  1. Hi. First I must tell you that it took me nearly 3 months to get it sorted out. I kept being told the bank would not refund the charges until the outcome of the OFT case. I sent Natwest a preliminary letter from the templates library asking for the money back & then a LBA 14 days later. I quoted the Social Security Administration Act 1992 Section 187 187.—(1) Subject to the provision of this Act, every assignment of or charge on– (a) benefit as defined in section 122 of the Contributions and Benefits Act; [3(aa) a jobseeker’s allowance;] (b) any income-related benefit; or © child benefit, and every agreement to assign or charge such benefit shall be void; Anyway it worked for me, but Natwest said they refunded my money because the amounts I had gone overdrawn were small i.e the most was £10. You could also send them a Right of Appropriation letter in the Bank Templates Library. It will stop them taking your benefit money. Good luck with it all.
  2. Thanks to all of you for your advice & especially to Screw the Bailiff as I know you are helping me & your advice is very welcome.
  3. Thanks for the advice. The easiest way for us to sort it out would be if the council would do an attachment of earnings order but they say they don't do them.
  4. Just wanted to let those know that gave me their advice, that Natwest have refunded all the charges they made against my account - yippee! The template letters were very handy. Thanks to all.
  5. I was wondering if any one else has had any dealings with bailliffs called Ross & Roberts? We signed a walking possession a while back. We had to agree to pay £150 a month. Over Xmas we missed a payment. The bailliffs came back 3 weeks ago & told us that we had to pay them £150 there & then or they would take our belongings, so we paid them, but we went overdrawn at the bank & ended up in trouble with that. The bailliffs said they want £200 a month from now on as they & the council we owe the council tax to will NOT except any payment lower than that. We have three children & can't cope with the amount of money they want each month. Can anyone please give me some advice?
  6. Hi, Vortex. Thanks for the advice, I'm going to open an account elsewhere for my benefits to go into. I recieved a letter from Natwest today, saying they are going to issue me with Default/Termination notices for the total amount plus interest & charges. They are saying that Recovery agents will be instructed to collect my bank cards & I will be charged £125 because of them doing it. Any more advice please?
  7. Hi, thanks to all of you!!!
  8. I have been charged £131.37 in bank charges. Natwest are now saying they are going to issue me with formal regulatory notices. I have tried to talk to them about the charges but they say the charges will stay until the outcome of the test case, & in the meantime they want my account charges paid in full. I am on disability benefit, & my child tax credit etc goes into my account. I'm worried sick. I have told them about the Act which states they cannot take my benefits to pay the charges but Natwest are ignoring me about it. Can someone please help?
