Evening all, been a while since ive needed your help, hopefully this one is quite straightforward, sorting some paperwork the other day and I found some loan agreements from 1994 onwards with TSB and Natwest various amounts but all seem to have some type of insurance payment on them, do I still need to SAR them to start a PPI claim or can I do it with just the loan agreements? Latest update, apparently I am now under retail business banking and my dad is under commercial business banking due to differences in turnover, Lloyds apparently no longer have dedicated agricultural managers! Advice from my dads manager was basically to bend over and take it as if I continue to complain and kick up a fuss they may close the business account (wonder if he used to work for Natwest with that level of helpfulness) anyway after spending 15 minutes trying to get through the call centre whilst returning a missed call from the business manager (absolute farce, asking me security questions relating to our joint personal account which I have nothing to do with as they were repeatedly told) I finally got through to a helpfull and understanding manager, although when she asked me what my business was, I wasnt sure quite what to think I have been under retail banking for two years! Anyway outcome is fingers crossed they are going to waive last months charges to give me a chance to catch up, however I am still recieving letters of concern requesting information be supplied by x date but not stating what this information is, I have now written to them for the fourth time explaining I am not being awkward and I'm happy to supply the information if they tell me what it is, the last 3 letters have gone unanswered so I'm not holding my breath.

Hi yes spoken to them about increasing the overdraft and got the "maximum exposure" response despite all the borrowings being secured and the existing loans being paid down enough to leave some leeway on the security, I've had no response to letters sent to them either, it's like dejavu I could be dealing with TSB 20 years ago which is why I took the business account off them before, my fathers business does have a higher turnover but for the last 15 years we have both been under the same relationship manager through north midlands agriculture, agricultural businesses like mine and my fathers are usually under an agricultural manager as they have more understanding of the seasonal cash flow problems of our businesses, though I suspect I am now under a normal business manger which is whats causing the problem, although as I say getting anything out of them is like getting blood from a stone.

I'm working on a sideways attack at the minute because my father also banks with them and it appears that the North Midlands Agriculture office never was closed as he is still under them with direct contact to his relationship manager who is apparently one of the helpful ones, so I have made a list of the charges and printed off copies of the letters that were'nt responded too and he is going to have a word with him and see if he can sort out whats gone on.

Morning all, I have had ongoing problems with Lloyds since last year since they decided to split things, I was told I would no longer be under one manager who I had direct contact with through the North Midlands Agriculture ofice as this would be closing and I would have to deal with the call centre managers, for the last year I have had no sense out of them when contacting them and not even a letter of acknowledgement when writing to them never mind a reply, anyway to the crux of the matter, things have been tight on the business last couple of months and I have gone over the overdraft a few times, however despite me trying to talk to them about it nothing has been resolved and now they have started bouncing direct debits and cheques if they would take it over, however when applying thier own charges they have allowed these to take it over which I will then be charged on again no doubt, any advice appreciated, getting sense out of a call centre manager is like getting blood out of a stone!

Thanks both we are both getting quite good at arse kicking in these situations due to the time we spent dealing with our other problems over the last few years with help from this forum, the dca are'nt to much of a worry I've managed to get BCW and Wescott to back down in the last year, I shall do some digging re: the information commissioner.

Final update to this as not been on the forum in quite a while, never got as far as sorting it out myself around september last year Lloyds sent me out a form to sign if I wanted to claim PPI in the end they agreed my claim on 5 out of 7 loans I've had over the years and paid be back just over £8000

Afternoon all, been a while but I have a new problem, my wife has cancelled her old contract with Orange as it was too expensive, she had 3 phones on it one for herself and two for the kids, the final settlement figure from Orange came through higher than expected on enquiry she has been told that it was due to charges being added for itemised billing, which she had never agreed to and has taken up with them in the past, sent a SAR to orange which they have sent back and said she has to fill in thier own SAR form, in the meantime they have passed the account to Red Castle Recoveries, she has filled out the SAR form and I have printed off a new SAR letter for her to send them to and also a letter for Red Castle pointing out this account is in dispute and also attaching a letter telling them that their threats of doorstep collection will be reported to the FCA, anything else I can do, she is willing to settle the account in full once she can get a figure which does not include charges for services not requested, regards Purp

Latest update we have had contact from Immediate Financial, apologizing for not having settled any debts in the 12 months we have been with them and giving us a figure for monies held for us in our client account which is nearer to what we believed it should be which they have offered to return without complaint, Wescot have backed down although not completely but have a sort of half apologetic letter from them and they are now willing to accept £1 per month from us as they were from IF, Buchanan Clark and Wells however have sent a long rambling letter saying that they threatened doorstep collection as we had not replied to thier original letters but then contradict themselves by saying they did get our letters but as we did not follow up with a financial statement and offer of payment this is what escalated the matter! BCW never acknowledged receipt of the two letters we sent until I sent copies of both with my last letter to them and sent it recorded, last letter I sent them also included the doorstep collection letter off here, BCW claim that the case referenced in that letter is not relevant? and also that apparently by signing the original CCA with Barclays that we agreed to doorstep collection as part of any debt recovery required by default?! I also offered to honour the payment agreemment made with them by IF and continue paying the £1 per month however they say they will not put this in place without a financial statement.
  10. Hi fletch, I am doing have written them all down and they will be listed when I reply to Wescot, just working on a suitable reply to their high and mighty I've also got to get my wife to go through her phone as well as they were texting and ringing her too.

