Use the DPA letter to force the bank to provide your data for a maximum fee of £10. Send the Prelim letter and stick to the timetable it lays out - don't be put off by their arguments about lawfulness, Terms & Conditions or any delaying tactics.

Reclaiming Credit Card Charges

As far as the OFT and £12 is concerned - it was a guideline and not an acceptable limit. By making and unlawful charge the whole amount is in dispute, not just a portion of it. Just carry on with the process. -

If you've already raised a claim there's no need for an extra form N1 (it's the form you use to raise the court claim if you don't use MoneyClaim. You must send the bank and the court a copy of your schedule of charges, as this constitutes the financial details of your claim.

Apologies for problems with the site - this is due to a software upgrade. This practise is common among all banks and does lead to a convenient method to be able to charge more. As far as the OFT and £12 is concerned - firstly, the statement was only in connection with Credit Card accounts - and secondly, it was a guideline and not an acceptable limit. By making an unlawful charge the whole amount is in dispute, not just a portion of it.

You will need to print it out and send a copy each to the court and the bank. The court address should be on the Moneyclaim site - it's in Northampton I believe.
