  2. My husband has recieved paperwork of santander today. The opening letter told us there were things they couldnt provide us with: "we can confirm that we are unable to supply any details regarding the commisdions paid on the account as this is between santander consumer finance and the dealership. " "We are unable to provide underwriting notes but we can confirm when underwriting the finance proposal we base our decision on the customer's personal details and circumstances provided to us by the dealership and their credit history, which is logged with experian and equifax." They have supplied us with a copy of contract, statement of payments and all letters sent to my husband since he has had agreemenet. Have you any advice where to go from here. Thank you
  3. Relating to above, at the very bottom of the Code Red letter in very small print is the following text:- Santander Consumer (UK) plc trading as Code Red Collection Services. Registered office: 3 Princess Way, Redhill, Surrey RH1 1SR. Registered in England number 2248870. Authorised and regulated by the Financial Services Authority for General Insurance mediation activity. Please not if you live in Scotland a Decree for payment may be forced by way of an Earning Arrestment, Letters of Inhibitation or Sequestration and if you live in Northern Ireland a Decreefor payment may be enforced by Attachment of Earnings or Seizure Order. is this what you were relating to as a HOUSE licence number??? My husband pointed this out and thinks its just the company/VAT registry number but he thought i should double check. Again i would like to show my gratitude for your kindness in helping us with this matter, we are forever in your debt (excuse the punn !!)

  8. Hi everyone, First of all - BIG APOLOGIES!! I only have an internet phone, so it's a bit awkward seeing messages and keeping up to date. I've had to wait until my two babes have settled, before coming round to use parent's office computer. postggj - answers as follows:- 1) Amount of credit -£5,100 2) Total amount payable - £7,769.80 3) Agreement over 54mths 4) Acceptance Fee - blank on agreement 5) OPtion Fee - £299.00 payable with final payment. 6) APR - 15.1% 7) Cash price of vehicle (on the invoice from the garage) - £5,864.00* 8) Total cost of down payment and/or deposit - £764.00 9) Monthly Repayment - £124.20 The actual agreement does not have the date my husband signed, but the "used vehicle order form" which was given same day is dated 7th October 2007. *This was the same form which gave details of cash price. Clause 2.5 The acceptance fee is due and payable with the first monthly payment as an additional payment unless you have chosen to spread this payment over the term of the agreement. If you chose to spread the payment we will calculate and apply interest on the Acceptance Fee in the same wasy as stated for total interest at the end of the "Other Financial Information" section. Clause 3 Option To Purchase You will have an option to purchase the car by paying us the option fee shown in the "Other Financial INformation" section. Once you have paid all other relevant payments stated in this agreement and if you have kept to your side of this agreement. Until that time the car remains our property. If you do not exercise that option by paying us the option fee with the final payment on it's due date you must :- a) return the car (together with all keys, master keys, V5 registration form, immobiliser and other codes relating to the car and anythin reasonablly necessary to allow us to get full value for the car ) to us or to such dealer, auction house or other person we reasonably specify, at your expense and on the date for payment of the final payment or such other date we specify, unless you arrange with us for us to collect the car from you. If we arrange to collect the car from you, either because we have agreed with you to do so or because you failed to return the car to us, then you must pay us the cost and expenses we incur in doing this when we ask, at the rates charged to us by our suppliers without any allowance for any volume discounts we may get; b) allow us to inspect the car, to see if you have taken reasonable care of the car in accordance with the terms and conditions of this agreement; and c) pay to us anything due under paragraph (a) above, any payments which were due to us at the date of termination which you have not paid, the costs of all repairs required to put the car into a reasonable condition (including the cost of repairing or replacing all keys, master keys, immobiliser, and other codes relating to the car and anything else reasonably necessary to allow us to get full value for the car) and any sums due to us for breach of this agreement by you before the date it comes to an end. Those payments must be made to us when you return or when we collect the car or, if the amount of those payments is not known at that date, when we ask for them. On the subject of PPI. You will think us very stupid:roll: but we hadn't even realised that we had agreed to this. It's only since you asked about agreement and we scanned it, that we noticed it was there. A certificate of insurance and summary of conditions were stapled on the back. To be honest, the paperwork was just accepted and filed away as soon as we got home. A BIG LESSON FOR US I think!!! HW23

