni2bad. I am just starting to flap a bit as this is the final hurdle and i read on another thread that the Abbey turned up at court with another person and a date has now been set. This was in the Scottish thread and the person was from Aberdeen. Fingers crossed !!!!!!!!!
  9. I to have filed a claim with HBOS at the Glasgow Sherrif Court on the 3/7/06. I have not heard anything from HBOS yet, but i'll let you know as soon as i hear anything.
  10. Hi Manolo. I to am very interested in this thread as i have filled my claim with HBOS on the 3/7/06. I wish you all the very best for this and you have showed great strength so far so keep it up. I will let you know how i get on with my HBOS claim to see if it helps you. GO FOR IT !!!!!!!!!!!
  11. I Recieved my documents back from the Glasgow Sherrif Court yesterday with it being stamped on the 3/7/06. Just a quick question people. Does anyone know roughly how long it takes for the bank to pay out? Ive been waiting for 9 days now. I'm keen to either take the robbers to court or go and spend my money on a great holiday with my lovely lady.

Update After offering me a mere £130 (should have been £1269) i told them i would see them in court.I filed my "summary clause" case (for claims over £750 but less than £1500) on the 3/7/06 through the Glasgow Sherrif Court. This cost me a mere £39. I was told by the clerk that it would take about 3 - 4 days to process and the court case (if the Halirobbers have the bottle for it) would be in about 8-10 weeks. Heres hoping they will pay me my £1269 (plus the £159 in intrest, plus the £39 fee for filling the claim) before the court date. Fingers crossed !!! A wee bit of advice for Scottish claimers. You can claim more than £750 but it must be less than £1500. You can find this info in the Scotland section in the forum. It is brilliant as it has all the court froms templated and really takes you step by step through the process. I would just like to say thanks for the the person that posted the court information as i would not have had a clue what to do !!!! Will keep you all updated on when the robbers pay out.

  14. PS Sorry to be a pain people, but is there any way in Scotland that we can claim for more than £750 at a time instead of having to do this process several times. It just seems a bit backward.
  15. Hi Folks Please help me !!! My charges with the Halifax are £1269.00 and i have done all the letter stuff to no avail as they offered me £130. I am now obviously wanting to take them to court ASAP. I have done all my reading on this informative site (which will definetly recieve a donation once this is completed) and i understand that i can only claim £750 at a time (which is rubbish as the English courts offer higher claims). The thing is,what I am still confused about (after reading several threads) is when i go to claim, must my claim include the 8% intrest or should my first claim be for £750 and then the interest is put on top. Also do i have to wait until my first claim is settled before i start my final one ? Any help would be gratefully appreciated as i don't want to make a mess of this after going through all the other procesess.

  17. I've just read in Edinburgh Kevs thread that In Scotland you can not claim for any more than 5 years at a time and i have claimed for 6 years worth of charges. Is this true as this could really stuff up the whole process for me.

Further to me sending my first letter for my charges worth £1260 i recived a letter from HBOS (dated the 6/6/06) saying you're thank you for you're letter it is being dealt with our customer complaints dept and you will recieve a response shortly. I then recieved a second letter from HBOS (dated the 9/6/06) stating that thanks for you're letter but you knew about the charges (in the terms and conditions) and "we cannot be responsible if you have authorised payments against funds that were not available". "Ultimately it is you're responsibility to manage you're account. However, as a gesture of goodwill i am prepared to refund £130 (basically 10% of what these robbers owe me) of charges in full and final settlement of you're complaint". This i found hillarious ! You have not managed you're account but we'll give you £130 ! On the 9/6/06 i had sent my LBA of, so i'm wondering what the next stage is. Do I have to pay now to file a claim or do i send another letter saying to HBOS to get stuffed with there £130 and i want my full £1260. This i want to do obviously but i don't know if i have to file a claim at this stage. Any help would be gratefully appreciated as i've looked in the libraries and i can only work out the first two stages.
  19. Sent away my first letter on the 26/5/06 and have still had no reply from the Halifax at all. The 14 days will be up tomorrow, so i'll be sending away the second letter tonight. Is this normal for them to ignore you're first letter ?
  20. I received my statements from HBOS today (with 2 years missing, I hasten to add) and the charges total £579. I was told by telephone banking that the dept. that deals with queries re statements are open from 9am to 5pm, so this means I'll have to wait til tomorrow to get the full amount. Unfortunately, I will have to wait another week, which is a shame as I was wanting to begin the process tonight.
  21. Applied for my statements for the last 6 years on the 15/5/06 and the bank said that it would take up to 10 days. Thought i would post this as a wee reminder of how long the process took for me. Stick to the same thread, merged thanks Louise
  22. First of all, may i say this site is an absoulte god send and it is a fantastic way of getting back at the banks. I understand the basics of it and i have applied to the bank for my statement's for the last 6 years. (Is it correct that we can claim for the last 6 years ? ) I've been browsing the forum and i don't really get all the jargon. So i was wondering if someone could show me the stages of going about trying to reclaim my charges as i'm not to sure. Once again thanks for you're help on this and i will be showing all my mates this as it truelly is an amazing thing to be able to reclaim all my chareges back from the evil HBOS.
