  1. Hi, We live on a narrow street with a factory nearby and one side of the road has double yellows painted on it (the side we live on). They were put in place so that lorries could get to the factory as far as I understand. However, since moving there in November 07, we have never known a traffic warden come along and not known of anyone getting a ticket for parking on the yellows. Parking on the street is ridiculous, very limited and tight (one guy has 6 cars!). On the day in question, my husband had managed to squeeze the car into a spot outside our house. There is a section of the road without yellows which is usually full, but on this occasion it was coned off for roadworks so spaces were even more limited. He received a ticket at approx 4pm when he was sleeping. What are the chances of the Council not following this up when they realise that the car owner lives on the street? Also, what would our chances of challenging this fine be?? We're loathe to pay a fine for parking outside our own home! Is it really reasonable to expect someone to trawl the streets looking for a parking space and then to leave their car away from their sight? Hope someone can help, Thanks!
  2. Thanks for your comment, I also feel that this would cause a problem. Just an update on the situation - I managed to track down the person who has actually bought the house to confirm that this was the case. The landlord had rang him in a panic to say that we would be going round to collect the washing machine and told the house owner that he would pay him for it! He is making out that the washing machine was his. But we have also caught him out with something else - he owes us money for an almost new tumble dryer that we left behind... he has told the house holder that we took the tumble dryer with us - so what happened to it? I think he has taken it for himself so I am now going to file a Police report for theft (we still have proof of purchase for all items!). DO NOT make the same mistake as we did - no matter how long you've known someone, they can still screw you over. Back up everything with contracts and signed agreements!
  3. In July 06, my husband and I moved into a house owned by a family friend (friends for 20+ years). As such, we didn't really bother too much with tenancy agreements etc. We always paid the rent on time and in full and looked after the property as if it were our own. We never bothered the landlord with maintenance problems, even spending our own money on improving the property. We moved out in January after giving a months notice, the landlord then decided to sell the property. We came to a verbal agreement with him that we would leave the washing machine, tumble drier, 3 sets of curtains, all net curtains and 6 curtain poles/rails in the property, and when he sold it, he would pay us £350 towards the cost. He then advertised the property as having these items included (which we know as we helped him fill in the estate agent/lawyer documents detailing the house content) and went on to sell the property privately. We have come to ask him now for the £350 and he is stating that he won't pay us! He says we can go to the house to remove the items as he doesn't want them any more! Surely if he has sold the house with these items included he cannot do this?? Can anyone provide any advice on where to go? I know that small claims court is an option, but with only 'gentlemen's agreements' to go on, would it be worth it? Any advise you can provide would be welcomed. Thanks!

Hi all, Well, it was too good to be true, we received another letter from Parking Eye stating amongst other jargon, that it was our responsibilty to prove who was driving the car and saying that if they do not hear from us within 7 days, further action will be taken. Am I right in thinking that if we ignore this letter, they will go away?? Also, is it true that if bailiffs are sent that they should go away if we tell them the matter is in dispute? I'm trying to keep my nerve but its proving difficult! Need a pep-talk! Thanks Az
  5. Hi all, Just to keep you updated - its been two weeks since I sent my letter and we've not heard anything yet. I don't want to tempt fate but I will be seriously shocked if the letter worked at the first attempt! Is it normal for them to take so long to reply? We are actually almost 4 weeks passed the 7 day deadline for response too - is this a good sign? Keep your fingers crossed!! Az

I have drafted the below letter using a combination of comments from this site and would be grateful for any comments on its content - is it satisfactory? Do I need to put the bit in about using "offence"? "I refer to your letter dated 21 January 2008. Any alleged contract that exists will be with the driver of the vehicle on the day. Please take the matter up with them. I would also like to point out that on the document I have been sent, you use the word ‘offence’, which in itself is a criminal offence according to the Administration of Justice Act 1970. Please do not contact me again unless it is to advise me that you will not be contacting me, as the registered keeper, again and that the matter is now closed. " Thanks again for your help.
  9. Dear all, Being a new user to the site, I just wanted to say a big THANK YOU for putting my mind at rest about these parking bullies! My husband got a Parking Charge Reminer from ParkingEye and being a born worrier, I was getting very stressed about it as he was refusing to pay on principle . Since reading through this thread, I now feel well-armed to respond to ParkingEye advising them that the contract is with the driver and not the RK. I'm keeping my fingers crossed that this will be sufficient - wish me luck! By the way, I haven't seen ParkingEye mentioned much on this thread - am I right in assuming that I deal with them in the same way as the others?? I'd be grateful for any comments you could provide!
