  9. I've just checked their website which states:- "If you make your initial payment by cheque before 2pm it will be received at our processing centre the next working day. Later payments will be received at our processing centre the following working day. You can draw against it on the sixth Working day after it reaches our processing centre. You will start earning interest on the cheque from the second Working day after it arrives at our processing centre." The 21st July was a Wednesday so your cheque (if paid in before 2pm) would have been received at the processing centre on the Thursday. This would mean that the cheque would not have cleared until the following Friday(30th). If you paid it in after 2pm, it will not be cleared until Monday. enamae

  18. I think you'll find that this is covered by Section 9 of The lending Code deals with Financial difficulties. Page 23 deals with the procedure for the recovery of debts; Debt recovery procedures 162. If the customer does not co-operate with the subscriber, a plan cannot be developed and the subscriber may proceed with normal debt recovery procedures. Lack of co-operation would include not responding to the subscriber’s attempts at contact and unreasonable demands by the customer (for example, a request that the debt be written off or repaid over a very long period, even though the customer could afford to make reasonable repayments). 163. The subscriber should take into consideration any other accounts that the customer may have with the subscriber if these have a credit balance. In addition, if a customer has assets which could reasonably be expected to be sold to reduce outstanding debts, the subscriber may request that the customer, and if appropriate, their adviser, considers this option. Thereafter, the subscriber should acknowledge that income should only be used to repay ‘non-priority’ debts once provision has been made for any ‘priority’ debts. The subscriber should leave the customer with sufficient money for reasonable day-to-day expenses, taking into account individual circumstances. Subscribers will not subject customers to harassment or undue pressure when discussing their problems. 164.   19. Why does the OP have to request another CCA? Is it because the one received this morning was blank, it was received as a result of her phone call yesterday or to see if they actually have a signed copy? Ashley was there a covering letter with the CCA ? enamae
  20. This is what happens when you reclaim charges. They either refund the charges to you, and you then repay any overdrawn amount or they reduce what you owe by the amount of the charges and forward the remainder (if any) to you. You can not expect them to refund the charges and reduce the debt. enamae

  23. janindebt's other thread (link in my post above) stated that she had not received a claim form and as she was unable to defend the claim in court, she should be able to have the judgement set aside. enamae
