  1. Hi Jobmid,

     

    The info received from them is just a copy of a signed and dated application form.

    They have stamped it and a signature of sorts is over the stamp - this may just be a recived or an application approved stamp as opposed to anything else!

    I have not seen a CCA at all, but the form does shwo that I asked for PPI & communications with them have also confirmed this.

     

    I queried the USA Versus UK law and said as you are here in the UK you are bound by UK Law and the response was, well we are bound by and operate under both UK and USA Laws..........I thought bo****ks to that one, UK law prevails in the UK.

     

    They are just trying to hide behind & confuse us with this American twaddle.

     

    I have fired off al the usual CAG templates to them including write to me dont call me letter.

    I have formally complained about two of their people offering me "pay us less now and borrow the money elsewhere deals" but so far the person to whom the last complaint was sent has not replied.

    This of course may be because they know they are in the wrong and so they are trying a different approach to me.

     

    All I have had is a letter that regretfully, calls are not all recirded so it is impossible to confirm the complaint...........yeah right, i'm stupid enough to swallow that one!

    Shame they only record calls that they might find useful, any others are wiped, sorry not recorded.:D

    they are talking drivle as usual. i think its time you start recording your calls and if they call do not answer any of thier security questions. They are only bound by UK law as they have been issued a credit licence in the UK. Their treat monkeys will say anything. fire off the cca request dont sign anything also again request a final letter regarding the ppi as you need to complain about this to them

  2. Well MBNA's treat monkeys love to say they are bound by american law which if they were they would be in even more trouble with the law than they are here. They are bound by english law as they are based in chester.

     

    Could you post a copy of the cca you recived with your personal details removed as there is a chance the it might be not enforcable. Do not deal with them over the phone send the template letter that says all dealings should be in written format only as they are harassing you over the phone.

     

    Also request in writing for a final letter with regards to the ppi so you can take your case to the fsa. Good luck and if you need any help let me know.

  3. well if the dont have a cca then the debt can not be enforced. MBNA have gone all quite on me since the ombudsman stepped in its been a few months now since I have heard a peep out of them they used to call daily from a private number and I then stoped answering private numbers which led to problems as my job would call me from a private number or if

    i had been looking for a new job then all those calls came from private numbers

  4. That was NOT my point. If enough people all got together and complained EN MASSE to say the FSA, FO, OFCOM (yes for misuse of telephones) Banking Standards then something WILL be done.

     

    It doesn't matter if the debts are sold on, this is about putting ALL MBNA employees on the dole, where people like them belong. Let's see how they like it when THEY get harassed for being in debt! :mad::mad:.

     

    All it takes is a flood of letters ALL about the same thing and action will be taken.

     

    dont get me wrong i am also plagued my this bunch of wasters they do need to get taken down i have a complaint in the the ombudsman at present the funny thing is they were told to hault all action by the ombudsman but after been ordered to do this they sold my account to a dca and when the dca heard this they passed it straight back to mbna. the ombudsman is now looking to punish them shows how stupid mbna are

  5. I see SO many people on this forum who, like myself have problems with the bunch of retards at MBNA, but no one actually seems to be making any REAL progress (one voice shouting in the storm etc) therefor I propose this;

     

    If YOU are GENUINELY interested in ridding the world of these muppets, PM me. I am proposing a petition to the government to have MBNA's credit license removed. This would shut them down in the UK. With any luck, they are so disorganised, all debts would be written off!

     

    We could do them enough damage in the press too, and them government may even begin to question their methods and instigate their own investigation.

    whist it would be nice i think the debts would be passed on to another bank as was in the case of northern rock where the co-op took over their credit cards mbna would just simply sell all the debts to another bank or dca

  6. the only way you can get those letters stopped is to go your local royal mail dorting office and tell them this person does not live at your address then when a letter reaches the sorting office it gets returned and not delivered to your house. This is what I did and it worked.

  7. Well I've just sent the made up OTHER letter back to the **** it came from, hopefully that should be the end of that, and a cca request regarding the other alleged debt against myself.

    it wont be though they ignore all returned mail i had this problem at my old address that lowell kept sending letters for people who used to live there years ago i kept returning them in the end i ended up filing them under "bin"

  8. im not so sure about this one everthing looks to be there to me it looks enforcable but i am not 100% sure on this the apr is quoted the newer cca's are more watertight than the old ones it seems you have one of the new ones as the data is 2007 on it hopefully someone else can offer a second opinion on this

  9. they could be anyone calling i would not pay anything until you get something in writing even when they do that you need to request a copy of the cca and a deed of assigment. Like whats to spot me from calling you predending you have a debt and to ask for immediate payment.

    Barclaycard are my thorn at the mo - they really do not like it when I tell them to read the stop harrass letter which they signed for on 17/02 :D

     

    I've started to ask them to hang on and I'll get the person they want to speak to and just put the phone under my bottom. I do go back every now and again to see if they are still there, but they tend to hang on for about 5 mins then give up :D

     

    Cheers for that. there is nothing like calling a good dca and getting the most silly person at the end of the call AIB have now told me that they listened to the telephone recording and have asked global debt recovery to sack the agent another win for cag one less treat money to call you

  11. if its 7 years old then its statue barred if there has been no payments in the past 6 years they are not allowed to collect on this debt dont send the cca request send this letter

  12. i had a funny one 2 weeks ago with global debt recovery:

     

    really grump agent answered

    me: i spoke to the bank and they have not passed the debtto yourselfs

    them: they have told us to sue you

    me: i am not going to take treats from you

    them: i have not

    me: you have just made a treat of sueing me

    them: sueing is not a treat mr the bank is telling me thay you owe them money and you wont pay them back

    me: may i say something:

    them: no i dont want to speak to you good day

    me: i will keep calling back

    them:your harassing tactics are not going to work (they must get alot og us Caggers on the phone:D) the conversation is not you shouting at me (at no point did i raise my voice to him)

    me: you are not listining to me

    them: i dont want to listen to you what you are saying is complete nonsence the bank has not told you anything of the kind

    me: well they have and i read out the number of the bank and told him i spoke to them before calling him

    them: you have taken money from a bank

    me: where is the deed of assigment? the bank have told me they have not passed this to collections what would you do if someone contacts you out of the blue asking for money?

    them: listen this is how a converation works what normally happens when you have a converation with someone is you wait until there is a pause in the conversation (he was getting very ratty at this point) or you wait until its clear that the other person has finshed speaking (wow a dca knows how conversations work pity he didnt take his own advice as i could not get a word in edge ways they dont like been put in thier place) please send me an email as i dont want to speak to you

    me: i go on and explain how a microsoft exhange server works and how you can block emails from certin address using exchange

    me: well during a conversation if someone is telling lies and been abusive then its normal for someone to but in and corrtect the untruth the term is heckling

    conversationg goes on and one like this for 25 mins at the end of which i think i heard him tumping the desk even when i offered him payment he would not take it he said i am going to sue you and me saying not without a deed of assigment or any papers to back it up you wont i heart was racing at then end of the call but i never raised my voice to him i sent the cd off to the bank and they were socked. i have also sent it to my solisitor on friday to get rid of this dca as the debt has now been paid with the bank
