  2. Just write a letter of complaint to them. In it write something along the lines of 'with the length of time it has taken to resolve this problem, I feel it only fair that Peugeot compensate me for the trouble this has caused'
  3. Ebay is nothing short of a waste of time. I'd say I find it amazing how they let people openly sell counterfeit razors and batteries but when you've got 100,000 feedback and are providing them a nice steady income, I'm not really that surprised they allow it. They're slowly driving people away. It won't be long until there is another decent auction site available and the buyers and sellers will be leaving in droves. Their insistance that we all use paypal put me off - especially considering Paypal is owned by Ebay.
  4. No I haven't. He is still suffering because of it. I think we need to differentiate between ambulance chasers wanting to sue Xerox for a paper cut and the council leaving a hole in the ground. The difference is, any halfwit that is looking where he/she is walking will notice a raised slab. It's a bit hard to work out there's a hole under a pile of leaves.
  5. Then it's still an accident and I would treat it as such. Same again. Same again. I was self employed at the time. I lost a weeks pay. As for investigating an accident, why? Why not just accept that it was an unfortunate incident? Nobody intended to harm you. Why do we live in a culture where companies have to advertise that a door has glass in it just in case some halfwit walks into it? I just did. If you can apply that train of thought to a kerb then why can't you apply it to a paving slab? I deliberately ignored them. Like I said. 20 years ago, falling over would be met with a bit of a laugh and a joke. It wouldn't extend to taking the proverbial out of disabled/eldery etc etc. Children regularly fall over. Shall we sue God for providing us with fresh air? I responded, explaining what I meant because you said it wouldn't be an accident. It shouldn't be no. However there are instances beyond the control of the council, believe it or not, where slabs do raise. They don't go round intentionally raising them so people fall over. They carry out annual inspections of all roads and paths. If they carried out an inspection and found a slab to be OK and over a short period of time, it became raised, would you still expect the council to fork out cash? There will always be blame. Simply because accidents don't happen any more in the minds of some people. An accident is an unexpected, unintentional incident without deliberate cause. Health and Safety are having a field day. You can't have sh!t in your own toilet without completing a risk assessment. I don't think it's a case of companies getting their act together. I think they've got their act together. They just get stung by people wanting to make a quick buck and it does nothing to benefit the genuine claimants. Sometimes, just sometimes, accidents happen. Instead of looking to point the finger, we should just accept that nobody set out to harm us. There was no deliberate attempt to injure us. Less 'lumping' and more 'accepting'. It's not a case of me not liking paying for insurance and fuel. I think everybody the same on that one. My problem is living in a country where people have an accident and would rather have the number of a no win no fee solicitor before medical attention. This has a major knock on effect. Like I said in a previous post, companies won't just accept it as a dent in their profits, they'll pass it onto the customer. How can anybody be happy with that?
  6. Not all companies do good customer service. Some, however, are more than prepared to go that extra mile. Customer service should profit a company. After all, if a customer is happy then they'll carry on shopping there. It's makes sense. I'll beg to differ with JonCris. It started with the likes of The Accident Group and Claims Direct. As well as the introduction of conditional fee arrangements. When people realise that there's no risk involved in trying to sue for an accident then like sheep, they all follow. The term itself may well be media spin, however the cost of such litigations cost the UK £10 billion per year so I'd say it's very real. A perfectly legitimate claim. Nobody could argue otherwise.

Not sure if it's the correct one. What to do now would depend on whether you still want the goods that haven't been delivered. Instead of emailing them, send a letter recorded delivery.
  8. My partner dropped a bottle of milk. It smashed. I ended up with a piece of glass in my foot. Should I sue her? Would you sue the council if you stubbed your toe on the kerb? I'm not talking about blind, infirm and/or elderly. I'm talking about able bodied people. I'll explain it a bit better. If an accident has resulted in a financial loss for the victim then I have no problem with them seeking recompense. If there was deliberate negligence which resulted in an accident then I have no problem with people claiming compensation. If someone sets out to deliberately harm and/or deprive then quite clearly it's not an accident, and they would be well within their rights to seek recompense. So you would accept it as an accident. Now substitute the can of pop for a cup of coffee. Would you feel the same? If you trip on a raised slab and break your toe then why would you want an explanation? Why would you need an explanation? Why could you just not accept that you were clumsy and failed to watch where you were walking? Why does someone need to be held responsible for it? Why do you need to look to blame somebody else for it? Year on year, I see an increase in every insurance premium I pay. Nothing ever decreases. The cost of this ambulance chasing culture is plain to see. Companies don't take a dent to the profits when they pay compensation. They just hike their prices and we all end up paying for it. Added to that the increasing fuel costs and think about it next time you're walking round ASDA and you remember the story of the bloke that tried to sue for slipping on a grape.
  9. I see absolutely everything wrong with people forgetting the meaning of the word accident. 20 years ago, falling over a raised paving slap would be met with laugher and a joke. Today it's met with a lawsuit. I've no problem with people claiming compensation when they have incurred a financial loss or someone deliberately set out to harm and/or deprive.
  10. I credit you for allowing common sense to prevail. I'm not keen on this ambulance chasing compensation culture that has winged its way over from America where an accident is no longer and accident and someone MUST be held to account. Write them a stern letter by all means. Explain that it could easily have been one of your children it fell on and that should they offer an apology and recognise that the member of staff was partly to blame then you won't take any further action. As Conniff says, they'll probably throw in a voucher for you. Good luck.
  11. If you are able to stick to certain trains then when you book your tickets, ask them to reserve seats for you. As barracad said, some people book seats and don't actually use them. It can be irritating but there's not much that can be done about it. Even though you may have stated the trains you were travelling on when you booked them, they don't necessarily have to print the train times because depending on the type of ticket, you may be able to travel back on any train.
  12. The ABS ECU is the brains of the braking system. As they are repairing it and have provided you with a courtesy car, I'm not sure there's much you can do. You could ask for compensation and contact Consumer Direct and get some advice from them.
  13. So they took £15.99??? They assume it was for a narrowband account but can't find the account?? Tell them to get stuffed. Explain that as they have no idea why it was paid then it simply amounts to theft and you would like the money returned to your account. Give them your account number and sort code and refuse to give your card details. I wouldn't trust them as far as I could throw them.
  14. Why are people mentioning the DPA?? The DPA only covers personal and/or sensitive data that a company stores about you. Phorm will have no personal details and/or sensitive data so quoting from the DPA is pointless. The ICO has stated that for this to be legal it would have to be an opt-in system. Phorm have said on a number of occasions that they initiated dialogue with the ICO. They fail to mention that the ICO told them the above and are keeping a close eye on this. Phorm have stated that should you opt out, the cookie will expire after 2 years. Should you clear your cookies before 2 years then you will need to opt out again. Pretty pointless if you ask me. If they insist on selling this idea to the ISP's with the opt-out policy then I can see some major court cases happening. There may also be some legal issues about them storing and/or altering webpages without prior consent of webmasters. They simply plan on removing the ads from the site and replacing them with their ads. Of course, the adspace will be sold to the highest bidder and profit will be split with the ISP. They say that if you opt out, no data will be collected. I'd like to know how. Their profiler connects to the ISP server. All traffic will be routed through the profiler. Maybe if they were less transparent and more upfront, it might not appear to look like they're simply trying to gain the monopoly on pop-ups. I can't see them advancing too quickly with this. Their stocks dropped 85% last year and they lost over £11 million. Hopefully they'll go bankrupt before they can implement it.
