  1. This is quite spectacular news. Do we have a government that is actually on the side of the normal person now? ID cards: gone. HIPS: gone. Debt sales under 25k: gone. Tax allowance increase: Next april! I like, but it is early days so lets how it goes.
  2. Hi, had two calls today from Baines and Earnst (I used to be with them when I was naive). I answered them and pretended I wasn't who they wanted, but when I asked who was calling they said it was B&E and that Mr Beetzart could be in line for a £1500 refund. It's got to be a con? Anyone else come across something like this? Cheers
  3. Barclaycard sent me just Terms and Conditions without anything else. When I sent back a letter stating this was not good enough they sent a long winded reply about how it was! With regards to the Cabot account: do nothing until they send you something then post it up here.
  4. If it is any help Snowingagain I had two accounts with Mercers and I CCA'd them both (thanks to advice from CAG). (I was also trying to pay something each month but they kept adding interest.) What they returned was utter bile and not worthy to be toilet paper. So I sent 'accounts in dispute' letters, plus telephone harrassment letters, and I haven't heard a thing since. That was in 2008. My point is, they are easily beatable!
  5. I used to have two accounts with Mercers, both Barclaycard. When I couldn't afford to make informal repayments any more they bombarded me night and day with calls. I was still making payments but much smaller ones. I then found CAG and CCA'ed them. What I got back was pure rubbish and ceased payment. They haven't recieved payment for nearly 18 months now and I haven't heard a thing from them. Deep down I know they will pop up again sometime but in the meanwhile it is nice to be out of their grasp.
  6. Dear Sir/Madam Re:− This letter is a formal request pursuant to s.77(1) of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide. I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77(6) will apply. Only use the next paragraph if you are sending to a DCA and not the original creditor. If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties. Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR). I enclose a postal order in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose. If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee. We look forward to hearing from you. Yours faithfully Print name here never sign This is the most recent CCA letter that I have used. I can't find the site either but I hope this helps.
  7. Hi, I've tried searching everywhere but I can't find a recent template for a CCA request letter. Can anyone help? Thank you
  8. I've just dug out some old letters that prove they have my present address. Two old Barclaycard statements and two from a DCA. I take it this would be evidence enough? Thanks for your advice
  9. I have made payments but stopped last year when they couldn't supply CCAs. I don't want to be penalised for their mistakes.
  10. I have two debts with barclaycard and two loans from Barclays. Apart from the odd phone call I have received no letters from anyone regarding these accounts even though it has been passed around 4-5 DCAs. I thought nothing of it really, then it dawned on me. I moved to my present address 5 years ago and told all my creditors this. I thought 'what if all letters are being sent to my old address?' Nah! That can't of happened. Well I rung the most recent DCA (I know I shouldn't but it was bugging me) and low and behold they had my old address of their records and have been sending letters there. Why can't they get things right? I don't want other people opening my mail. Surely it is a data protection violation because I haven't tried to evade them but have been honest with my whereabouts. What should I do? This DCA are only chasing one of the debts, god knows what letters have been sent to my previous address. I have received letters for all these debts to my present address so I can't understand why they would still be using my old address. Any ideas? Thank you
  11. Robbers Way have just rung me. (wiping tears from my eyes I can hardly type) them double hard bar**ards made it to work for the second day running. They make me proud to be British, that strong British heart of will and strength, fighting adversity all the way. They will collect those bloody debts even if it gives them frostbite, and 50p to put in their electric meters! Forget all the paramedics, doctors, nurses, firefighters, who struggle to get to work, it's the Debt Collector's call monkeys getting to their headsets on time that make me so immensely proud to be British. You can't beat a British debt collector!
  12. This is thread dedicated to all those brave DCA workers who managed to battle the arctic conditions to arrive at their 'pods' on time. I bet there was a serious sense of self satisfaction as they heaved on their headsets and booted up their VDUs ready for another day of debt collecting. Can you imagine for just one minute the struggle they had to endure to get to their place of employment? They would have left their bedsits long before we would even consider getting up. They are true heroes. May I say a big thank you to Robinson Way who, through adversity, managed to phone me yesterday. I am waiting with anticipation for today's call. God bless 'em!
  13. I suffer from chronic depression and maybe bipolar. Doctors have prescribed me four different medications which are helping and I am undergoing therapy as well. I have been diagnosed with this well before I ever got into debt. I am not trying to find excuses to get out of paying as I will pay when my creditors provide enforcable CCAs, but should I tell creditors of my situation? Will they use it to harrass me more? Thank you
