  1. The old hot potato I know. Re credit card agreements. NOT enforceable if t&c are NOT on same page as signature? I have received my CCA's but where do I stand when the prescribed t&c's are supplied with but not on the actual agreement. Let's leave the fact that they may be the wrong t&c's - that is for the experts but I'm talking about where NO APR's or amount borrowed for example. I can work that one out. Perhaps the answer will come when I reject the debt on these grounds and they take me to court for a case of won't pay rather than can't. Suggest we build a thread / database of actual recent outcomes of court cases where the judge has made ruling regarding enforceability. There has been much speculation and advice on this site but the proof of the pudding...... Let's start here. Has anybody lost / won case on lack of prescribed t&c on CCA? looking for chinks in armour comes to mind.
  2. Have you already defaulted on any loans? If you default it will affect your credit scoring - think twice.
  3. Ok thanks. It's clear that unless the agreement is signed by the creditor it is NOT a properly executed agreement. Does this mean that the agreement could still be enforced by a court order though? Or is it case dismissed? Other threads I've read seem to indicate a judge would be unlikely to dismiss the case on grounds of no creditors signature.
  4. all I read is what a judge may or may not do. Has anyone actually been to court to test the 1974 act with relation to signed areements or any other technical points that may be omitted on the agreement?
  5. good question. I think they go by the registered keeper details (log book) but the KEEPER and OWNER are two seperate things. Reg. keeper does NOT have to be the owner!
  6. definative answer please, does a credit card agreement have to be signed on behalf of the credit card company to be enforceable in court?
