  4. Strange tactics from Lloyds (either that or they messed up!) - I used the above letter and heard nothing further from Lloyds/court so I applied for judgment in default on 12 March. I heard nothing else but, having just looked at our account, they have refunded £900.22 which was the full amount of our joint account claim but didn't tell us! As I haven't had a claim go this way can someone confirm if I still need to write to the court to let them know the claim has been settled? Thank you to anyone who has replied/helped in anyway, particulalry GaryH in this case. (Other Lloyds claim for approx £400 waiting for court date) Curli

  6. I have a question that I hope somone can help with. I did two claims (not sure why not but there must have been a good reason at the time!). Acknowledgement of service was filed on 23 January for both claims but I have only recevied a defence and AQ for one (AQ to be filed by 24/2) - does that mean I might win the other by default?   7. I am posting this in the hope someone can tell me where to turn. Three weeks our car sprung a huge water leak, my husband (who is very mechanically minded) had a look and agreed with the garage that a new water pump was required. This was Saturday morning 13 Jan. They said they would get the part Monday and we would have it back Tues eve. To cut a long story shortish at the end of that week after being fobbed off with how long it was taking it turned out they had broken a bolt and were having trouble getting the replacement. It was eventually promoised back to me at the end of last week. Last Friday my husband paid by card over the phone so I could pick it up but then they said the oil pump wasn't working when they put it back together, then they had to get one of those (nothing wrong with it when the car went to them). Then we expected it back on Tuesday and they said a piece was missing and they had to get another. They apparently got that yesterday. I have suspected for the last week that they are not playing straight for some reason so as today I have got a hire car (they refused to get me one I am paying for this) I decided to pay them a visit. At 11.45 I drove round the back of the garage and my husband called them on his mobile and was ssured the car was being worked on - he told them that was rubbish because I could see it and it was just sat out the back. He was told it would be on the ramp by 12.30. At 1.40pm it was still sat out the back and at 1.50pm I was assured by phone that it was being worked on ( iwas home by now), even though I said I was there 10 minutes previously, I was told it had just been put up. I drove down there (only 10 mins away) and it was still sat in the same place. My husband then phoned and was told it would be put on a ramp as soon as one was free. We paid last Friday by card when we expected to get the car, they have not charged for the "extra" work, but it has caused huge stress, cost and inconvenience for the last three weeks - can I report them to any one or is there ANYTHING I can do. If we don't gte it back today I think we have to pay another garage to recover it and fix it. It is a large , independant MOT centre. I am back down there in half an hour to see if they are working on it. Any ideas - anyone? Thank you Sharon
  8. I am now ready to start filing my claim online, ready to complete on monday (cause it's payday!) but I have a question. As I am claiming from two accounts, one for my OH and one joint one, do I have to do two separate claims? Curli
  9. Thanks Bookworm, I've just phoned and asked nicely and after putting me on hold for a couple of seconds they have agreed to reverse the charges as a goodwill gesture! I need a sit down and a stiff drink, then I'm off to the branch tomorrow to close the b***** account! Curli
  10. I successfully claimed against Abbey and this was settled in October. I went into the branch today to close my account and was horrified to find that I was £5.99 overdrawn with £50 of charges to be applied:eek: . Although all my cards, dd, etc were cancelled apparently when I subscribed to Holiday Which (a trial which I immediately cancelled) earlier in the year I didn't set up a DD but it was taken direclty from my card and according to Abbey they can keep doing that as long as the account is open:?. This is outrageous I have no cheque book or card to withfraw from the account but another company can:mad: So although I have to chase Which because I had cancelled the subscription, can I claim the £50 back from Abbey? I am intending to pay it and close the account to avoid further charges, but I think I may try phoning Abbey first to ask for it back nicely. Any thoughts/help much appreciated? Curli
  11. Sorry I can't help you, but I am at the same stage, received statements today and confused about interest. On my statements I have purchase interest, special rate interest, cash withdrawal interest, balance transfer interest and special monthly interest!!! Curli

    I have a couple of questions I hope someone can help with. The letter in the templates library for credit cards is much shorter than the bank version and there is only one giving fourteen days, instead of two letters both giving fourteen days that I used for my bank account - do I only have to give them 14 days or should I adapt the bank letters and give CAP1 28 days? Secondly I have used a simple spreadsheet without interest, but have other people claimed interest successfully? Is it worth trying to get my head around the interest business, because apart from the basic 8% (when it goes to court) I am really unsure how to proceed with this part. Thanks Curli

    I sent it to Head Office. My fault though - I was too lazy to go to the PO and send it recorded so I just put it in the normal post box and now I can't prove when they got it. Last thime I will do that though - I have learnt my lesson! Curli
  15. Thought I would start a thread on here as I am beginning the process of reclaiming my Capital One charges. Sent SAR off on 2 November and as I haven't heard anything I have just phoned them. They confirmed that the letter was received by them on 13th November (stalling tactics?) so are counting their 40 days from then. I guess they will use Christmas post as an excuse as well. Curli
