  1. thanks for the reply its so frustrating because Kensington are well aware that they are failing in their obligation to treat customers fairly they have already admitted that they have not given any consideration to any alternative other than repossession and they have failed to give a written explanation as to the reasons for not accepting our income and expenditure both instances are a breach of the mortgage protocol but they don't seem to care
  2. can anybody help with Kensington to cut a long story short got into arrears with secured loan we made a verbal agreement to pay the full monthly payment plus £50 towards the arrears sent bach income and expenditure which Kensington said they did not recieve so continued to add £50 monthly arrears fee in Sept they passed our account to their solicitors when we complained we recieved a letter from them dated 20th Oct saying that all action was on hold until the end of Nov to review the account, we then recieved a calling up notice from their solicitors dated 5th Nov [15 days after they said all action was on hold. They then added £490 solicitors costs to our account . Now they have said they do not accept our income and expenditure despite the same figures being accepted by all our other creditors including gmac our main mortgage provider The up shot of all this is that we have been making full payments plus £50 towards the arrears for the past 6 months and our arrears have increased by over £800 The missed payments total about 1100 but due to their charges our arrears balance is now £3200 any advice would be greatly appreciated thanks

  4. ist credit are now demanding increased payments or they will take court action can i be taken to court twice for the same debt?
  5. we were paying marbles directly as per court agreement we werent paying to the court
  6. it was about 5 years ago that it went to court . the court and marbles accepted our repayment offer in court. the problem was that our repayments were erratic as our income was erratic due to being self employed. at the time the debt was over £4000 it now stands at £1800 i think marbles were reluctant to return to court as we were making payments and reducing the debt. they did not inform us that they had passed the debt to 1st credit. we have made payments to 1st credit but they are now trying to bully and intimidate us .we do not dispute that we owe this debt but having made serious attempts to clear this debt we are not going to allow 1st credit to bully and threaten us
  7. can anyone advise me please.i had a visa card with marbles a few years ago which i got into difficulty with they took me to court for appx £4000 i have paid over £2000 of this back but now 1st credit have it and are threatening court action.can they take me to court again for the same debt? do they have a legal right to enforce the original court order as they did not obtain it? could someone please advise me thanks. p.s. this is in scotland if that makes any difference
