  3. Hi, Update, well after a long battle, MBNA finally coughed up to both claims for PPI refund but only repaid the actual premiums of £2000 & £700. Sent a letter off to them pointing out that I should be entitled to the interest paid on the PPI amounts, they wrote back stating that what we had received was all we were entitled to. Sent off a complaint to the FOS who wrote back saying that MBNA had made the same statement to them and they were unsure if they could do anything. Unfortunately I was taken quite ill and over the last 2 years have had 3 operations for colonic cancer so not a lot was done. Now feeling a lot better I decided to have another go at MBNA so after a LBA started to claims through MCOL for approximately £10,000 & £3,000 in respect of the miss-sold PPI. As expected, MBNA are defending the claims but have also offered £5,500 and £350 as a 'good will' gesture. What I would appreciate, if possible, would be to hear from anyone who has had similar experience with MCOL and also what is the likely reaction of the judge would be if I refused MBNAs offer and went ahead with our claims. In reality, these banks have been ripping people off for years, just look at the posts on this site, and hate the thought of them getting away with anything.   4. Hi jacchris, Just came accross this thread, my wife also was charged for PPI from before 1999 but as she retired in 1996 it was as much use as an ashtray on a motorbike. Anyway, I only realised in 2009, (yep I know), and have since complained to Shop Direct, who replied with the usual ' not my problem' and latterly to the FOS. As Shop Direct were not part of the Dispute Resolution Service until November 2004 and the policy was 'sold' before that, the FOS's hands are a bit tied but they are able to chase the Insurance provider which is, in this case and likely to be in yours, Aviva. We have just received two questionaires from Aviva, one of theirs and another one which is the FOS's original. Was just going to complete the one but find it easier to do both and copy the FOS.   6. Hi Smoothound, Is it possible that the they have reduced the outstanding balance on your account to zero and forwarded to you what was left over? Have a look at what you estimated what was due, remove what the balance remaining on your account then add what you received. Some estimates are a bit high, ppi + interest + compond + simple, so be realistic. Regards...

Hi, My situation was slightly different in that I still had an outstanding balance so they they just reduced it but, if I were in your shoes I would get a letter thanking them for the 'part payment' but pointing out that you do not believe that they have refunded all of the refund to which you are entitled and bank the cheque. In your letter, give them a period of time in which you expect to receive a response, 28 days is not unreasonable, before you take the matter further. Hopefully, you will receive a 'Final Response'. If you do or not does not matter, you have given them a chance to rectify the situation that you can provide as proof of your, not unreasonable, attempt to resolve the situation. I have had a situation in the past where I've received a payment for work done but had been under paid. When I pointed this out the company disagreed, we ended up in court and the court decided in my favour. The point of this is that when I received the original payment, I banked the cheque, then started the process of recovering the outstanding balance. In court, the fact that I had banked any money at all from the company was never mentioned. Bosun.

Hi Smoothound, See post 121 above, unfortunately had to have a couple of operations since that was posted so have not got around to starting court proceedings yet, but my situation is the same as yours. Initially went the FOS route but all I got was some dozy bug(person)ger on the other end of the 'phone saying, 'well MBNA believe they have refunded you the PPI plus interest' for over a year. This was in spite of my copying all the statements and providing a speradsheet to show they could not have. Court is the only route left I feel. As dx said, get the calcs from the FOS site and use those to calculate what you should be getting. Doubt if the court would argue against what the FOS say should be used. Bets of luck. Bosun.

  11. Hi, MBNA have not bothered to respond to my Letter before Action, which was sent recorded fortunately. This was sent over 28 days ago so they have had enough time to respond but why they haven't I don't know. Next stop is the N1 form into our local courts for my cliam, and claimonline for my other halves. Smoothound, sorry to highjack your thread. Will start another of my own detailing the steps I'm taking in the hope that it will be of some assistance to others. Regards, Bosun.
  12. Ditto here Citybloke, The one with Egg, which included principle, compound, simple at 8% plus £250 for the inconvenience they had caused got £7,500 knocked off my balance. We're going a bit harder with MBNA claiming 8% on top due to the fact that they had use of our money due to their 'mistake'. They were charging us 19 & 16% respectively so 8% seems a fair amount. And, if the court wishes to add a bit extra, who are we to go against the Courts of this fair land? Regards, Bosun.
  13. Hi Smoothound, This happened to both myself and my wife so does not seem out of the ordinary for them. For us they sent a third letter asking for proof of our employment status, which we sent, and within a couple of weeks got a refund. They only refunded the principle though so we complained to the FOS. This complaint had been with FOS for over a year so we're now taking the court route. In your case I don't think the FOS will accept a complaint untill you get a letter from MBNA saying it's their final decision though. Regards, Bosun.

Hi Mikeekky, Seems a strange state of affairs, found the following on the internet: - 'Broadly, the IMD covers all natural and legal persons who for remuneration purposes carry out an insurance mediation activity, including providing financial advice and introducing a client to another firm to receive financial advice. The directive requires that these professionals be registered with their Home State regulator (the country in which they are resident) in order to operate a legal business. There is an exemption for professionals whose principle activity is not insurance mediation, e.g. lawyers and accountants.' Cannot see the point of trying to sell someone PPI if they are paying in cash. Personally, apart from breakdown insurance, (not trying to tempt fate here), don't see the point of anything else, though no doubt someone on here may have a different view. Regards, Bosun.

Under normal circumstances I would not do this but couldn't think of any other way of getting the info to you. Didn't start a thread, had one going about an intrest rate hike after termination but did not have a comment for about a year so thought, why bother, and went my own way. http://www.consumeractiongroup.co.uk/forum/showthread.php?235513-Terminated-Agreement-amp-Interest-Rate-Hike What I got from Egg was a refund of all PPI, plus associated interest, (their words), + 8% + £200 for distress. So they do charge interest on PPI ! PPI came to about £1500, ended up getting £7000. Know what you mean, living a life has a tendancy to get in the way of looking at the detail of what is actually happening with regards to credit cards, loans, etc. Will be starting a thread shortly about MBNA. Had about £2000 in PPI, complained and they coffed up £1900. Went to the FOS but poor souls they are under so much pressure lately that they accepted MBNA's statement that they had paid me interest as well. So off to court seeking about £9000 and although it's with MBNA it may throw up something that you & M&M could use. Regards, Bosun.
