Just had exactly the same yesterday. I'm sending an S.A.R. today, they make out they are hiding your details lol. RUBBISH
-
Morning Silverfox. Thanks, i got an S.A.R. going to Halifax so ill wizz One off to Crap1 as well. The S.A.R. should have the 'original signed agreement' in it should it not? cant wait for this lol

Hi steSE, its a horrid no win situation, i have Lowells, and my missus has Lowells and Unreliable collections, robbers way, all for one catalogue with illegal insurance on it, and a NPOWER account that never existed and a British Gas that was paid. All in all if i pay them, the DCAs win and im out of pocket, if i dont theres Defaults galore at the CRA. What you have to remember, is that Lowells probably defaulted you before they even contacted you, so unless you look at your Credit File every day, you wouldn't have known anyway till it was there, so you may as well battle them till the end, then force them to remove it

Hi Silverfox, Thanks. Well i had my 'credit agreement' from Crap 1, i have no scanner at the moment, but i will try and sort something to post them. What they sent is a double sided letter. On the front its just a bog standard letter, saying my acc no and credit limit, then says see over for agreement, then on next line says we have omitted your details for safety reasons. I know i never signed a credit agreement, it was just an App form. The letter has no interest rates, no signature details, and then just says my card is overlimit by £82 which is all charges. Another letter just answers my queries on the phone calls, all the usual guff. What follow up letter should i use from the templates, as i know they dont have a signed agreement, im thinking of claiming all the charges back, so they will outweigh the original balance outstanding

I hope you give them what for lol. I have an account with lowlifes now, iv'e got the bemused letter waiting to go. Puzzled me as i know they are thick as sh*t but 6 months ago, i received a letter from Bowels, asking for £429, as i did not know any better, i rang, asked what it was for, and they said a loan at a property i lived at....................................... in 1996. I said 2 things to him. STATUTE BARRED. I said it wasn't recognised anyway (genuinely) the flat i lived was for 2 months in that year, so i said, 'how can you expect to collect that' got a letter 3 days later saying as a goodwill gesture (whatever) they will not pursue it. Seems to me they are as dim as a candle with a wick that wont burn, they seem to only like confrontation .......... brilliantly Logic. Gimps -
Hi Hillards, is it possible you can let me have the Exec Office contact Details by PM? i'm having issues with a bill, a lot more than it should be and i want to sort it as it shows on my credit file. I had bought myself out of my contract, agreed to pay the buy out fee, but when it came, it was for 2 months more than it should have been. They have gave the accoun t to DLC without answering any of my questions. Id appreciate it if i could get them. Thanks. Neil

Claire, i sympathise with you..... I joined Orange in July 2007, by Sept i'd had 5 identical phones which none worked properly. As thye did not have like for likes, they had to give me a new mobile altogether. They to upgraded without my knowledge, but my saving grace in a way, is that they have conflicted reports as to why i was upgraded, one says cos i got a new phone, the others say its cos i got their free home broadband. I am sending an SAR so i can see the notes, i suggest it may be wise for you to do the same, see if you can find any discrepencies

Not in my experience no. I got a bill for £952 with £395 this years bill, the rest in so called unpaid arrears dating from 2002 to present. When i requested an SAR they just sent a statement with the amounts supposedly showing outstanding from each year, surprisingly, this did not show the payments made. I told them its wrong and im not paying till they separate the two amounts, this years and the unpaid arrears which supposedly exist. I said i'd contest the arrears and pay my recent bill, they gave me a £40 pay plan a month which i said yes, paid 1 instalment, they took it off the disputed arrears, so i told them if they dont sepapate the 2 amounts, i will on 1st April dispute the whole lot when 09/10 bill comes out. They have not been in touch, so it looks like war. -
mum vs littlewoods direct and marshall wards

In truth, Lowells dont know what they are doing. I have a thread here, because of Littlewoods, Lowells have bought a disputed account. I CCAd them, which is up today, No NOA, just a letter from Lowell Portfolio1, Stating Lowell Farcial are the collectors. Sit tight Lisa, me thinks your debt wont be far away from being binned. -

Hassle from Lowells disputed debt from Littlewoods Catalogue
nish40 replied to nish40's topic in Mail order catalogues
Got a Reply for my CCA request from Lowells. The last day is today to receive it (12+2 days), and when i got home last night from work i had a letter from Lowell Portfolio stating a reference number, and saying the account had been sold to Lowells, And that Lowell Farcial were the authorised collectors. No CCA, and i guess this letter is my NOA. Thing is as explained in my original post, this account was disputed with the OC which was Littlewoods Direct, as they had been adding product insurance without our prior Knowledge, for 8 months (the missuses account) she hid statements. I have letters acknowledging the complaint from Littlewoods, but then they sell it. I am getting a copy of her credit file as i do know someone has added adverse data, but im not sure who. Can anyone suggest the best way to go with this please, any letters i should send? thanks. Neil -

Incidentally, can anyone advise on something? TFC keep levying charges and adverse credit on me, with this being disputed for well over a year, are they allowed to do that, and if not what can i do about it. Stephensons Barristers are putting the final touches to The Court case, to which im really looking forward to, but i think they are too far into the paperwork for me to see if i can get squoze in, i dont want to upset the applecart. Does anyone think i have a case to take separate action against them for carrying on chasing for money, pestering me and putting adverse comments in with the CRAs? -
Thanks PGH. You giving me lots of ideas to throw at Robbers way and Bowells when they contact me back. Brilliant, im laughing my aris off at some of this
-
Ok will do, thanks

These parasites are not allowed to call at your home unless you make an appointment for them to. Write to them and make them aware you DO NOT give your permission for them to call at your house. I myself have been emailing them, then printing the email off and stapling it to their correspondence when i receive it. Its worked so far, maybe that might help keep costs down for you a bit

I would send the letter 42man has posted, amended to suit. Record deliver it, then chill and wait for the responses. How is your Aqua one going?
