  1. Hi, Have gone onto Self controled DMP. sent CCA request to Moorcroft to confirm They have the right to the debt. Have also sent the notification that I'm having financial difficulties and have sent my I&E sheet along with list of creditors and how much each is going to get. I then get a letter from moorcroft this morning informing me that I have defaulted etc. The outstanding figure has been reduced by the prorata payment that I sent them. Now my question Is. As a debt collection Agency is it correct to send them a CCA request using the usual rules of 12+2 and 30 days guidelines. or, because this debt is as a result of a mobile contract that had finished, but hadn't been fully paid, and passed to a DCA. Only a miniscule amount but it may as well be a big amount due to the other outgoings. I'm paying more than the minimum required by law, but I assume this is not enough for them. Input on this matter appreciated. Sharpman

  3. My daughter has now had a phone call saying they're closing the account because she can't provide the requested documents. Guess she'll have to get a proper friendly account elsewhere.
  4. So, what you're saying is that ACE could well imply that this is a copy of the agreement in force at the time. But how could they prove that it was in fact a copy without a signature. Even a photocopy of the original CCA would have gone a lot further to prove the agreement exists. where as this one could have been any tom dick or harry's with an address added on (not by my OH hand).   5. A starter for 10 ...... Sent off CCA request to ACE on 28th Jan 2008. signed for 29th Jan. Recieved a 'Sample Credit Agreement' from ACE customer Liason Advisor Directors Office Dated 4th feb 2008. This is the 'Sample' Sent to me. This is The letter that was sent with the 'Sample' Could someone have a peek at the 'Sample' just to confirm my suspicions of invalidity. as can clearly be seen there is a distinct lack of signature on the sheet. The address details were filled in by some numpty at ACE. OH swears she never filled in something like this. Thanks in advance Sharpman.
  6. Hi Peeps Sent a CCA request to HFC on 28Jan 2008, Signed for 29th Jan 2008. Recieved today (05 Feb) a photocopy of loan agreement, no terms and conditions. Along with a print out of the account and a settlment figure sheet. My question is this. Does the CCA have to be the original because this looks like a photcopy of a faxed sheet. (at the bottom of the sheet is a line saying 'HFC Bank copy page 1 of ? (can't make out the other number as its blocked out by photo copy line) Information on the CCA is refering to conditions overleaf, But there is no overleaf as they have not provided it. Also do they have to provide t&c as was in force at the time of the cca. Thanks
  7. Hi, Something to make you laugh. My daughter, who has just turned 16 decided to open a bank account with HSBC (much against my advice, but thats daughters for you). She went down to the local branch, filled out the necesary paper work. provided her passport. (although this had expired) The clerk said that this was not a problem as he/she could definatley identify that this was infact her. A week or so later she had all her details from the bank. Account no, paying in book etc. shortly after she recieved her solo card. All was looking good. she had her wages directed to her account etc. was able to draw money out and put money in, no problems............ Then out of the blue she recieves a letter from HSBC quoting Money laundering regulations etc. Could she supply the following pieces of identification. Driving Licence National ID Card Passport (valid) HM Revenue & customs (HMRC) Tax Notification ie. PAYE Notice HMRC Notification of working family tax credit HMRC Notification of Child tax Credit HMRC Notification of Disable persons tax credit HMRC Tax calculation Construction Industry Registration card CIS 4(p), CIS 4(p), CIS 5 and CIS 6 Benefits agency letter, Original Notification letter. Now, although Her passport was a little out of date I would have thought that the passport would have been more proof as to identification than any of the HMRC documents as they don't realy prove that they refer to the person who has them in their hand. apart from her age and not having access to any of the above documents apart from her passport HSBC aren't budging. I have to take time off work to go down to the branch with her to tell some one there who she is. These regulations are all well and good. Now here is the funny part...... Short while back I started to recieve mail from HSBC with another persons name on it. This was their bank stements, paying in book etc. The account had been active for a good 10 months. I was even getting notification of cards and pin nos being sent to the branch. Now if I was dishonest I could have taken these statements etc down to the bank to pick up my card and pin. So, Somebody who is not even a citizen of this country (maybe I'm being sterotypical, name said it all) can open up a bank account using my address and carry on using that account and my daughter, who is a british citizen and has been all her life can't open an account. where's the logic in that. :x
  8. Hi peeps, Sent CCA request in January. Signed for on 24th Jan. recieved a Statement today. Funnily enough there was an entry on the sheet dated 24th jan - ADMINISTRATION CHARGE AMENDMENT - refund of £78.00 Then the next line is dated 2 days later with an admin charge of £12.00 No explanation for the refund in the letter. all I can assume is it's a result of the CCA request. Still have untill 11th Feb to produce. Sharpman

