  1. Hi Andrew1, You're down to one member now, your fans have probably slopped off for some fireworks... Am having a go at Citi and have just recently been contacted by our friends at Cabot, (Joe must be wondering why he cannot get through anymore, good old truecall), so will be following with interest. Have an outstanding claim against Citi, possibly they'll want to pay Cabot if I win, so like you am looking for ways to combat the barstewards, (no offence to legitimate Bar Staff).   3. Hi, Understand, at the end of the day you're calling the shots, but, if you are in a similar situation to me you could be looking at quite a few quid to start the new year with. It will not affect your current cliam, I also have a claim with a FOS adjudicator which was running at the same time as the other claim. If you like I can email the details I sent to the FOS.   4. Hi Satterthwaite, Just had a chat with the FOS yesterday re. my claim for PPI refund from Egg. Egg initially argued with the FOS that as my PPI started in 1999, that the FOS could not rule on it. FOS disagreed with Egg and my case has been passed to an adjudicator. So, the point of all this? Egg may only like to go back 6 years but a, there is no time limit of claims for PPI, and b, a precident has now been set that Egg have to go back to at least 1999. Which would cover a lot of claims I think. Regards, Bosun.

Hi Shadow, I take your point, but from what I've been reading on here and from personal experience, I know that they are not above changing dates, putting false information on file, etc. If all has gone quite with an account then your observation could be valid, however mine is recent and as I normaly only use one of the above agencies I want to know what has been recorded by the other two. I'm glad you made the above point, it gives people another perspective and they can then make an informed choice depending on their circumstances. Many thanks, Bosun.

Hi, As there seems to be a few ‘oddities’ going on with Citi/Cabot, and who knows which other Banks/Debit Chasers, maybe it’s time people started having a look at their credit file to make sure everything is aboveboard. I’ve taken the liberty of copying a letter I’ve sent to the CRAs and maybe someone may like to use it as a template. Just replace the italics with your details At the bottom of this post is a couple of explanitory notes plus the addresses, ‘phone numbers and website adresses of the three CRAs I’ve written to. Template Letter (Your Address) (Address of CRA) Date (Date sent) Our Ref (I just like to put a ref in hoping that the CRA will use it then I can as an audit trail) Dear Sir/Madam, Please send me the information which I am entitled to under section 7(1) of the Data Protection Act 1998, including information under section 7(1)(d)". Please find below details, as advised by the Information Commissioners Office, which I believe will sufficiently allow you to identify me from your records. If you need further information from me, please advise me as soon as possible. If you do not normally handle these requests for your organisation, please pass this letter to your Data Protection Officer or another appropriate official. Identification Data: - · Full name; (Your Name). · Previous Names; (any previous names you’ve been know by, maiden name for example) · Full address; (full address including Post Code) · Other addresses; (Other addresses that you have lived at for the last six years – If you have not lived anywhere else use – “I have not lived at any other address in the last six years” · Date of birth; (Date of Birth) Please find enclosed a cheque for the amount of £2.00 as advised by the Information Commissioners Office. Yours Faithfully, (Signature) (Print Name). Notes Some decisions are made by an automatic process (for example, one made by a computer system). You should keep a copy of your letter and you may want to send it by recorded delivery. Unless the agency needs more information, they have seven working days from receiving your letter to provide you with a copy of your file. Sometimes the credit reference agencies do need more information from you before they can send you your file. For example, they may need proof of your name and address from a utility bill or bank statement. It is important to make sure that no one else gets your file by mistake or to check that no one else has fraudulently applied for your credit reference file. The agencies do not have to send you your file until they get this information. Call Credit allow you to view your details on-line for the same £2.00, but you could probably waste over £2.00 of electricity waiting for their website to process the request – I gave up after half an hour and I have very good broadband speed.   9. Hi Sunboy, May not be much help but, not knowing your full situation, I would try to come to some sort of agreement with Egg in the short term. Tell them what you can afford and start paying that no matter how hard they holler because if push comes to shove later on, i.e. court, you can point out that rather that ignore the debit, you have been making an effort to pay it off. Next thing is did you pay any PPI which may be reclaimable? Another is, were you one of those people that were terminated a while back. I was, they increased the interest rates just prior to the termination, I complained to the FOS and got my money back - and a reduction in the interest rate. Finally, look around this site. There are a lot of people on here with different sorts of problems with the banks and a lot of different solutions. Regards, Bosun.

