YasJaz - it was the week of the case that they decided to settle. And no - they still havent paid up yet!! -

The court has completed the case as they showed up in court on the day and said that they were paying me, but the court has set the case to 'dealt with' on the internet so I assume that it is closed. -
Hi, Agreed a settlement with BOI just before my case as they said they werent going to defind it. Here we are nearly a MONTH after the case and they still havent paid for the following reasons: 1. They havent heard from the court yet (even though the settlement was reached out of court) 2. Once they issue a payment order it will take several weeks until you get the money. Has anyone had this problem with them?

Hi there, Must be having a blonde moment as all this is confusing me today!! I have written a letter to Preferred Mortgages about £700 of bounced dd charges and they gave me the usual fob off letter. Is reclaiming these penalty charges against mortgage companies still recommended? Thanks -

I'm at an advanced stage with my BOI claim. The claim relates to a business bank account which has now closed. The cases are due to be heard on the 5th October. The claim was for near £4000 so I still the claim into two smaller amounts. I then went ahead and filed the claims with the courts and have received their response. They have disputed the claim on the following points: That I referred to them in the claim forms as the Bank of Ireland and not The Governor and Company of the Bank of Ireland (how was I meant to know that ) Charges were correctly applied in accordance with the terms and conditions The charges that were applied to the account were not applied pursuant to an unfair term of a contract as alleged Denys that the terms and conditions are unenforceable The applicant has commenced two actions in the Small Claims Court in respect of bank charges applied to her account. The total claimed is £3951 and exceeds the Small Claims Court limit. These cases should be amalgamated and transferred to the County Court or written down to £2000 plus interest thereon and one court fee Counterclaim: They also lodged a counterclaim for £352.76 and £72.38 in interest on an unpaid overdraft as the account was closed (I have to check this to see if this is correct - I honestly dont know at the moment) and also their court fee of £18. Has anybody any advice on how to prepare for the day in court?

About the phone call - as soon as I sent the Subject Access Request - the manager of the bank was on the phone to my parents (whose accounts it is) acting dumb and asking them why they want the information. Thankfully - I'd told them to act dumb. But maybe this is a bullying tactic?

Hi there, Spilting them up into 2 is exactly what I'm about to do. I'm going after the Bank of Ireland for £3965 (just sent 2nd letter today) and Ulster Bank for £3000 (first letter sent today). My accounts are business accounts and I had to chase the statements up from the Dublin office myself. The girl I spoke to down there said they were getting hundreds of these requests. Perhaps they have now decided not to deal with customers personally? Definately keep on them and get your remaining three years back. Good luck with your fight!