Had another letter from Wescot today saying they will not uphold the complaint of harassment as they have only rung 7 times all within thier usual opening hours of 08.00 -21.00 and denying they sent the text message I recieved at 00.51am which woke me up! I've just been through my phone and I have 17 calls which can be attributed to Wescots 3 different phone numbers and also 3 text messages although I know there have been more of those too.

Hi fletch, sent the complaint about a fortnight ago, had a letter saying they have had the letter and are investigating, yes they were making token payments only but based on what we were paying into the client account monthly they have had more than enough money to pay off the smallest debt even without negotiating it down which they reckoned they would do.

Hi Fletch yes IF were not making payments on time to our creditors despite reassuring us everytime we rang them that they were, we are still waiting on a reply from IF regarding our complaints and request for the return of our money from our client account so we can use it to pay some of our creditors.

Thanks for the above, Immediate Financial are dmp providers we were with and were "dealing" using the term in its loosest sense it appears, with our creditors on our behalf although it appears now that they were'nt which has caused some of the above to default and end up with the debt collectors we are now taking matters back in hands ourselves and are in the process of trying to recover the money from our client account with IF.

Further to my above post I have just checked and I sent the CCA request on the 3rd April and was acknowledged in writing on 15th April and again on 30th April as it has not been forthcoming does this meanit is now past the 12+2 days? also Wescotts letters state that my account has been put on hold until the documentation has been found however it obviously has not as they have continued to harass me by phone and text and today again by letter since they were sent the the CCA request.

Hi fletch thanks for that I haven't heard back from Natwest yet this time round however Westcott who are currently acting fro them have today set another letter claiming they have had no contact from me and threatening further action if I do not contact them, I have two letters from them acknowleding reciept of the CCA request so obviously they have heard from me! seems they have the same attitude as Natwest.

Thanks Fletch, I did send Natwest a letter pointing out that there is no legal reason for them to require a signature but funnily enough they ignored that completely as well, this weeks target is Wescott as despite me receiving two letters from them saying they have suspended my account until they hear from Natwest, they are still ringing and texting everyday, including texting me at 12.51 am this morning! I feel a complaint to the OFT coming on.

Hi dx No 1 with Natwest has now been cca'd 2 times on each occasion they have refused to provide cca as I have not propvided a signature, goes quiet for a few months then reappears with a new debt collector, think no 2 is with westcott as they also have no1 but it seems from various letters niether they or natwest seem to know what the amount is as we have had 3 letters off natwest in the last month stating figures from £0.00 to £4753, Natwest were sent SAR via the ppi reclaim section of the DMP we were with which got us £550 back which was paid back onto the cc which Natwest then loaded up with interest and charges and put it back to where it was before the reclaim, will get SAR letters sorted for Barclays and Studio, thanks dx

Hi Dx, just got credit file debts are below Natwest cc £3594 currently in dispute and not being paid Natwest o/d £4753 not sure who this one is currently with possibly westcott am trying to find out Barclays bank £1256 was in payment agreement with barclays but has been move to buchanan clark and wells due to default by dmp! Eon £612 now on credit meter so repaid via that Studio catalogue £1493 not sure if this is still with studio or with debt collector trying to find out

I have sent SAR letter and also letter informing them that thier services are no longer required and that we wish a full refund to Immediate Financial and I have also sent a letter to Buchanan Wells and Clark to inform them that we will be dealing with it ourselves now and that I will forward an up to date financial statement shortly with a monthly repayment offer.

Hi dx, things got away from us last year due to various reasons and as the dmp seemed to have sorted themselves out and were dealing with it all as things had gone quiet and we knew the debt collectors etc were dealing with them we left it to itself, unfortunately it has now all surfaced again and as we are now in a better position to look at sorting it ourselves we now intend to, thanks purp

Hi DX have only sent CCA to Westcott at the minute as they are acting for Natwest who I have already CCA'd directly and via Triton whom they passed it to first, all I keep getting is letters back saying they cannot send it without a signature then go quiet for a few months and pass it to debt collector. Will ask the other half who the others are with think they have all been passed on to debt collectors now all of who apart from Natwests ones (shocker!) had agreed to £1 a month.

Morning, we took out a DMP with Immediate Financial in march last year after much head banging with Natwest who were refusing to believe anything we told them so we decided to go down the dmp route, Immediate Financial were highly reccomended on various sites so we went with them, at various times in the last year they have failed to pay the £1 a month to creditors and we have been threatened with court and constantly harassed by various debt collectors everything has been forwarded to IF as we were instructed to do, having never recieved the monthly client account statements we were supposed to get and realising they had, had enough money off us to pay one of the smaller debts we have been in contact and given various excuses about why it has'nt been done, finally got a client account statement off them yesterday which is showing £600 less than what should be in there based on the monthly dd we pay to them, so we are looking at doing it ourselves now as have spoken to payplan and stepchange and both were as much help as a chocolate teapot! So the question is how to we go abouit recovering our money from them and also all the paper work we have sent them so that we can track down who currently holds the debt? thanks Purp
