yes-- rather naively,after i received a demand after 2 years of hearing nothing--- i wrote to them and simply asked what the reference number on the letter refered to---that was all i asked....
I then got a letter saying everything on hold---then this morning i was posted all the statements from 2001 onwards...

Thanks for this--- i'll answer questions raised ( please see my responses in blue)...and i am worried about it as the amount being claimed is massive:
These statements you have been sent - have these come from Capquest or directly from Egg? Did you send an S.A.R - (Subject Access Request) to Egg? Did you send a CCA request to Capquest, and if so what happened?
These came from CAPQUEST--not yer SAR them or CCA--but will do so now
The more details you can give us, the more likely it is we can find something useful.
What do you hold in the way of assets? Are you a property owner, and, if so, how much equity is in the property?
no longer a property owner but still own interest in a business which failed---approx equity £20k
Are you on benefits or do you earn money in a job or business?
previously claimed benefits but now working
All of these factors infulence what might happen.
We need all the facts we can get at this stage.

42man- with regards to the letter---as i did not actually formally request shall i still sent out the letter as suggested?
As i stated in one of my earlier postings all i did was to ask what this was allabout but at that point i did not actually send a formal request--

Just an update....and i am now increasingly becoming worried as fear that they will simply place a statutory demand...
I have this morning received approx 60 odd pages of copy statements--looks like computer printout as EGG logo does not appear on any of them...Anyway-- all they(CAPQUEST) have sent are these statements showing a massive accumulated debt..they have not sent anything else at all e.g debt purchase, defaults, credit agreement etc,etc,etc
They have now given me until 9th Novemebr to call and pay them prior to escalated recovery action..
Please could someone urgently advice me on what to do next and keep these people at a distance...i am really worried as i have heard on this forum abput the tactics that Capquest use..

jst a little advice again please -- just want to make sure that i am sending the correct letters:
for a debt which i do agree with and am simply just after claiming back unfair charges, is it just the SAR that is sent?? and not CCA??

Hi,
Having now lost house--i am begininng my fight against all those who i feel have unfairly charged.
I have a 'cardcash' websaver account with Halifax since 2002-- after my problems started in 2004 i have been consyantly charged £39 (unpaid DD's etc)- yes, i realise that if i'd managed my cashflow better then they would noy have charged but unfortunately everything spiralled out of control.
Could someone advice me the exact steps to take with them now---and also is it still worthwhile doing so.
I would be grateful for any advice-
PS/ over past 12 months i have also had a period of unemployment ( approx 2/3 months) when they were still charging me--- i am unsure the cases that can be put forward as 'hardship' cases-- I am no longer unemployed though and can't really prove hardship presently as we have already lost everything we had!!!

I understand what you are saying but i have not yet made any formal requests--
all i did was to ask them what it was about( a very brief 1 paragraph letter)--
The rely i received this morning quoted atha' all on hold for 28 days'
So should i now send the templated letters that are advised on this forum e.g SAR/CCA requests etc

anyway this morning a brief letter arrives and states' ...account is on hold for 28 days whilst we obtain the information required''
I strongly do suspect they will issue a stat demand when i formally dispute this in the future so can i preempt them by disputing it now and could you advise the exact letters i now beed to send out to them and in what order- any advice greatly appreciated

The final update is that we now longer have a home as sold under value due to repo order--- I am free of my mortgage & charging orders etc but now no home. we have been allowed to stay on for another 30 days to find place to rent.
My sole aim now is to appeal against every unfair charge etc whether it be my previous mortgage company or the people who placed charging orders on my property..
I am fully aware that i frst send out a S.A.R - (Subject Access Request) with £10---is there anywhere on the website that i can see all the following steps as well...and are the forms the same for each creditor

Thanks 42man-- I will take the advice available here and pursue all of this---
as you've probably guessed i will very shortly lose my home as unable to keep up with arrears---have sold it cheap to start getting a life again-- but i feel aggrieved with all the over charging that i have suffered-

As i said in one of my very early posts - it was my intention that as soon as i'd got rid off house( repossession)-- i would then sit down and deal with one by one all those who have in the past placed massive charges to my account...
However, after being away for 3 days when i logged on yesterday i read here that some court action/judgement had not gone in the claimants favour?? not sure what it really meant..
Does this mena that there would be no point in pursuing the ones that i had in mind to deal with

Situation has developed in that they will take their money in full when my home goes--
As i am now too lae --after the house has sold ceven though they have had all of their charges etc in full can i still satrt a claim or would it be a waste of time--
they don't seem to have all the documents etc and have added on massive charges...but at the moment they have won as they will get their money repaid in full when house completes

Hi,
just received a letter from solicitors and a 1page copy of the signed 'credit agreement- regulated by the consumer credit act 1974'
Nothing else---so is this all they are supposed to send to me and could you advise what the next step is??
Ps/ in the letter that accomoanied this 1 page agreement they have also stated right at the bottom ' Further costs will be added to the account should we have to enter into lengthy correspondence'
Hope someone can advice me again

Thanks again-- i am just beginning to realise that the sorts have charges i have paid i the past are astronomical---it is no wonder that i cannot seem to get myself on track.
I totally agree with you that the additional could be legal but when they applied for charging order the costs were supposed to be included
I will keep you guys informed but have to add that i'll probably be back for more advice as thanks to this forum i am now starting to go through all of my state,ments---so far i am shocked at the charges i have been paying out---
I guess this was my stupid fault for not paying my bills on time!!

I am sorry but another issue i am trying to resolve....
Creation after getting a CCJ secured their judgement order for £4300 via a charging order---last year.
I had requested a statement from them regarding actual figures as i'd only paid approx £200 since then...
They have sent an amount owing of approx nearly £6600!!!!--
with loads of charges added onto it after the charging order was granted
Plesae can anyone advice s i am at my wits end again...
I am sorry if i have posted this on the wrong section but am desperate