  12. Hi Rowan, How are things going? Had a post by CitizenB the other day, part of which read: - The reason the debt is assigned is immaterial. For instance, books of loans may be sold on to be collected as an asset rather than as a discounted debt. In some instances, the debt collector may have purchased a debt but not have the relevant agreement. Whilst, in general, ‘liabilities’ cannot be assigned there must be a question mark over whether ‘duties’ are the same. This is important since there is a rule, expressed in Tito v Waddell (No 2) [1977] Ch 106 at 289 to 302, that where a benefit is conditional upon some burden, the assignee must also take the burden. An example is where the contractor has the right to mine on condition that they pay compensation to those disrupted by the mining. If they assign their right to mine, the assignee takes this right subject to the duty to pay compensation. Therefore, there is a strong argument that under the Act, the right to payment is never absolute. It is always subject to duties (many of which are imposed under the Act). For instance, the right to enforce the credit agreement at all is subject to the duty to comply with section 77 or 78. This duty is not a ‘liability’ as such under the credit agreement but is a condition of the right to repayment. May 2008 Susan Edwards Head of Credit Investigations and Enforcement, Office of Fair Trading Now I know this is to do with Debt Collectors and s77 & 78, etc, but I would also assume that it could quite reasonably apply to any company that bought/took over/was assigned an account to which was attached a benefit and that it was not unreasonable for it to be obligated to any liabilities. I am awaiting, with baited breath 8-), for my reply from the FOS to which I will reply with the above, and also copy the OFT, if they reject my claim. Regards, Bosun.

  14. Hi Guys, May be of interest, no CAA from citi and outstanding PPI claim, so stopped paying last year. Cabot now on the case so have Section 78'd them. Now new entry on my credit file New Information KINGS HILL (NO.1) LTD/M&SFS (I) Credit Card I know who it is but why the use of different names? Want to raise that as an issue with the CRA's but apparently I need to request one of their reports first so letters have been written. Regards, Bosun.

Did a company search and the first run produced a different company name but the company seems to have changed it's name twice on the same day - don't understand this but it does show they have, or have had the same address as Cabots.   20. Hi Shadow, Different problem I'm afraid, the CLIs OK it's just that the 'phone does not ring at all with the truecall attached. Did get in touch with them but they were unable to help. Haven't needed the machine since Citi stopped calling at the beginning of the year so looks like I'm having to buy another 'phone - but which one. Truecall have yet to provide a definitive list of those that do/do not work. Anyway not too bothered at the moment. As my wife put in an email to me this morning 'as I write, 'you know who' has just phoned, have logged it. Aren’t they nice people ringing every day to see if we’re OK.' Regards, Bosun.
  21. Rowan, Two things, was your card originally with Citi or with Peoples Bank? The second is that the FOS have just come to an agreement with Citi over PPI payments taken out prior to 2001 so I would call the FOS, give them your reference no. and find out if anything has changed. What they have agreed I don't know but could be worth asking about. The reason I ask about Peoples Bank is that Citi bought a lot of accounts that started in 1998/99 and Peoples Bank was at the time regulated by the FOS. Regards, Bosun.

Hi Enron, Noticed on here that a lot of Citi 'customers' have had their 'custom' transferred to Cabot during September... wonder if this has anything to do with the discussions going on at the moment? Will ring the FOS in the morning and find out their thoughts on this. If Citi are prempting any problems by passing the buck to Cabot, and this could be shown as probable, what would you suggest. Mind you, I would love to be around if the FOS did turn around to Cabot and say - oh by the way, you have just bought the obligations associated with the alleged debts as well. Regards Bosun.

I have received the same as you after Citi refused to sed me a copy of the CCA as requested, even after telling the FOS they had! Consiquently I've been contacted by Cabot and have replied with the following. ' As I have not received any Notice of Assignment of any alleged debt I will forthwith, ignore any attempt by you, or anyone alleging to act on behalf of your company, to communicate with me. In addition, with reference to the above alleged account that you claim to own, I would be grateful for a signed copy of my Credit Card Agreement. Under the Consumer Credit Act 1974 (Sections 77-79), I am entitled to receive a copy of this agreement upon request. I enclose a Postal Order payment of £1.00 which represents the fee payable under the said Act. I understand that a copy of my Credit Card Agreement should be supplied within 12 working days. I look forward to hearing from you. ' Hopefully you have a telephone with calling number display or a truecall device. They always call on a number starting with 01732. Unfortunately our truecall device does not work with our new telephone , (otherwise we would block them), so we just look at the caller no. If it starts with 01732, we ignore it. The advice from people far better qualified than me on here is that if they don't have the CCA, they cannot do much about it but try to give you grief - don't let it get to you.
