Hi Senior, Had various "discount if you pay now" type letters, ignored most but replied to one last year but clearly stating I do not acknowledge the existence of any debt and asking for agreement copy. No reply received. I assume they are having a desperate clear out of anything that becomes SB and issuing bulk summonses just before? The last payment made was March 2010, the default issued 03.06.04. The cheeky sods are also claiming £2k+ of interest - a bit rich when any sane person would have CCJd for a real debt way before 6 years had expired!

Hi all, Just received a County Court Summons (N1) from these cretins - last payment was made May 2004 and default issued June 2004. I've returned the form stating I intend to defend the claim. Looking at the agreement copy sent, the deposit was used against the insurances not the value of the vehicle which is the opposite of what I was led to believe. I take it I then use the defence of mistated credit amount and therefore an unenforceable agreement? Incidentally,the vehicle was sent back as it was about as reliable as a politician's promise, but YCC have cunningly recorded all their paperwork as reposesed, lying ...wits.
