Fist challenge the fee's they have added on £225.00 they are entitled to charge an addmin fee on alocation and a vistist fee, if they have not levied goods they cannot charge a levy fee, if they have not levied they cannot charge an enforcement fee typicall £150.00. Write ASAP recorded delivery asking for the case to be on hold and for a copy of the levy sheet that you signed (even if you did not) also obtain the bailiffs certificate number and ask for proof they are certificated. If the bailiff calls do not let them in, if they have been in your home before and you signed a levy sheet you will have to pay otherwise they cannot charge you that amount. kind regards inteluk

Its correct once the council are paid in full the liability order is discharged and they have nothing to enforce, however bare in mind the bailiff firms often just send out work in bulk to the bailiff and they will be non the wiser to this and will try to enforce like any other case. Therefore keep your proof of payments to hand and have a copy made in an envelope in case the bailiff calls. if you do get a knock dont open the door hand them the letter through a window or letterbox. xheers inteluk

If this is a local authority debt its not a consumer credit debt and therefore not on your credit file. first thing to do is find out which court issued the liability order in what name and when. Then get confirmation you were registered at the address they say you owe the money for. It is true that if you move out a property the obligation is on yourself to inform the council, let me know if you need any further help once you have confirmation of the order.   7. How did you pay the council as once a case is referred to the bailiffs they will not take payment unles you did it throught the web. The way to resolve is send a letter recorded delivery to the bailiff firm and keep a copy enclosing the amount you paid to the council. As the council are paid the issue is now betwee you and rundle and co. In most cases where this is used the bailiff firm have wrote and advised of the debt and the charge payer is aware that the bailiffs have the case and then decide to pay to the council. The bailiff firms see this happen a lot and if they can show they wrote to you before they paid it then you will find you are probebly best to pay this amount, because if they alocate it to a bailiff they will try to add on a levy and further fee's. My advise would be pay it with your credit card and then file a charge back through the merchant services indemnification insurance and let them handle it. hope you get sorted kind regards: inteluk
  8. Hello just wanted to mention, a bailiff can only charge an enforcement fee after a levy. This will usually be found in writing on the reverse of the copy of the liability order the council obtained at court. A typical enforcement fee is £150, and the bailiff will not be paid any money unless they enforce the case. Without entering your property they cant levy, looking through your window and completing a levy sheet makes it invalid. Certain goods cannot be levied by law, pc's cannot be removed if used by a child for schoolwork. A levy sheet is invalid without a signature from you and that you are given a copy. Do not let them in and they can not levy in your home on your goods and charge an enforcement fee. they typically will have ten minutes alocated in time per day per case. Ask that they are certificated, through the letter box, photograph them if you can. If there not certificated they are tresspasing on your property. If they turn up in a pair its only because one is a trainee and has not got a clue and probebly only worked for the firm a few days, photograph them with your mobile as well. Write to the council asking for them to return the case, if you are vunarable eg on benefits, single parent, pregnant, mental health issues, sick, recent bereavement they are obligated to return the case, but you have to tell them in writing, hence write to them and the council sendeing recorded all the time, (dont phone there is nothing you can say they havent heard a thousand times) any further help just ask cheers inteluk sorry cant put a link to the website as its against CAG rules!! PS: If a bailiff says they are calling the police, offer to do it for them and tell the police you are scared and intimidated, they are duty bound to see you are not at risk of harm. This is all a headache to the bailiff who will move on to the next case.
  9. The client is the only one who can withdraw the case from the bailiff, the bailiff firm never give back the account except for non traceable cases. The issue of bailiffs clamping cars and levying is one of the most abused in the industry. They must DVLA check a car for clearence of finance before levying. If a bailiff turns up and says they have levied your car, write to the bailiff firm recorded requesting a copy of the levy sheet, plus ask for a breakdown in costs. (photograph them with your mobile) If they clamp your car calmly photograph the clamp on the car, its all intimidation on there part and they usually only have one clamp and wont want to leave it. Goto the council and ask for the case to be returned due to bailiff unauthorised levy. Always check there name for being certificated, ask the bailiff firm to provide information that they are bonded. if there is no finance on the car they can levy the car, if you have made payment through the council website request in writing the case has been de-alocated from the bailiff firm.   10. You need to find out his / her full name to find out if there certificated, also what there saying about the police is rubbish. Find out who they work for and write recorded delivery (dont phone) asking for full details of the case and original debt. Contact me by PM for further help if you would like!
  11. Hello sorry for the delay in reply, I have been reading up on CAG terms and conditions as I got in trouble for listing my web site and phone number, Its sorted now though.   12. Often this is the primary concern when a bailiff has visited that you want to protect your goods, but its all part of the bailiff trying to take control. The bailiff cannot take goods without a levy, which they can only do if you let them in and sign it. They nearly always do not want to get involved in removing goods as they only get a very small bonus based on paid in full cases hence time verses reward. read my bailif section regarding what to do next, as for a stat deck the bailiff will probebly reply with you will need to prove ownership at auction. focus on getting the case put on hold and learning your rights rather than what they can and cant take as this is where they want you. ring if you need me (EDIT)
