  1. Hi there. I'm in Guildford tomorrow morning as well. From a quick search of the board, it seems there will be a few of us there in the morning! I'm claiming against two banks in the morning, LTSB for charges and Abbey for wasted costs.
  2. Hi Jenkers, I'm in Guildford tomorrow morning too - at 10:30 as well. I've got two cases that I'm claiming for. Don't worry about it. I've been to court before with previous accounts and it's no big deal - the judges will realise that you are there in person and it's unlikely (almost definitely) that anyone from Nationwide will be there anyway. I may see you there.
  3. Hi ukcrow, It took AGES! It was transferred from Epsom County Court in January this year and took until March before they gave me a date. I think the courts are getting their act together now. They're starting to bulk manage a lot of these cases in bigger courts - Epsom's is only a tiddler.
  4. I fully intend to go along. And thanks for your support! This is my second court visit with LTSB so I know what it's like in front of a judge. The first time I had received a letter from them a few days before but the cheque wasn't received by the court date. I'll check my account this evening (the first one was a closed account) but it's a credit card so would they pay the money into that account or via a cheque?

Abbey have already settled my claim against them but, they left it so late that I incurred all the costs associated with preparing my bundle etc. As such, I've written to the court asking for my costs to be paid. The judge came back and said that if I wanted to apply for costs, I would need to go to the hearing (scheduled for tomorrow in Guildford) and apply in person. Has anyone been through this? What can I expect to happen tomorrow?
  8. I've got my date in court with LTSB tomorrow. I submitted all the paperwork 3 weeks ago and thought I'd phone the court today to make sure that it was still on the schedule. They said they had received a letter from LTSB saying that the case had been settled yet, I've received nothing!!! Obviously I still need to go along to the court but, what should I expect to happen? I know LTSB tend to leave it to the last minute to settle as they did with a previous case of mine but at least I had received something before the court date then.
  9. But the claim will have been completely settled. These additional charges are not included within the original claim and I didn't modify the claim after I received them. I've now submitted my doc bundle - obviously including this new batch of charges. Is it now too late to add them in? Any advice?
  10. I've received a letter from Abbey today saying that they are settling my claim and money will be transferred into my account within the next few days. Unfortunately, I received a few more charges from them last month which haven't made it into this claim. Should I press them for inclusion of this amount in this settlement? I also just sent my docs into the court yesterday - if I'd received this letter a day earlier, it would have saved me a lot of effort!
  11. I've got a date for round 2 with Abbey in a few weeks and I'm just putting together my document bundle at the moment. It's going to be very similar to the contents of my first case against them but I was wondering whether I should include the settlement letter from my first case as additional evidence? Does anyone have any view on this?
  12. I've had an offer from Abbey to settle out of court. It's about 96% of my total claim. However, as I've said above, I've recently been hit by a few more bank charges on my Abbey account. In my settlement discussion with them, do you think it would be wise to put as a condition that these additional charges are included within the settlement? Any quick advice from anyone would be really appreciated.
  13. Ouch, I'm really sorry to hear that. He sounds completely the opposite of most of the other reports I've heard of other judges. Best thing to do is forget about it for a few days - take some time out and most of all, don't make any rash decisions.
  14. It was a great programme and it was great to see the banks squirm! I've been considering whether this could be added to my bundles too. I see no reason why not.

  16. I suppose the way to look at it is that it's only going to cost me £35 in the short term. Presumably, if (when) I'm successful in my claim, it will be Abbey that pay the £35?
  17. I've been hit by some more Abbey charges this month. Should I modify my claim to include this new amount? I've got a directions hearing scheduled for 5th Feb.
  18. I've had a couple of my cases transferred to Guildford from Epsom County Court. Not got a date for the hearing yet but it's very frustrating seeing as Epsom have had the claim for at least 2 months!
  19. Hmm, I just thought I'd phone DLA and see if I could have a copy of their Allocation Questionnaire. They're no longer dealing with my case! The guy I spoke to said that all claims had been transferred to Abbey and were now being dealt with internally.
  20. All my documents submitted to the court now too so everything now in place for the 15th Jan.
  21. I've received a 'NOTICE OF DIRECTIONS OF HEARING' form in the post from the court re: my claim against Abbey for the 5th Feb! It says that 20 minutes have been allocated for this. Any idea what I can expect in this?
  22. If I was you, I'd write to the court explaining that you cannot possibly provide them with this information by this deadline without co-operation from the Defendant. Also send the court a copy of the letters you've sent to Charles Bacon. It may be worthwhile ringing Nationwide too - just to see if they have sent anything.
  23. It may be worth sending a copy of the letter to the court as well.
  24. Sounds like a fine letter to me Bev. No reason why you can't claim interest either. You don't need your account to be open in order to continue with an interest claim.
