  1. Hello, me again I thought I'd use this thread instead of adding a new one as its still abbey who are the only real pain in the bum I have left. Long story short, had a mental 2009, but through it all managed to get myself on an even keel in regards to my debts. However, as I had put abbey on the back burner, it didn't go any further in regards to taking it to court; it would of just remained on hold anyhow til nov. Even after novembers decision, didn't hear anything from abbey til january this year, just a letter saying that I still owed them money. They've now sent it on to the collectors, recieved a nasty letter 2 weeks ago demanding that I pay the full amount instantly or face a visit/court action. As I've not heard anything to the contrary I take it that the whole charges thing hasn't changed since november? Is there anything I can do now or can abbey just keep on til they get their money back and I not be able toreclaim anything? Thanks for any help as always

  4. Bump Is there any way I can check through what they've sent me myself? What do I need to look out for that would make this agreement flawed?
  5. Hiya I've finally heard back from Allied international.   6. I too was contacted by aktiv last year concerning a debt from ELEVEN years ago. Its obvious that as far as these companies reach, aktiv is little more than a pushy scavenger. I informed them when they last contacted me by phone of where they stood, I didn't have one of the 'I'm a legal expert' call me, so they had little more to say than 'lets leave it at that then.' Haven't heard a word since, until last week when they sent me a letter offering to write it off for 60% of the original debt, which I consigned instantly to the shredder. I'll send them the statute barred letter next week to make sure theres no further misunderstanding, although I don't hold too much hope. It's a pity that they have obviously had at some point some success with trying to enforce debts that legaly they have no right to, and people not knowing their rights.
  7. Thanks again Citizen! So, if I get you right, the proper format for a cca is a single sheet of a4, printable on both sides, with sigs from all concerned. Also that the 7 pages sent amount to nothing more than a set of T&C?

As I said in my other post, firstly I was under the impression that they were required to send a copy of the signed agreement. But after reading another post in regards to the ambiguity of the term 'true copy' I sent a follow up request asking for a signed copy. Also, upon reading other threads concerning ccas, I noticed some old posts concerning the requirement of of a new cca being formed and also the fact that the card supplier was required to provide a copy of the original agreement in the event of a new card being issued. I lost my card at the start of 07 and was issued a new card, but as far as I can recall, the only paperwork I received was a copy of the T&C and information concerning the activation of my new card. I have read several posts discussing the terminology of sections 77/78 regarding whether or not the requirements set forth in the request are met by an unsigned copy such as I have received. Basically, I am a little cloudy on whether or not I have a leg to stand on in the case of the bank taking the case further. Any help is much appreciated, Thanks
  9. Hi. Had a search through this thread to gleam any further info in regards to ccas. At the start of the thread, all be it dated 2006, there is info concerning the the new token loop hole, does this info still stand? I only ask as it may be another point on my side, was sent a replacement card a while ago with only a copy of the t&c.   10. Just an update: I still haven't received a signed copy of my cca from lloyds. Taking another look at the original request I sent, it states that i require a 'true copy' and not specificaly a signed copy. In regards to that I have sent them another request outlining that I require a signed copy pursuent to the CPR. I have further since heard only from MHA asking as to why no payments have been made. I informed them, as I have before on a number of occasions. that I am still waiting to hear back from lloyds in regards to my cca. To which he replied that without further payment, in 5 days, I will be defaulted and the account handed to a dca. Can they do this? The CPR request runs out 02/02/08 so I hold no hopes of receiving my cca, even if they have it, before they move on with things. I thought that they weren't allowed to pass on my information before answering the request as they would have to pass a signed copy of my cca to any dca they sold the debt to. All help is much appreciated as always.
  11. At last they have replied, after nearly 2 months, and on chrimbo eve of all days! Basically what they have sent is a copy of a credit agreement, completely unsigned, the only mention of my name is in type at the top of the front page. The form seems to be more geared around regulations and the like so I take it that this isn't actually a cca at all?
  12. No worries, thanks for the reply! ;-) Not yet no. I'm at that stage now, is it posible to just add the extra charges when filling in the n1 without letting abbey know that the claim will be for a larger amount?
  13. Update. Abbey have now stopped contacting me other than by sending the occasional statment. Since my claim started they have added a further £130 in charges to the account. My question is that with all the delays that have occured during my claim and with the extra charges that they have added, is it worth my while to start my claim over? Or do I just carry on even though some of the dates have been overshot and make a further claim for any additional charges added once the original claim has been settled? Thanks for any replies Edit: I contacted my local county court to see if they could advise me at all in regards to the matter and they told me that as the cases were being stayed and that all I had done so far was give preliminary warning concerning action that there should be bno problem with my contibueing with the clsim as is.
