  1. Please can someone help I have a court hearing next week to decide if Sainsburys should continue to have a charging order my home for £1500. I got this credit crad around 5 years ago when I was asked to sign up whilst shopping in sainsburys! i was fine until got into trouble with debts when had my second child and was on maternity money, then could only go back part time to my job, eventually this debt got passed on to debt collection agencies and I arranged to pay sainsburys by standing order I got it down from £5000 to the £1500 but trouble started when i changed banks beginning of the yr and lost the SO details to pay, I rang a couple of times and paid on card asked for SO details and was told they would be sent out I never received them, next thing a couple of mths later I got a letter from court stating that eversheds and sainsburys had judgment against me and I had to pay forthwith. i couldnt afford this and so wrote many times and emailed Sainsburys to arrange a way to pay in monthly installments, i then got letters from eversheds that sainsburys were happy to accept a payment arrangement but they were applying for charging order and would accept payment once they had the charging order. I have sent SAR to Sainsburys and Eversheds and also asked for copy of my credit agreement as I cant ever remember signing one just the application form in the Sainsburys store, also PPI was added onto this account and lots of late payment/overlimit charges that I want to claim back, but is it too late now that they have the ccj and charging order and is there anything I can send or take to the court next week to stop it being made?? The last time I heard anything was a few month ago now when eversheds wrote to me and asked for a list of all my creditors so they could write to them and inform them of the charging order, to which I did not reply. Please can someone help??? thanks

Hi Please can someone help me, I have a claim against GE for all the fees/charges ect that have been added to our mortgage, we have now complained to the FOS about these but recived a letter yesterday from GE basically asking me to call them to let them know how I wanted this matter to be settled and that my complaint would have a considerable delay with the FOS before they are able to consider our complaint and that this may give us the opportunity to settle the matter between us in a much shorter timescale and that if I was agreeable we could discussn it over the telephoneor I could set out exactly what my expectations are for the settlement so they can understand if there is room for a negotiated early settlement. I have replied and told GE that I wish the FOS to look at my complaint as I have give them plenty of time to settle my complaint and they havent! We took out our first mortgage with GE in Sept 2004, but I cannot remember which broker we used and need their details so I have just recently sent a SAR to GE for the details on this mortgage as PPI was included on the agreement and I now want to claim this back also, does anyone have any idea of any brokers GE (well IGroup at the time) used as I would like to send a SAR to the brokers also, I am sure if I see the name I will remember! I remember at the time we were in a mess with our finances and the brokers sent a sales man to my house to complete all of the paperwork, and that at the time they did a cash back when we got the PPi with the mortgage, now after reading everything on here about GE, secret commissions etc I want to gather as much evidence as I can to send to the FOS, the current complaint we have with them is with regards to this mortgage and our current mortgage which we took out when we moved as they would not allow us to move our old mortgage and I have issues with the fact that at the time Sept 2005 they said they didnt deal with new mortgages directly and GE gave us the number of Loans Etc to call, we paid a broker fee of £1610 added onto our mortgage for this company and really they did not do their job they only looked at GE Money no other company, so if anyone has any ideas of brokers that IGroup used at this time as I really want to get this sent into the FOS and let them look at it all Thanks Maz
  3. Thanks Ell-enn, I have sent my letter now did it in my dinner hour! I have just put on basically the same as what I sent a couple of weeks ago to them, but have added somemore on with regards to the texts from the manager. I also sent the £50 by postal order as I don't have a cheque book anyway! I will text the agent tomorrow and tell her that I have sent my payment and letter to head office, and tell her not to bother calling to mine see what she says tomorrow!! Thanks again everyone!

Ok I will do, I will send the £50 that I originally asked to pay with the letter and will send an income and expenditure form to show that this is all I can afford at the moment until my hours go up again. I will mention in the letter about the manager texting me with regards to a £4000 charge that would be levied to her if I didn't pay extra also.

I will write another letter now to head office, as they haven't replied to my other one and I will post it today, I am going to complain about her actually because I am annoyed that she has text me stating she is going to get a £4000 charge levied against her if I don't pay an extra £20, why would they even do this?? I think I might go to the Citizens Advice Bureau for some advice on this as well!
  6. Ok I have wrote to head office but they haven't replied yet, I thought that something was up, how could the manager get charged over £4000 just because I didn't pay £20 extra!
  7. Please can someone help me I have 3 provident loans, in total they come to just over £5000. I have been really struggling to pay these as my hours were cut at work and also my partners. I have got copies of all three credit agreements and they seem fine, I have asked them to pay a much lower amount of £50 per month as this is all I can afford at the moment. The agent text me yesterday asking when I would be paying, I can pay tomorrow so text back and told her, and then told her I would make a payment again on the 27th March when I get paid and that I would try and pay as much as I can but obviously my mortgage, council tax and utilites need to come first. She then text back asking again asking how much I would be paying as they are being charged thousands in bad debt charges by the bank because of missed payments. I text back and told her most I can afford tomorrow is £100. I then got a text off her manager about half an hour later, stating the payment you are making this week, how much are you paying, so again I text the manager back and said £100. She then asked if I could pay £142.50 which would be 2 weeks payment, so I said I could at a push if I can get the extra money together. She then text back saying thank you. I then get a text ten minutes later from the manager again saying sorry just spoken to my boss and he is asking for £163.75 this week to prevent a charge being levied on her of over £4000, and would I be able to pay this amount. Please can someone help as I dont know what to do, I can probably pay the £163.75 but it will leave me with no money at all until I get paid in 2 weeks, and then when I do get paid I don't think they will accept lower payments then and I usually pay monthly so its like £285 per month of which at the moment I can pay £50 until my hours go back up at work, I have already wrote to head office at Provident to offer this payment and last time the agent called I paid her £50 and she said as long as we get a payment they are not bothered, but now they are saying that they are going to get charged etc if I dont pay more, is this right? Please can someone advise me Thanks in advance Maz

