  2. Hi DBC, Yes that is a one option that I am sorting out (will email them as I am not spending any money on stamps to post them stuff). Is there anyone I can complaint to about them stating things that aren't true in their letter?
  3. Hi fellow CAGgers, I got a parking invoice in the lovely town of Workington back on 6th August 2012. As usual I popped it away in a safe place and forgot about it. Today I get a nice letter from Secure Car Parks Limited asking me to pay it. I usually just ignore as I know the idiots will give up and go away after time. This letter though made me laugh at what lies they will go to to try and make people pay. As stated above the invoice was popped on my car in August of this year. The protection of freedom act came into play 1st October. They have stated in their letter that due to the protection of freedom act they have the right to recover the amount they think is owed (a stonking 60 quid) from the registered keeper. Legal action will then be commenced to recover all amounts due together with any associated cost incurred. I feel I can have some fun with this or hopefully land them in bother due to the fact they are stating acts that were in force in August. They also state the appeals process with POPLA which again I believe didn't come into play until 1st October either. Is there anything I can do? Ignoring this one seems less fun than stirring up some of the brown stuff Your thoughts and info would be fantastic on this. Cheers, Sploits

  5. Im not sure how it was paid (wont find out until Monday) but I dont think thats an option my colleague wants to take. Him and his wife love the sofa and just want it fixed or replaced. Its only a few months old so is covered by the manufacturers warranty. Im thinking the furniture osbudsman might be the best port of action (after reading a few similar threads like this). Thank you for your input though
  6. Hi, I'm posting this on behalf of a work colleague. He recently bought a sofa from a company called Sofaland (bought 13th August 2012). He got himself a nice 3 seater and 2 seater. The sofas were delivered and everything was fine. Within a few weeks the 2 seater sofa started squeaking badly. He got in touch with Sofaland and they sent out an engineer to try and repair it. He couldn't fix it and said it looked like a manufacturer design flaw and it was defective. Away the engineer went and my colleague contacted Sofaland a few days later (giving them time to get the report), they said they would get back to him. A week passed so my colleague called the store he bought the sofa from and spoke to the salesman. The salesman basically 'fobbed' him off and said somebody else was dealing with it. More phone calls happened to the store and again he was 'fobbed' off. He then contacted the company head office via email and they sent out an email with their apologies saying that an engineer needed to go and view the sofa (not sure why as the engineer had already been out!). That email was sent to my colleague back in September. To date nothing else has happened. My friend is stuck with a defective sofa and Sofaland seem to refuse to do anything about it. What is the best course of action to go down to get this resolved? Kind regards, Sploits

  8. Hi needhelp, I will get him to ring the insurance company today and tell them it was a fraudulent transaction. He didnt authorise it so to be fair it kind of is. I will see what response I get back and if needed will be back with another query Dw190, I will also tell him to ask for a new card so the problem doesnt happen again. Thank you both for your help
  9. Hi, Trying to help a friend out and who better to ask than the fellow CAGgers Last year my mate paid for his 'then' girlfriends car insurance on his credit card. Within the last year they have broke up and went seperate ways. Today my mate cleared some money off his credit card balance and when he asked for his current balance he was surprised to find the balance had shot up instead of going down. He then found out that his now EX girlfriends car insurance had been taken off the card again. He phoned the insurance company and asked to cancel the payment. They said they could not do it as he isnt the policy holder. The ex girlfriend wont cooperate (a years worth of free insurance so why would she) so he feels like he is stuck and has lost nearly £800! Can he get his card company to do a chargeback? The payment was taken out on 22nd September Any help would be great, Sploits

Well as yet I havent managed to get a vioy of byelaws as the missus has me out shopping (oh the joys) bit did manage to get another picture from a small sign from one of their carparks small sign So it looks like its the civil route they go down after all. Unless of course their signs contradict each other

I'm not the most clued up on byelaws (never even looked into them before now to be honest) but if they have the power to put new byelaws then would that not mean they are a law upon themselves and they can add whatever they want and at whatever cost? Would the easiest thing to get a copy of the byelaws be to go to Whitehaven Harbour Commissioners office?
  12. Unfortunately I haven't got a ticket at the minute (I usually bin them) but I know for a fact no byelaws are mentioned on the tickets.
  13. So if there is no mention of a byelaw then how do people know the difference? If people get a ticket from these lot then what is the best course of action?
  14. OK as promised I went and got some pictures of Whitehaven Harbour Commissioners parking signs. I will just link them as they are quite a big size. And hopefully my description is right for each picture. This picture is of the signage you see as you enter one of there car parks Picture 1 This picture is off an added extra they have stuck to their signs Picture 2 And finally the sign behind the first sign (on the back) Picture 3 I like the new sign that states from November the Parking Enforcement Notices will increase to £70 but yet the Blue sign states that you MAY be liable for £70. So the cost has obviously went up before the start of November. Also clamping is mentioned but they will know it's now a no no (and to be honest I have never er seen or heard of them doing it) No sign of BPA membership anywhere on their signs and no byelaws mentioned either.

  18. There is no wording on the tickets stating any bylaws (harbour or any other). The wording on all the signs states civil parking charges will be issued. I will take a photo of the sign on Froday and post a copy up for you all. Also would yhey br allowed to use the bylaw if the carparks have nothi g to do with the harbour? Fair enough they are close but we are a seaside town and the carparks have no real connection to the harbour (apart from being possibly owned by the harbour commission). Would that not be like Newcastle airport using the bylaw for a carpark they possibly owned/managed in Newcastle city centre?
  19. This could prove very useful indeed. Roll on Friday so that I can do some snooping and then if they aren't part of the BPA I will personally go out of my way to recieve a ticket from them to then see what rights they have (if any) to get my details from the DVLA. Thanks
  20. Hi firstclassx, I have had a ticket off them in the past and nothing has ever been mentioned about any harbour bylaws. Also the car parks are off the harbour and you cannot access the working harbour directly from the car parks.
  21. Brilliant Crocdoc, I will advise people to continue ignoring. As for Whitehaven Harbour Commissioners I will check there signage out and report back to my findings. They hate me as it is due to me advising the whole of my town to ignore their junkmail. This will add to the hatred if I can find out that they aren't members. Cheers, Sploits
  22. Hi Crocdoc, Thanks for the reply, I'm not 100% sure that they aren't a member of the BPA but having a look at the members list I can't find them listed anywhere. I will be in town this coming Friday so I will pop round and check their signage and see if it lists it there. If it doesn't then what is the best port of action. Can they be reported for obtaining RK details when they aren't supposed to? If so then who to? Also if they are members and they dish out a parking charge then we ignore because of what reason? I know it was always because of them not knowing the driver, charging an extortianate amount (penalty) etc but with the new law then I thought we had to comply and possibly pay (loss of earnings at the most anyway). Sorry if the question sounds dumb, I'm just trying to get my head around it so that I don't give out false advice if anybody asks me whether or not to pay an invoice from a PPC. Thanks again
  23. Hi, I'm on the understanding that the new rules for PPC's that start today are for BPA members only. If so what about the Non-BPA members? I ask this as we have a few car parks in my local town (Whitehaven) that are patrolled (and I'm pretty sure owned) by Whitehaven Harbour Commissioners. They have a habit of dealing out Parking Invoices like confetti and whenever I can I advise people to ignore their empty threats (and the eventual threats from Roxburghe and the lovely Graham White). As far as I know they don't appear to be members of the BPA (I have checked the BPA list but can't find them on there) http://www.britishparking.co.uk/AOS-Members Any advice would be great.
