  1. Hi All, following on from my previous post, I would really like to get some proper solicitors advice regards my situation and urgently!!!! I can't find ANYONE! Has anyone got any ideas of a firm etc that could help? I ideally need a one to one and then from there and as quick as poss (today!) My local CAB is closed today!!!!!
  2. Hi, It would make no difference attending, although they say I have given a statement in lieu of attending! (Not sure how I can have done that having not seen any evidence until now!) It would appear they can dismiss me immediately, I take it that means i get paid on suspension until next Wednesday when the hearing is? The thing is the allegations really are word against word so I have no way of defending them just as they have no way of proving them, but that means i'm out basically eh! (Looks like I am going to have to cover up 6 years of ridiculous hard work to avoid references!!!)
  3. Hi and thanks for your replies. It is gross misconduct and some of the allegations are very serious. Many are complete lies but word against word. I gave notice of five weeks as per my contract. I was originally told, when first suspended, that if I resigned everything would stop as there would be no allegations to be had. They feel they have found sufficient enough evidence (although all from past employees, and clients who are alcoholics and drug users!) to dismiss. So basically I'm stuffed? They can dismiss and ignore my resignation? Thanks
  4. Hi All I'll try to keep this short! I was suspended on full pay following 5 serious allegations back in April, I initially went "sick" due to stress for 6 weeks so during that time they couldn't hold an investigation meeting but obviously could get there case together and hold interviews etc. Having informed them I was back available to work, I received a letter inviting me to an investigation meeting, I declined that by handing in a letter of resignation dated 12th June. They initially wrote saying they wanted me to reconsider and attend an interview. I declined again and reiterated my desire to resign. I received a letter stating that I had to attend an investigation interview or my pay would be stopped, I could provide a statement instead. I provided the statement and have today received a full report and bits regards a Disciplinary Hearing to take place next Wednesday in my absence, recommendation Instant Dismissal. CAN THEY DO THAT? I'VE RESIGNED? Thanks :-?

  6. Oh great! Well either way he has no right to be emailing me in that way. I am sure the judge will find it interesting, harrassment while awaiting a court date etc.

  12. Hi All Well I recieved a ticket for parking by a private company Combined Parking Solutions of Wolverhampton. I followed the advice on here Next thing I get are some court papers to fill in. So I filled it in saying I had not heard from them regards the letter and denying responsibility for parking there. Now it's gone further to county court and a hearing set for September!!!!! HELP! I've just received a letter from them, it's long but well worth a read please and any advice of what to do very gratefully accepted! What do I do? Can they do this? As for the CCTV I have never seen it and they don't confirm for instance how many people? They say "children" BUT it was a child for starters so are they playing a game or what? PLEASE HELP SOMEONE Thanks
  13. Hi Reclaimant, Well I declined interview on the basis I didn't have all the facts etc. (In fact I still don't have some of the info I requested!) They rescheduled and on the morning of the interview I called in sick and self certificated until seeing the Doctor. The Doctor has then signed me off for two weeks. They have contacted me twice while ill. My Doctor is due to see me next Thursday and has already stated she expects to sign me off again due to the nature of stress and pressure they have put me under. Meanwhile I am deciding what to do. I am pretty certain that once I am fit for work I will resign as purely the way they have treated me means I would never go back anyway. Regards my notice, it looks like I have 5 weeks (one for each full year of service). I will add in how amazingly supportive and helpfull shootmeplz has been in the background. Thanks for your interest.
  14. I have just had to resign from my current employment and have managed to get some self employed work. The thing is not sure how much I'll make, how long it will last etc. Can I make a claim for housing benefit with not having an employer etc? Just giving an idea of earnings? Cheers
  15. Hi, thanks for your reply. I appreciate your sentiment at first and I really didn't sign expecting this position. I don't actuallly want to "get out" as such and will speak to the landlord and see that if I get him another tenant maybe he would release me etc. Your advice is helpful if all else fails. Cheers all
  16. Hi, yeh I am in the other area dealing with that. Fact is I have allegations against that quite simply I will not come away with a job over. On top of that I actually couldn't go back if they did just warn me for instance, not after the way they are treating me right now
  17. Aequitas..you're not a landlord are you lol! JonCris..you're right but have no option. Resign now and keep reference and last 6 years job record or give them their day and get sacked losing everything in less time than my notice paid in lieu from resigning! Looking at the possibility of getting a lodger in (with agent permission of course!) but would mean the landlord keeps his 12 month contract rather than have me walk and get the equivalent of 1 months money notice (from the deposit)

  19. Hi All I am going through a dispute at work and it looks like I will be resigning leaving me with no work or therefore income! I have just signed 11/04 a 12 month AST and want to know if I am really stuffed into having pay the 12 months/stay here or whether I can back out without losing the deposit etc? Any questions to clarify please ask and help gratefully received. Thanks
  20. Hi all. I am writing a self cert form and a covering letter. This is due to the stress involved in being suspended and going through disciplinary procedings. I want to let them know that I am self certing while awaiting my Doctors appointment which is booked for Thursday afternoon. I want them to know I will not take any phone calls or visits to my home while ill. That all communication should be by letter. At the same time I don't want to say too much or not enough. Help anyone?

The interview isn't the hearing just a fact gathering exercise I believe, BUT tbh (call me soft etc etc) I just do not want to go into HQ and sit in front of them answering questions! I wondered about handing my written notice in just stating that I am giving three months notice as per my terms of employment etc and then sit and see? Will PM you Shootmeplz. Thanks again all.
  22. Hi all Well to cut a long story short I was suspended on full pay last Tuesday. There are 5 allegations against me that are quite frankly open to interpretation. People I have spoke to feel that I have a 50/50 chance depending who sits on the disciplinary panel. Anyway, the question I need help with is regards general policy. I have been called for an interview tomorrow afternoon BUT I actually just want to resign. I have been told that if I resign the investigations will all stop, the allegations will stop, and I will walk away with a reference and 6 years job record. That is my most important thing. I have asked for a signed copy of my Schedule of Employment to confirm what notice period I have but so far they have not provided this. I don't have a "contract" of employment due to the nature of the chairty I work for. As a manager I am positive I read 3 months but they are saying I have 1. I don't want to even bother attending the interview, I can't be doing with all the hassle and issues involved and want to just let my staff get on without all the interveiws they are having to have etc. BUT I need more than 1 month to prepare for the future. SO, do I have a right to refuse attending the interview until I receive my Schedule of Employment? They say they will give me all the notice details at the interview but I want it first. I will just resign if it gives 3 months. I am also wondering about the issue of having a work colleague with me, the one I have chosen is not available to be released from shifts until May 22nd. But I know I can't expect them to hold the interview till then can I? Oh sorry so many questions, but basically can I get the interview put off by any of the following; a) Signed copy of my schedule of employment hasn't been supplied as requested. b) My work colleague can't attend till May 22nd due to work shifts. c) Finally I get signed of with stress (this is not a ploy, if you knew half of what I have been through in the last 3 years you'd be amazed. I've had family and friends telling me to take action against them due to serious breaches of support etc etc) Thanks, hope somone can help in time
