  1. Hi I'm not sure how much help I'm going to get as I think this forum is aimed at helping people who owe money yet I need help with how to resolve an issue where someone owes me money. We are a Limited company and last October started doing some work for a landscaper, this job took a couple of months to complete and our invoice total was about £3300, the landscaper was a sole trader. His client refused to pay his final invoice, nothing to do with our work but he didint agree all the extra and wasn't happy with the final invoice value, this dispute has been going on for nearly 12 months and I'm fed up with it. The landscaper has now got a full time job in another field and says he cant pay until his client pays, I spoke to his client direct and he said the work I had done had been paid for, so the landscaper has had the money and spent it, in total the landscaper was paid over £120k for this job, he was not VAT registered and I don't believe he paid tax on this money but I guess thats another story. At the moment we are in stalemate he wont pay a thing until his final balance is paid by the client and the client wont pay any more, the landscaper isnt prepared to take him to court as it will cost to much and take to long, where do this leave me? I've asked for a monthly payment plan and he hinted that if we tried the court route then he may go bankrupt - could be a bluff. His new line of work also seems to be cash in hand as well, so technically he doesnt earn anything, I've spoken to a debt collection agency who said I'm best off filing for a small claims court but if the guy doesnt have any money it wont get me very far will it? but he is earning on the quiet so he does have money. If I file the small claims court and he's issued with a letter saying you must pay withing 7 days or whatever and he doesnt what actually happens from there? If I file a small claims court how long do I have to recover the debt, I heard 6 years max? Thanks

I can confirm we have had a letter stating a refund will be processed which is all we wanted all along and our claim to be dealt with professionally, its a shame the only way we got a result is by posting on a public forum but the web is a way of advertising, good and bad advertising comes from that. Thanks you Engravers World for finally making the right decision

After suffering terrible service from a online retailer (Engravers World) I have decided to write about this experience while I assess how much it would cost to take to court and how much I would be entitled to if I was to win. So I ordered a engraved photo frame for a wedding gift, it looked good and was reasonably priced but the problems started after I paid for the item, we paid for recorded delivery but when it was delivered Royal Mail signed the delivery card and threw the parcel over our gate, they didnt leave a card to say we have a parcel and a few days later we found the parcel. The frame was damaged, it had dents on it and could not be given as a gift, we contacted Engravers World who was most unhelpful suggesting we should claim against Royal Mail, I pointed out that Engravers World chose to use Royal Mail and the claim should come from Engravers World, after about 4 emails they finally agreed to claim against Royal Mail and asked us to send the frame back which we did. About a week after we sent the frame back we contacted Engravers World and they informed us we damaged the frame after we unpackaged it and Engravers World would not be claiming against Royal Mail. So Engravers World are claiming we damaged the frame ourselves however this was damaged either in transit or before it left Engravers World, Ive spoken to consumer direct and they advised that if they are claiming we damaged the frame then they need to prove it which they cant and if they refuse to offer a refund then I am entitled to take Engravers World to court, decision time. Although the frame is a low valve, its frustrating being told I'm lying and they told me Im changing the story when I wasnt, this is the latest email from them: this is the latest email from them: We have taken your parcel to our company solicitor and shown him the > emails,letters and the frame. > We have all carefully inspected the packaging, wrapping, box and frame, and > can conclude that physics will prove that this has been damaged after > unpacking the item. > there is no damage to the box both internally or externally which co-insides > with the damage on the frame. > This means it could not have been done until the frame was unpacked from the > packaging & taken out of the cardbord box. the type of damage is both from > blunt impact and a sharp edge impact. This indicates that there could not > have been cardboard around it and there is no damage to its box. > So unless you now change the story again to tell us that the postman > unwrapped your gift as well, we will be happy to show you this all infront > of the court. I have explained numerous times the burdon of proof is on the seller and they could show any kind of box and I wouldnt know the difference, for all I know it was posted like this. Can I ask for the frame to be sent back to be at their cost as I have purchased it and sent it back at their request, if I do take it to court I would need the frame but not sure I should have to pay postage 3 times!   4. Thanks for the reply, im not interested in gettng out the contract because of the unlimited texts well 3000 anyway. When we complained with the Samsung D900 all they did was a quick test on the phone in the shop and said theres nothng wrong with it, both home and work locations have been checked before and I believe they both receive a good signal strength, I'll have to go into the shop and insist the phone is replaced and if itstill does not work sell it on ebay and buy a different phone

  6. Hi Im new to this forum and got a question about mobile phone conracts, I apologise if a similar post has already been made but I want a direct answer to my question. About 11 months ago my girlfriend took out an 18 month contract with orange (Samsung D900, after 2 months of her complaining about how crap the signal was with orange I suggested she tried her old phone (Nokia) bingo! I know the signal strength varies from phone but this was crazy in the Samsung she got 1 - 2 bars of signal but in the nokia she got full strength. She took the Samsung back to the shop and they said they tested it all to be ok, realising she was fighting a losing battle she just went back to the Nokia phone. Now, on Sunday the trusty Nokia was playing up so she went to the Orange shop and paid £100 to upgrade the phone, she ended up getting the Samsung U600, 1 of her friends has it and she liked it (you can see where this is going) but today at work she was back down to getting 1 - 2 bars of signal, and she says she cant call people as it contiunally breaks up, the girl in the shop said there's no cooling off period but what can she do, as far as I can see the the phone does not seem compatable with orange at her work. I just need some advice on how I can move forward with this at the end of the day I just want herto have a phone that works but from experience Orange will do very little to help.
