  1. Regarding the Fair Processing Notice , does this specifically name an individual and is dated? I have probs with HSBC passing on 2 accounts in dispute to Metropolitan, so any ammo I can get would be grat....
  2. OK, here's my situation in a nutshell: I have 2 business accounts with 2 businesses, one with an agreed overrdraft A of £5000 and the other an agreed overdraft B of £4000. Buiness hasnt been good over the past few years and I went to my local branch to ash for help. The buiness manager there advised me to move funds from B to A leaving B very close to the OD limit. I recognised that we were not getting any money in from the business and asked HSBC for help, they said thgere was nothing they could do. I asked for the interest and charges to be held as they could well see that there were no funds going in and that it was soon going to spiral into a black hole. I sent Income and expenditure forms to them proving I had very little income but still HSBC kept on piling on the interest on both overdrafts until they now both sit at around £6500, well over the agreed limit. I now am suffering quite badly with depression over this, it's affecting my health. Contacted HSBC numerous times and you always get a different person, or someone in India who doesnt have any idea what you are talking about. By HSBC's own admission they said the notes on the system about me were in a complete mess and they couldnt tell what was going on. They assured me that the debt would not go to a Debt collection agency until every possibility was exhausted, 3 days later they passed it onto Metropolitan. Before this happened though, I had lodged a complaint with HSBC that they had broken the terms of the Banking Code. I've also lodged a complaint on 23 July with the Financial Ombudsman. Now, I have Metropolitan asking for FULL PAYMENT within 24 hours, the bank will not talk to me as they say they have closed the accounts and passed them to Metropolitan, Metropolitan tell me to talk to the bak, you can see the catch 22 here. The bank did issue a final response, but that was regarding a matter that had nothing to do with this. The left hand definately doesnt see the right hand here. I'm furious, this whole situation came about by HSBC's advice to me and also them not recognising my requests for help. I've asked HSBC to take the account back and they won't although as I understand it, they should not have passed it to Metropolitan in the first place as it was in dispute in the first place. So I have Metropolitan who are not interested in the history of the case at all, just the money and the HSBC who now wont talk to me. What can I do? UPDATE: Just called MCS to arrange a monthly payment of £1.00 Postal Order top them and have been advised that they have now passed the debt to DG Solicitors.... I only got the bloody letter yesterday (14th May) and it was dated 7th May. Getting really worried now.... any help?????
