  1. This is still going, guys. I've contacted Experian AGAIN asking them to chase this up. Another letter to 1st Credit has gone unanswered. Can anyone offer me a straight yes or no to this, because I'm really starting to feel like I'm fighting an uphill battle and I should just lay down and die until the six years are up. If 1st Credit can't provide any paperwork whatsoever (which they haven't done do far) with regards to Citi's entry or their own, can I get it removed? Do they have to remove it if they can't prove it? Bearing in mind I've settled the debt totally. Thanks
  2. Do you know if the law regarding sending CCA is no longer valid? Besides the fact they owe me a quid!
  3. Ha ha. How about threatening them with legal action? Could I use the fact they've put inaccurate information about me (the outstanding balance) as leverage? I'm starting to resign myself to the fact it's gonna be there for the whole six years. Thanks for such a quick response.

It's been a long time since any action - I contacted Experian and asked them to investigate it, stating that 1st Credit had not provided a CCA (still hasn't) and were now ignoring all correspondence from me. Experian looked into it, placing a comment on my Credit Report saying it was being investigated. It took a month or so for them to reply (which is today), saying that 1st Credit had now amended the address on the entry to my PREVIOUS address (which is where I was living when I took the loan out), but now it also has an outstanding balance! I have confirmation from them (in writing) that there IS no outstanding balance, since 1st's original response to my CCA letter was a request to pay off the balance. This amount is (supposedly) what they dropped off the balance to allow me to pay it off. Experian haven't even queried this. Citifinancial, who I originally took the loan out with, made a similar mistake of leaving the outstanding balance in full on my report. When I pulled them up on it, they removed it sharpish. Can anybody advise me on a next step? I still haven't received my CCA from 1st, and last I heard the legislation about companies not providing this within 12 + 2 was no longer legal. My ultimate goal (if AT ALL POSSIBLE) is to get this default removed. I've had enough of messing around with this people. They are causing me no end of sleepless nights and grief. Thanks in advance.

  6. I can do that?! Really?! Or am I just being dumb? These guys have been a constant source of worry for me. They're rude, unhelpful, ignorant - payback would be awesome!

  8. Hi, I've posted on here before with regards to dealing with 1st Credit. Basically, I had a loan with Citifinancial, which I defaulted on and was passed to 1st Credit. The loan was PAID off, however upon checking my credit report Citi was still on there with an outstanding balance, and 1st Credit was also on there, showing as satisfied. Both were at status Defaulted. I contacted Citi immediately, who couldn't apologise enough and deleted their entry entirely from my record. However, 1st Credit is still on there. I have queried their ability to place an entry on my credit record. Experian aren't particularlu helpful. Anyway, after taking advise from several people on this forum (thanks guys, big style) I started to write letters to 1st Credit asking for relevant paperwork that allows them to place such an entry. I received a letter back telling me this could take 6-8 weeks AT LEAST. Well this time has long passed, and further letters to them now are being ignored totally. Can ANYBODY advise me on the possibility of getting this default removed, since they can't produce the relevant paperwork? I've followed the templates that have been placed on this forum, but now that they've ceased contact I'm stuck. Any help would be greatly appreciated. Thanks in advance
  9. I am about to send off a letter again. It's been over 40 days since my original request and still I have not received a copy of the CCA. Below is the letter I am about to send. Can anybody advise me if this is an ok letter, or if I should amend anything? Dear Sir or Madam Your Ref : xxxxxxxxxxxxxxxxxx Account number - xxxxxxxxxxxxxxxxxxxx I wrote to you on the 19th May, 2008 asking for some relevant information. I enclose a copy of the letter which was sent via recorded delivery. You wrote back to me on the 21st May, 2008 without providing any of the information asked for in the original letter. As more than 28 days has now passed from the date of the letter you are now in breach of your duties under Section 78 of the Consumer Credit Act. If you do not provide the information within 7 days I will have no choice but to escalate the matter to the relevant authorities including the Office of Fair Trading and the Information Commissioner's Office. Yours faithfully Me -------------- My aim is to get them to remove this default totally if they can't produce the goods. Any advice would be well appreciated. By the way, the original letter asked for a copy of the CCA with £1 postal order enclosed. Receipt has been acknowledged with them and they have told me this could take 6 to 8 weeks.
  10. Hey Purpley, could you keep us posted on this one? I'm in exactly the same boat - paid off my debt 12 months ago - I've asked 1st Credit for a copy of my CCA (to which they replied this could take like 8 weeks), and am still waiting. That was 5 weeks ago. I know they are now in breach of the length of time to get the copy to me, but I don't know if that's enough to get the default removed. Thanks

  12. Hi - I've recently asked 1st Credit for a CCA - they are now well over the 12 day period to produce it. I have received a letter to say they will supply, but that's it. The debt was paid over a year ago - all I want to know is this: if they don't respond with a CCA, can I then request the entry on my credit record be removed? It's in their name. Thanks
  13. Just another update: spoke to 1st - confirmed no debt owed. This is a standard letter they send out (!!!!) and it just happened to include this figure. How many people are going to receive these letters and PAY?! I'm writing to their complaints department immediately.
  14. I've had a letter this morning stating that they are contacting Citi with regards to my request and will be responding as soon as possible. However, they are now stating that there is an outstanding balance of over £300. This is incorrect and this debt is down as settled! I will be speaking to them tonight, but has anyone had the same experience? These people are really starting to get to me.
  15. I thought I might be stuck with it. Originally there were two defaults recorded against the same debt (one by Citi, one by 1st) but since Citi made an error they removed the entry altogether before it got all legal-like. Just out of curio, though - if they don't come back to me with a CCA, can I apply to have the remaining default removed?
  16. Just spoke to Experian - they basically said what I said in my second posting. I defaulted, and now I show one default which is correct. Should I just leave it at that.....?
  17. Wow that was quick! Thanks. OK, so they should not have put an entry on my CR then. Is that what you're saying? If I contact Experian they will look into it for me? I know I'm pushing my luck here at the end of the day - I defaulted, therefore I should have an entry - however Citi removed theirs because they made a mistake which I suffered for, and this one shouldn't even be here in the first place.
  18. Hi - first of all, I'm very sorry if this is a duplicate post. This is my first posting, so a bit overwhelmed with info here. Reassuring to see I'm not alone, though. A couple of years ago I defaulted on a loan with CitiFinancial, who passed the debt onto 1st Credit. I paid the debt off through 1st. Recently upon checking my credit record, I saw that I had TWO entries for this loan - the first with Citi, the second with 1st. Citi still showed as active and unpaid, 1st showed as settled. I contacted Citi, who couldn't apologise enough (after being threatened with action) and then proceeded to DELETE the entry from my credit record. HOWEVER, 1st is still on there. What I'm querying is that they have put an entry on my credit record without me actually signing anything. Also, they automatically put me on as status defaulted on THEIR loan on the same date as Citi (eg 10th Jan 2006 for Citi and 10th Jan 2006 for 1st Credit), so anyone looking would see that I have TWO loans, one with Citi and one with 1st, and that I stopped paying both on the same day, hence doubling the debt and doubling the pain! I have written to 1st, who have ignored my letter (I know see that I need to enclose £1 postal if I want the CCA), and plan on writing again. Can someone please advise first though? Do I need to have signed something with 1st for them to place this entry on my report? Is what they've done legal (credit entry, instant default, same date as previous loan)? Thanks in advance.