  14. Thank you. My husband no longer wants to be involved with this company and is willing for the car to be taken away (he would deliver to a garage) as this has caused so much stress. Does anyone know where i need to go from here? No idea if it was at show room. But that was where everything else was signed.
  15. Hi Everyone, Thanks for all the help. I have a feeling I'm going to need loads of it! Hubby reckons we did get default notice, but pretty certain that got shredded by mistake with some other docs while I was in hospital. Posting up the copy of Agreement. HW23
  16. Can anyone give me some advice on this matter please?? My husband got a car on finace in oct 2007. The finace was through GE MONEY. Some time last year our finace was taken over by Santander. We werent given anything to sign. In febuary this year we had a new addition to the family, which caused us to some finacial difficulty, due to my husband taking paternity leave and receiving a basic benefit. I'm self employed, so on maternity benefit through the government. We struggled to keep up with everything, and missed a payment. The following month we missed another payment. As my husband had returned to work full time, our plan was to make a double payment over the next two months so that the account could be brought up to date. However, we recieved the following letter from Santander requesting return of the car:- 13th April 2010 Dear --------- NOTICE OF TERMINATION You have disregarded our previous notice of default and as a consequence we give you notice that we hereby terminate the hiring and agreement forthwith. You are therefore no longer with our consent in possession of our property as scheduled below, and we now formally request its return. AGREEMENT NUMBER ---------- DATED 23rd oct 2007 VEHICLE ---------- REGISTRATION ------------ This put my husband and I into complete "meltdown" and we made the decision not to make any further payment on the car, as we presumed the notice meant it was being re-possessed. We phoned and asked where to return the car, and were told we couldn't return it. Despite the earlier correspondence, Santander informed us they had to send a letter out for us to sign saying we were voluntarily surrendering our vehicle. This letter read: 6th May 2010 Dear ---------- You have recently contacted us to express an intrest in voluntarily surrendering your vechicle. In order to return the vehicle, you are required to fully complete and sign the enclosed voluntary surrender document and return it to us. Please also include the £70.50 uplift fee required. You must enclose your registration document (V5), to enable the sale of the vehicle. Failure to do this may result in a reduced sale price for the vehicle, thus increasing your liability. If you are not in possession of the V5 you must contact the DVLA on the telephone to obtain a replacement. On receipt of the fully completed and signed and witnessed voluntary surrender document, an agent will issued to uplift the vehicle. The vehicle must remain in your possession until uplifted by the agent and must have a current M.O.T. (if over 3 years old) and V5. The vehicle will be sold at auction to obtain the best market value and the net sale proceeds will be credited to your agreement. You will then be notified of any remaining liability and will be required to pay this balance immediately. Failure to make this payment, may result in your agreement being passed for further action. If you have any further queries, please contact us on the number below. Then on the 13th May we recieved a letter from dc code red collection services. They were demanding the full balance of the car and charges. This reads:- 13 May 2010, Dear Mr --- 48HOUR NOTICE Telephone Number 0844 848 8943 We have been instructed by our client to collect the sum of £3778.32 plus charges of £120.00 on your agreement. Creditor: Santander Consumer Finance Agreement Number -------- Balance £33778.32 Arrears including charges: £618.52 Please contact this office within 48hours of receipt of this letter, on telephone number 0844 848 8943 to resolve this matter. Failure to satisfy the Terms of your Agreement may result in court proceedings being taken against you. All correspondence and communications should be directed to Code Red Collections Services, as we are now dealing with your agreement. This should be treated as a matter of urgency. Please do not ignore this letter. Yours sincerely My husband rang the company and offered to pay £50 per month to pay off the arrears and charges, but this was refused as they will only accept a significant amount above regular payment. We are so confused by all this. There seems to have been a lot of contradiction, especially as we have not been voluntarily surrendering our car. Is there anyone out there who could help us sort out this mess, and make a suggestion as to the best way to proceed. A very worried housewife24.
  17. Hi, has anyone got a letter template to send to fashion world. i sent a a letter asking for credit agreement and a letter of dispute to the debt company reliable collections. I didnt recieve a true signed credit agreement. I also didnt recieve a letter about the dispute. I recieved a letter of fashion world today, stating they were passing my debt to one of these companies: MOORCROFT DEBT RECOVERY CAPQUEST INVESTMENTS LIMITED AKTIV KAPITAL FIRST INVESTMENT LIMITED. CAN THEY DO THIS

  19. I had a talk talk account about a year and a half ago. We had nothing but trouble with them, so went to bt. Ha a letter today saying if i dont pay £118.38 in the next 7days, it will be passed to county court. I refuse to pay it, as i dont know what the moneys for. Any one got any advice please