I really need some help, I have 3 provident loans stupid I know, I have had loans with Provident for a good few years now taken out because I have been struggling to pay everything again stupid i know, but I have now managed to get nearly everything sorted payed all of my mortgage arrears off ( I actually got a loan off provident a few yr back to pay these off but ended up back in arrears with my mortgage again because of trying to pay them both) so ive been in a bit of a nightmare. Like I say most things are sorted now Ive managed to do lots of overtime at work and used every single penny i have to pay towards getting debt payed off, but I am still in arrears with my Provident loans I am around £300 in arrears and the agent will be calling tomorrow for payment my weekly payment is £68 so I have to pay that also tomorrow, i just dont know what to do as I cannot afford this and don't get paid for another few weeks, does anyone know if i can request to pay less a week back or anything because i really want to get this paid off but I just can't afford the repayments my partner has recently lost his job aswell. Has anyone else had dealings with them i was thinking I might ring the head office in the morning and ask them about reduced payments because I don't really want to speak to my agent about it as when Ive had problems paying before her manager called me and said they would come to my work to get payment of me if I wasn't paying at home, and she has been texting me lately telling me my arrears amount and that the manager will be coming to see me if I don't bring my account up to date. I would appreciate any advice on this:-(

Hi Well today we have received a copy of a final copy of our agreement but it is just what we already had a copy of its the mortgage offer and the signed mortgage deed, we took out the mortgage in dec 2005 would we have had an actual agreement, im confused a bit now so I think I will take your advice and go to the CAB and see what they say. I have the copy of the first mortgage offer and now the final copy as this is what they have sent today. We didnt take out any ppi with them as we had with the first mortgage with them and then cancelled it and got it refunded as it was over 5grand and only covered my partner for the 1st 5 years. Yes we did pay an ERC of nearly £3 grand on our first mortgage as when we originally asked if we could move and add extra to our first mortgage, and were told we couldnt and had to remortgage I actually complained at the time about paying the ERC as it didnt seem fair that we were staying with them and increasing our mortgage and yet we still had to pay it. i am going to send of my SAR's today to the brokers and GE's soliciotors I will start there and also will see about getting the mortgage offer and signed mortgage deed checked out thanks for your help Maz

Hi Micko Thanks for your reply I think I might actually SAR them all because I had a bit of an issue at the time because when we remortgaged with them we actually already had a mortgage with GE and when we asked to move our mortgage when we moved house I rang Ge and they said we couldn't go direct through them as they didn't deal with customers direct and they actually gave us the number for the brokers who we had to go through to be able to take out a remortgage with them, at the time I really didn't think anything of this but know I don't know if this is right as why should we have paid a brokers fee when they didn't actually do a brokers job of searching for the best mortgage with different lenders they just remortgaged us with GE. I have CCA them as we kept copies of everything when we took out the mortgage but we don't actually have a copy of the agreement just the mortgage offer and a signed mortgage deed, so I am still waiting for a copy of our agreement Thanks Maz:oops:

Hi Everyone As of today we have cleared our arrears on our mortgage with GE Money, they have a suspended posession order so I am going to ask for a Notice of Discontinuance at the court, but I now want to claim for all of the charges that have been added to our mortgage. GE have said that they can't chase us for these and they are just placed at the end of mortgage but we are getting charged additional interest on top of these, I SAR'd them a while ago and know the charges upto April so I am going to SAR them again but reading up in other peoples post it seems I should also SAR the brokers and the solicitors is this right? The charges are now over £3500, but I don't know what is the best way to go about complaining about them as we still have the mortgage with them and will for another year until our early redemption period runs out and we want to now get a good few months of payments showing on our credit history of not being in arrears, is it advisable to go after them while we still have the mortgage?   12. Sorry, Ive just read that I need to ask for a Notice of Discontinuance so that if we get into arrears again they have to start from the beginning!!!
  13. Hi Everyone We have finally as of today paid off our arrears to GE Money, what should we do now do we need to contact the court to get the suspended posession order cancelled? Also the total charges now applied to our account are just over £3500, and I now want to take this further and get these refunded back onto our account now that we have cleared the arrears, do we also claim back the additional interest that we have paid due to these charges?   14. no thats the charges they have added to our account we get a £40 arrears admin charge each month and then we had lots of charges for returned direct debits aswell!!
