I have recently been offered a 65% settlement figure (2174, instead of 3346 I am claiming), what is the general opinion regarding the test case? I have been advised by Chelmsford Court that all claims are stayed and could take up to 18months-2yrs to complete and we are not guaranteed to win anyway. If I hold off and continue does anyone else have anymore info as to what the outcome might be and as I am already at Court stage is this likely to be quicker? According to my court there are not AQ's being sent out now either. I am very tempted to accept their offer but as it is still £1200 short of the total it is a difficult decision to make. Also can the bank withdraw this offer now because of the ruling last week?????

My total claim is for 3345 (without interest 2600) and they have offered 2174, but in the defence form sent to the court they state a denial of my entitlement to claim my interest in sum of 564, but have included this amount in the total and therefore in the 65% offer. If I don't accept and ignore their letter will the court date issued go ahead? Sorry if I sound vague, but my legal experience is very limited, and I started this process before I realised you could involve solicitors etc...

Having processed a court claim and receiving a court date, I have since received a letter from my bank offering me 65% of my total claim, obviously stating this would be a full and final settlement and is conditional to being a gesture of goodwill and without any admission of liability on their part. If I accept, can I still proceed with the court claim? and if I don't is there a chance I will get nothing? I am quite tempted to accept, but still believe I might be able to get more.....

Can someone tell me what I need to do now please. Last week I sent off my court forms, fee and 8% breakdown of the charges. Then on Saturday I received a letter from Abbey saying they 'as a goodwill gesture' would be paying a sum of money into my account within the next 10 working days (amount was quite offensive to be honest), this money has been put into my account without waiting to see if I will accept or not. Now I have court forms being processed and the amounts are now incorrect, should I phone the court and withdraw and re-submit, or leave to go through the process and update amount at a later date????? Can I still go for the full amount I have claimed, including the 8% or does this payment into my account affect this as well? I AM SO CONFUSED !!!! Thanks, hope someone can help me
