Hi Ingrid, firstly it is not Consumer Protection (Distance Selling) Regulations that you require, but the Consumer Protection (Cancellation of Contracts Concluded away from Business Premises) Regulations also known as the Doorstep Selling Regulations.   2. Hi Ingrid, firstly all utilities (telecoms, gas, light & heat) are exempt from CCA! Secondary BCW i take you mean BCW Group Plc , they are nothing more than a Debt Collector Agency, most likely Carphone Warehouse sold them this debt that CW could not collect them self.   3. 1: When a customer takes a Transcash payment slip to either a bank or Post Office, does the bank or PO convert this payment into an automated BACS payment or credit to the target company? 2: If not then what do they do with the Transcash payment slip that they retain? 3: What is the fee charged to the customer for: A: Customer pays 100% fee at PO?   4. 1: Unpower the modem for a few seconds (which releases the modem's fixed ip number). If the router still does not work right, you may have to clone the mac address to do this. A: Connect the modem directly via ethernet (RJ45 lead) to a pc and unpower the modem for a few seconds. B: Power the pc in WINXP run Command prompt or Run, type getmac.exe it is found in C:\WINDOWS\system32, note down the numbers for the port (RJ45) there may be more than 1 device. C: Unpower the router for a few seconds, pull the rJ45 lead from modem to pc at pc end and plug into router WAN port, plug a rJ45 lead from the routers LAN ports to pc. D: Use a web browser (IE / Firfox) to login to your router locate the CloneMAC page (normally advanced settings or manual configuation) and type in the mac number you obtained from getmac.exe, then click apply and save and exit, now all pcs should work from the router.

Basically my issue i bought 2 high value items with a 15 year warranty, but they did not have any documetation or warranty card in both, i got in touch with both retailer and distributer about a month after delivery and was told: Over 3 years later 1 item has gone faulty, now the retailer ask me to send by RD the serial number label from the item, but there is just 1 problem there. There is no serial number label on both of high value items period. I think that the high value items i got were someone else's warranty returns! As the faulty item is faulty in around the area where i beleive serial number label should be! Can recind the contract for a refund as the high value items are mis-discribed?

  7. Hi can anyone confirm if the Sale Of Goods Act 1979 faulty & mis-described rights are they same? I think the rights are the same, but not sure? Also does anyone have a link for Sale Of Goods Act 1979 in either '.PDF' or `.HTML'?

Thanks `Bookworm', & `ScarletPimpernel' for your help and advice, yes it was three seperate policies, so they will just have to take £83.60 as a loss, incidently i did recommend that both my parents were on the same policy, but that was costing 1 penny more than 2 single policies and my sister added no excess for a cost of £4.47 more, which could have reduced their losses by £40, but thier penny pinching cost them in the end!
  9. Hi Bookie, my parents paid £2170 (in full) by the begining of May, they got a refund of £1975 from Thomas Cook, which ment the deposit was £195 which was lost! On the Insurance side, (they got £65 on each of the three policies (£195) with an excess of £20 each, which leaves a shortfall of £83.60 including the excess, should my parents claim for the extra costs of £23.60? I have looked at the policy T&C's, but dont see anything it's Insure & Go if it makes any difference!

  11. Hi Vonnie, There is a process called the "Right of Appropriation" - this allows you to assign funds entering your account to specific events and needs. This is for ANY funds, not just benefits (The Consumer Forums).
  12. Hi my parents booked a vacation to Cyprus back in January for 3 persons to go in September, however my father was diagnosed cancer in mid May, thus the vacation was canceled. My parents paid £2170 (in full) by the begining of May, they got a refund of £1975, which ment the deposit was £195. Today i noticed on their invoice that they had paid £120 Air Passenger Duty + £15 Fuel duty. Can i reclaim the £135 of taxes from the travel agent (Thomas Cook) shop? Also should my parents have received a copy of (Thomas Cook) Terms & Conditions as they did not get any? On the insurance side, the medical report was filled by my father's cancer consultant, later the insurance company wrote back requesting the medical report must be filled in by your GP, however the GP's report has a price tag of £15. Can i claim the £15 for the GP's report from the insurance company? Also can claim the special delivery costs (£8.60) from the insurance company?

Name of company that registered the default: Halifax Card Services Amount of the default: £195.73 and again for £5.52 Was the account settled or did it still have a balance: 193.61 If the default was all/part/no charges: The default was all charges. What action did you take & on what grounds did you request the default removal: At LBA stage they offered to remove default, but gave me another instead! What (if any) third party was involved: Experian cleared both defaults after 5 months. Full story (The Consumer Forums) The defaults were only 1 month late markers!
  21. Hi katscash, i would first write to `Capitol one' rejecting their offer regarding the default, however the money they refunded you can be used as a part-settlement or rejected in full. Also put the amount you require and your terms of settlement in full (basically all my money and removal of default). However at the same time i would continue the court action in its present form if they do not agree (make sure the default removal is a component part of your court claim if not add it)! The court cost for default removal only is £150! With regards to your default is it a `8' on Experian? With regards to your CCA or S.A.R; is your credit agreement an application form?!   22. Hi Mel, firstly i would get in touch with one of CAG's moderators and get these three links merged in one post, then just use that post to add updates or new questions. Sticking to the one post is important as it gives users your full history that you have already posted, so you dont have to reiterate your history again and again and what help that has already been suggested from other users. Look at the `Blemain finance' post by `Dax' for example, currently there has been 180 replys so far. Where or who did you instruct your baliffs to collect from?   23. Hi 100mel sorry i have broken up your post as it makes it easier to read and your intention it is not very clear. Did Sainsburys just refund you your basic charges + court fees back, not including your bailiff's fee and FSO compensation amount? So Sainsburys just want to set the default as `satisfied' on your CRA records? Do you mean if i take will the money and they will do nothing about default? I take it that you are sueing Sainsburys! I would first write to Sainsburys rejecting their offer regarding the default, however the money they refunded you can be used as a part-settlement or rejected in full. Also put the amount you require and your terms of settlement in full (basically all my money and removal of default). However at the same time i would continue the court action in its present form if they do not agree (make sure the default removal is a component part of your claim if not add it)! The court cost for default removal only is £150! I do remember seeing that banks refunding charges without notifying you is unlawful and underhand, pretty sure it was a bank regulator.