  10. Hi peeps I'm looking for a sort code for Moorcroft Debt Recovery Ltd. I know they're ****, but I actualy owe the money (3g account). I'd like to set up a SO to pay it but I'd rather not Talk to them. I have the account No from the transcash slip but it doesn't have a sort code on it. Any Ideas? Sharpman.
  11. Thanks for the info I was not made aware of this by either payplan or CCCS. That was not even put to me. At the moment I'm at the CCA/pro rata stage. fingers crossed. The info on this site has been a great boost to me. it shows that there is a light at the end of the tunnel. The debt problems we have been having have hit my OH hardest of all. She blames her self for a lot of it. but I keep telling her that that's not true as we both have debts within the combined figure. But this site has eased her mind a little. Sharpman
  12. Combined Unsecured debt of a little over £20,886 comprising credit cards, overdraft, and Catalogue. My original free cash figure was £174.00 but I gave the wron figure for my take home pay.(gave a figure that included Overtime that is not guaranteed) which made my figure a little shy of £90.00 free This is when CCCS baulked on me.   13. Yeah, started the process. Sent them off after I contacted CCCS a week or so ago. Had the usual default letters from the DCAs. Sent my offers of Pro Rata for the duration upto the 12th day to confirm CCA posession. I've had to hold fire on NATIONWIDE Credit Card and Overdraft as I've just opened a basic account but don't have a card to draw out yet. (just got a letter to advise me another load of interest and charges being applied.) Currently going thru process of contacting relevant people to change details over. ie all the ones who are paying in . it's a waiting game now. Sharpman.
  14. Got turned down by Both companies. Because my free cash was less than £100.00 payplan didn't want to know. When I gave revised figures to CCCS, also below £100.00 they also did not want to help me. CCCS were 'kind' enough to send me a pack of letters and their I&E sheet with suggested Pro rata payments. then sent me on my merry way with a suggestion to call back if my cash flow is any better. Now if they weren't willing to take me on due to the low sum for any particular reason - perhaps they thought that creditors would not play ball. Then how would they expect lowly old me with no backing at all (apart from this very informative and helpful site (due to me finding this site things, at the moment don't look so grim) supposed to persuade them. But at least CCCS were a little helpful in that respect. Payplan didn't even ask for a full expenditure sheet. they asked income, and council Tax. then that was it, sorry guv you're not affluent enough (filled the rest in according to government guidelines (did not divulge what these were)). so I don't even know what free cash they have me down for. Payplan suggested I remortgage for an even higher mortgage and get into even more debt. which is all well and good for a quick fix, but then i'd be just as bad off, because i'd have a bigger debt with a bigger danger of losing my house altogether if I couldn't keep up the bigger payments.   16. Hi peeps, Have a query on a couple of types of insurance. one is Mortgage payment protection Insurance. The other is Income payment protection. I understand the gist of what they are for. If I took out income protection insurance would I need to take out Mortgage payment insurance ? Had a couple of online quotes and the income one covers me for more than enough to cover Mortgage payments and then some. both have the usual cover of accident/sickness/unemployment etc. Any views? :idea: Sharpman.
  17. Peeps, Found this on the OFT website. Its a dual rebate/APR calculator. Could be of some use. It calculates various methods. ie rule 78, prorata, Acturial etc http://www.oft.gov.uk/crw/445501/dualcalc_installer.exe Could be a good tool once get the hang of what needs to be input.   18. Hi, Ok, Does the 2004 regs regulate loans over £25000. I think CCA 74 only regulates loans for less than £25000 from what I can make out. If so, are there any strongly worded letters on here to enlighten Firstplus of the error of their ways. Sharpman
  19. thanks for info. BTW the loan was for a figure of 33612.30 (including PPI) So, as this loan was taken out Aug 2005 it's covered by the 2004 regs. Do the company then have to use the 2004 regs to work out the settlement figure? another question. On my CCA in the Bit about early settlement it states that the figure would be worked out using formula set out in the CCA 1974. quote 'Not withstanding the fact that this agreement is not regulated by the act' unquote. What does this mean. Also i'm looking at the loan pack again. In the pack it states that the Settlement figure is calculated according to the 'Consumer credit(Early Rettlement) Regulations 2004. On the Loan greement it quotes Consumer Credit Act 1974 for figure calculations. On a recent Settlement Figure quote: The Rebate allowed has been calculated in accordance with the 'Consumer credit(Rebate on Early Settlement) regulations 1983. Ok, Now which one is legal? or are they all allowed to be used when the occasion suits them. Sharpman
  20. Hi, Took out a loan in Aug 2005. Have asked for early settlement figure. They've quoted Consumer Credit(Rebate on early settlement) regulations 1983.. Does this loan fall under the 1983 regs? I think I read somewhere that loans prior to may 2005 were covered by 1983 regs. When do 2004 regs come into effect? What are the differences in the working out of settlement figures? 1983 v 2004 regs which is better financialy for the consumer. hope that all makes sense .....:? Sharpman

  23. Hi Peeps, A little query. I have a mortgage and a secured loan against my property. I am now looking to remortgage with a view to consolidate the mortgage and loan. The mortgage is going to be with a complete different company. Here's the question. Do I need to fill out a deed of postponement for the loan company? I think it a little strange if I do as The loan is going to be paid off so they won't have any further interest in the property. I only ask because the form they provide is asking all sorts of questions that is completley out of order if I'm finishing the loan. I'm also assuming they have no say in who and where I get my remortgage from. Any input appreciated. Thanks Sharpman
