  1. You would have thought they would have been a bit more prudent...or maybe even a bit less inventive. They do state I will not receive any further correspondence so here's hoping that is the case. I'll be keeping their letter for at least 6 years though just in case
  2. Just another quick update. I have recieved a copy of a letter from Capquest to the trading standards. They claim that in 2007 I agreed to pay in installments by email (this is news to me) but because they can't produce a copy of this email they have closed the account. Apparently they only keep things on file for 3 months! Thanks again for all your help.
  3. Hi Guys, Sorry for the delay getting back to you. Just had trading standards on the phone today. Capquest have contacted them and have closed the account. I'm not sure if anything else is happening but at least they are now off my back. It was Newcastle trading standrads. Thanks again for all your help
  4. Just a quick update. Trading Standards are coming to see me tomorrow morning to have a chat and see the letters from Capquest
  5. Thanks for all your help and for taking the time to prepare the letter before action for me. I have heard from consumer direct today and they are referring my case to the trading standards as they feel that what capquest are doing may be unlawful. I will send the letter to capquest and let people know what happens. Thanks again

  8. On 06 August 2009 capquest sent me a letter chasing a debt from 2001. I responded with a letter on the 27th to them stating that the letter was statute barred and sent it to be signed for on receipt. I tracked this letter and it was received by them on 28/08/2009. I still have the tracking number and receipt from the post office. I have not had any response from them with regards to my statement. On the 25th September they wrote to me again saying that they were preparing a statutory demand against me. I ignored this letter but still have it. On 17th May 2010 HL Legal solicitors wrote to me saying they were acting for capquest in this matter. They claim that a statutory demand for bankruptcy was sent to me on the 15th of October, 2009 and that I have made no effort to do anything about it. I have never received this letter. They also say that I made an arrangement to pay by monthly installments on 26 feb 2007. I did no such thing. Once again I ignored the letter but still have it. I have today received a letter from Capquest saying again that a statutory demand for bankruptcy was sent to me on the 15th Oct 2009 but that this time i didn't ignore it but responded by offering a proposal to pay without the need for further action. Once again I can say i did no such thing as I never got the demand. They are now threatening to send their field agents Resolvecall to attend to me personally. As you can see I am getting quite confused with what to do now. I certainly do not want anyone coming to my house. They seem to be saying something different in each letter and I would appreciate any advice anyone can give me with how to put an end to this. Thanks in advance

  10. I have just received a letter from Lowell Portfolio informing me they own a debt and that they have appointed Red Debt Collection Agency to recover the alleged debt. This debt is statute barred as it is well over 6 years old. Mackenzie hall tried to pursue this debt on behalf of Lowell last September and I sent them a statute barred letter then. They never acknowledged the letter but I know they received it as I sent it recorded delivery. Unfortunately, I no longer have the receipt from the Post Office. Should I just send another statute barred letter or is there a different approach i should be doing? Thanks for your help.

A friend has recently recieved a couple of letters from CCS Collect claiming to be operating as agents for Cabot and as I have had such useful advice on here in the past I was hoping someone could help this time. The first letter stated that he owed money to Cabot Financial (Europe) limited and included the usual threats about legal action if not settled in full and a bank payment slip. My friend called them and was told that the debt was from 2000 even though he is adamant that he knows nothing about it. The second letter is another threatening letter saying that they are preparing to take court action. At no time have they sent any info about what the debt is or who it is from, other than telling my friend the year it was from. Should he just send a statute barred letter as a result of the telephone call or should he ask for more information in writing first? He is obviously quite concerned about this.   14. I have had a letter from Lowell Portfolio 1 informing me that they have purchased an Hsbsc bank account which I may have had. I am 100% certain that this debt is older than 6 years and that I have not had any contact with anyone about this either. I would like to know if I should send of a statute barred letter straight away or should I wait until they contact me again. Thanks for your help.

  16. The letter was addressed to me, not 'the occupier' unfortunately. I appreciate the advice and will wait and see what happens next. I am guessing that it is not worth sending a 'statute barred' letter quite yet as they have not yet stated who the debt is from? Thanks again.

  18. I have just received a 'failure to respond notice' from Mackenzie Hall. They seem to be saying that they are working on behalf of Lowell Portfolio 1 Limited and they have been instructed to recover an overdue account on their behalf. They also say that they have got my address from a credit reference agency. This is in fact the second letter I have received from Mackenzie Hall. The first letter was merely stating they were attempting to contact 'the above named person' on a personal matter which i ignored. I have a couple of questions. 1.Is Lowell Portfolio 1 Limited the same as Lowells debt collection and if so shouldn't they have put who the alleged debt was originally with? 2.Can they get my address from a credit reference agency without my permission? I have had issues in the past with bad debt and I know that any I may have is statute barred. I would appreciate any advice on how to deal with this. Thanks in advance.
  19. I would like to thank Martin for posting the form letter to send to Capquest. I have today received a letter from Capquest stating that the account is statute barred and that they are in the process of closing the account on their system. I do have a question though. They have sent me a letter, apparently from Northern Rock stating they sold the debt to Capquest investments ltd on June 30th, 2005. this letter is printed on plain paper with no company logo anywhere so I am wondering if this is actually a genuine letter from Northern Rock or if it has just been done by someone at Capquest? Am I being overly concerned? My gut feeling is to write to trading standards with this letter as I feel that they are being less than honest again. Also, the comments about being in the process of closing the account worry me slightly. Surely they should be done automatically? Should I send another letter asking for proof of the account being closed or should I accept the letter at face value as it does state that the account is statute barred? Once again, Thanks

  21. I have just received a letter confirming receipt of my complaint letter and that it has been passed on to their complaints department. I presume I just wait now and thanks again for all the advice.