  14. A further update. The collections dept phoned me up once more on tuesday this week in order to ask me once more why I hadn't made any payments, for the umpteenth time. As I still haven't recieved any reply what so ever to my cca request, 1 month overdue now, I explained to the guy on the phone that I was not willing to speak to him concerning the account and was in no way willing to make any further payments. He got a bit flustered and confused and just told me to phone customer services. I said that it was up to them to get in touch with me now as I'd already contacted them concerning my agreement, and also instructed him that the collections dept should by no means try to contact me by phone until the matter was resolved. he said ok, apologised and said goodbye. they have kept to it, all be it for 2 days, and I have not heard a peep from them. I take it that I need not do anything further at this time as with the request the ball is now in their court?
  15. Right. I've not had chance to get anything done since thurs. I was just wandering whether there was a letter I should send now that they haven't responded to the request? Or do I just wait for them to get in toch with me? I've been away over the weekend and on my return noticed lots of missed calls on my mobile from them. Nothing since though. I just can't get over them not responding at all to the request. I sent it to credit card services, was this the right place to send it? Thanks again for any replies
  16. Thanks for the reply Thought it was 40 days for some reason. I'll get on with things now then. Any advice about the aparent default they've taken out against me? Does requesting a cca count as placing an account in dispute?
  17. Hi. I have had a credit card with LLoyds since 2005. I was initialy given a limit of 5k but never went into the red with it. During 07 I had to make use of the card, due to heavy charges from lloyds, and so ended up going a grand into the 5k. Almost immediately they dropped my limit to the amount I had spent, and started to apply charges and what not. I sorted it out and began making payments to cover the ineterst and a little bit more every month. However. This year I have had to miss out payments on the card a number of times. As soon as I did, they began to harrass me by phone at every oportunity.So I thought I'd send a rquest for my cca. That was 2 weeks ago now, and yesterday I was sent a letter from Sechari clark and mitchel formaly demanding me to pay all the money owed, now at 1400, or further action will be taken. They also add that a default has been issued, of which I was totaly unaware. As the time limit for the cca is 40 days, unless I'm wrong, theres only 2 and a bit weeks for them to reply. If no reply is forthcoming can I apply to have the defauilt removed? Any help is much apreciated.
  18. Thanks for the replies:-) Bloody demon leading me a merry dance so I've not been able to get much done claim wise. Heres an update anyway. Abbey's in house credit people kept pestering me with letters, almost identical letters for a month. Don't think I even bothered to open the last couple. They then tried the default thing for the second time so I sent another copy of the do not default me as the account is in dispute letter. Along witht this I sent them a latter offering to accept a lower payment. I heard back from their credit people on the 10th of nov, the letter just said 'Thanks you for your recent letter.In order for me to help plase telephone your account manager on ...within 7 days to talk about your situation.' As I was unsure as to which letter they were refering, I gave them aa call. Aparently all they wanted was to ask me if I wanted to make a payment over the phone. I said no the account is in dispute. They said that after a while they'll send the account back to abbey who will then send it to an outside dca. I said thanks, bye. Theres 4 days left on the reduced payment thingy i sent. Although I don't expect to hear anything.
  19. Update. After having a few problems, court failing to send out n1 forms twice :-s, I'm finaly ready to go ahead with the final step. Just been looking at the info to include on the n1 form, do I have to include everything in the post? I tried to copy nd paste onto the pdf included but couldn't get it all onto the back of the form. Help apreciated as always
  20. Hi. This is from a little while back, a few years, but it popped into my head again the other day so I thought I'd put it to you nice folks here ;-) Right... End of 04, dec, I moved into the house I'm living in at present. On moving from my old flat I phoned demon, in the glory days of them having a uk based call center, to let them know I needed my supply switching. Anyway a week or so later I had moved and at first had to put up with a dial up service whilst waiting for my bb to be sorted. !0 days later and shazam! I was back on bb so phoned demon and got them to switch the dial up off. More time goes by... Not being one of these folks who sifts through their bank statements checking every last detail one day I had to cancel a dd so popped down the bank to do so. While I was there I got them to write down a list of every dd that was going out only to be shocked when they infromed me that I had 2 dd's going out to thus plc. Got home and phoned them straight away to ask what was going on. Basicaly they had been billing me for the dial up for a year after I had asked them to shut it down. Frustrated by trying to get anywher on the phone I started emailing them. They just kept up the 'you have no evidence that you asked us to terminate the dial up connection'. Do I have any rights in this situation? Thanks in advance
  21. Since sending the follow up letter I've had a letter asking me to pay any oustanding overdraft off over the counter at my local abbey and a text asking me to phone them on an urgent matter. Do I still just wait? Thanks Sam
