  1. Hi there, Hope someone here can give me some advice. In late 2003 and early 2004 I got deeply in debt, ultimately leading to my eviction from rented accomodation in the april of 2004. I had quite a lot of debt at that time which I had tried to bury my head in the sand about. Being chucked out of my house meant I had to confront things and look for help - luckily my parents were able to come to agreements with the majority of my debtors and pay them off, while others I came to agreements with and paid off over the following years. In mid 2007 I was at the point where I had paid off nearly all my debt, with only a student loan to go which was cleared at the beginning of this year. I was beginning to look at rebuilding my credit history with the aim of getting a joint mortgage. Two of the original debts were to Egg, who had handed them on to Moorcroft. At the time these were paid off by my parents, or so I believed. It turns out that inadvertantly only one of these debts was paid off by my parents as the similar paperwork confused me into thinking they were one and the same. Despite having had the contact details of my parents address from the letter paying off the one debt, which they accepted, and my new address being available from credit reference agencies soon after eviction, Moorcroft totally failed to contact me. Then I get a letter from an agency last year saying that they had tracked me down and were going to come and get the money. I paid the full debt within a few days of receiving this notification. I am now challenging the CCJ in court, to have it set aside, for the following reasons: - I received no summons - I was unable to attend court due to the above - I was not living at the address the summons was sent to - I did not receive 28 days to pay All of the above is based on the failure of the credit reference agencies to track me down through information they could have easily gotten hold of in my opinion. And this CCJ could seriously affect my chance of getting that joint mortgage. I now have a court date and have been asked to present a statement of defence - can I do this myself? Do I need a solicitor to prepare this/attend court?
