Might be good to start PPI threads in PPI forum? Whats the consensus? I'm mentioning my PPI case with Egg, through the Egg forum. That way, Egg users and PPI users can see information that could be useful to them both.

Haven't sent Prelim letter yet. Am awaiting results of my SAR request. They failed to supply me with complete information the first time around, so I wrote back to to them asking for the remainder. They have until the 3rd April to comply..... Phil -

Thats very interesting. I am awaiting a response from them, after they failed to comply fully with my SAR. I wrote back stating information was missing. They have until the 3rd April to respond before they are in breach of the Data Protection Act. Ajjars, did this happen to your husband? What exactly was involved with your 'fight' for the information after the 40days? Great there are other people on the forum in this situation with them... Phil

Ok, cheers. I will send the pre-lim letter today and get this case going. It does seem that they are struggling to provide hard legal evidence, so I feel I have good chance of getting them. Will be calling the OFT today for advice, and will start a complaint with the FO. The FO have been inundated with complaints, so will see how long a reply takes. Will keep all updated! Had a reply from them. They have sent me the CCA agreement again (still no inclusion of any PPI apparent on it), and sent me a copy of the terms and conditions of it. (Thanks, should have sent me that when I opened the account). They keep bleating on about this 'screen shot' of my application review for the EGG card, and have sent me another copy of it. It says it 'is as filled in by me on my application' and that it is 'read-only' format. Thing is, i didnt type in the words 'Accident, Sickness, Unemployment and Life' into the box. I need help as how to take this futher. How do I prove, that they cannot prove that I selected this? i.e I ticked a box. Would this screen shot really prove I must have opted for PPI at time of application, in a court? It seems the only evidence they have of me opting for PPI is this screen shot. I have no recollection of selecting this. Can anyone please advise, I really want to get them over this. Phil Already won full refund from EGG Card in relation to overlimit charges. -

Hi All BACKGROUND: Am in process of claiming back Egg Card PPI. I feel it was applied without my consent. I had account for 4 years, ACCOUNT NOW CLOSED. Total PPI taken £981 of first 3 years approx, until I realised what it was and cancelled it. (approx £24-31 per month, varied) ACTION MADE: 1. Spoke to helpline and he sent me screen shot of the 'application review' screen when I made my application for the card online. 2. Made SAR 3. Made Credit Card Agreement copy request. RECEIVED THROUGH POST: 1. Received screen shot. Only shows a web form, with one box labelled 'Payment Protection' and the text 'ACCIDENT, SICKNESS, UNEMPLOYMENT and LIFE' entered into it. Doesn't prove that I selected anything so far.. 2. Received SAR, however was simply a load of statements shoved into an envelope. 3. Received CCA, however no mention about overlimit charges or anything about PPI. Just two pages of paper containing my signature. ACTION TAKEN: 1. Spoke to OFT. Said that they would have to prove I ticked a box otherwise no contract is made. 2.Sent reply to Data Protection Manager asking for full information on myself stating that some data I requested is missing. They have deadline of 3rd April to Reply 3.Included reply to Data Protection Manager regarding the CCA. Said it does not indicate any agreement with PPI at all, and that I require this information as evidence. They have deadline of 6th April to reply. Will update all further..... Thanks all Phil

-Sent Prelimletter for overlimit charges -Received bog-off reply -Sent LBA -Received offer of 'full and final' settlement, of difference between £16 and £20 for each charge, including some rubbish about the OFT guidance. -Sent 'Rejection' letter accepting offer but only as 'partial' and on grounds that they understand I will be pursuing for the remainder in court. (Awaiting reply, sent 20th March 2007) Given them deadline of 2nd April to accept my offer. - Sent two reply letters to Data Protection Manager in response to my SAR and CCA requests. They only sent me pack of statements for my SAR request, so have asked them to comply fully with all information requested, given them deadline of 3rd April to conform to request. i.e manaul intervention on account, or letter confirming they have no more information on me. Also complained they did not supply my PPI information on my Credit Agreement request. They have deadline of 6th April to reply (see PPI thread of mine in PPI forum)

HI AC, So do you recommend not accepting thier offer of £32 and requesting replayment in full? Thier letter quotes the OFTs ruling (and exception off EGG) to the £12 charge recommended to credit card companies by them. I dont know if I can, or how I can legally persue repayment in full with this ruling?? Thanks again Phil -

HA! Egg replied with my Credit Agreement. Mentions NOTHING about PPI. I have replied asking where this information is? They have also offered the difference of charges between OFTs £16 and the amount they were charging (£20). This was after a LBA that the offer was made. Only amounts to 8X charges, so total £32. I'm still trying to persue PPI [problem]. PHil -
hello Spinning fish, Be interesting if they cant supply it. I made CCA with EGG Card. They only returned signed agreement with no mention of PPI that was added to the account. Have sent letter today asking for this information that was omitted from the reply to my CCA. Be good to hear how you get on... Keep me posted Phil Turner

Have sent another letter asking the woman who sent me my Credit Agreement, to include the PPI details, as it mentions none. Still awaiting SAR reply. Phil

I am also awaiting return from my SAR. I already had statements which I am using for filing a separate claim regarding unlawful penalty charges.
