  1. A simple letter RD to Aktivs compliance manager

    Dear sir or madan with reference to the debt for xxxxx

    please take note I do not acknowledge any debt to

    you or any company you claim to represent.

    Further more from advice received and my personal

    research I conclude that the alleged debt is STATUTE BARRED

    so in the instance I will not be making any payment or offer

    payment now or in the future.

    Please note I am familia with OFT Guidance 2011

    and the sections regarding SB debt including that section

    regarding the selling of SB debt without informing the

    purchaser of the status of the debt.


    End of Story.


    BRIGADIER2JC got it spot on and send it recorded delivery so they cant turn around and say they never got it. with an email they can say just that

  2. well my issues rattle on it seems blackhorse sent a statment for an amount that is much higher than the letter muckhall sent and its like i never returned the car to them on it theres no mention of it...


    also i emailed my old land lady to tell her to stop sending the letters to my aunt she sent me this:


    Sorry to hear you had all that bother - but I will continue to forward letters until your name is removed from any mailing lists using my address. Otherwise I would be inundated with post for previous tenants down through the years! If you'd prefer for me to forward them to ypursolitor rather than your aunt that's fine with me- just let me know.

    i dunno what to do this is causing me sleepless nights now. Also if i contact them it rests the clock ticking on this. I lost 3k on this deal i suffered enough. What can i do?

  3. there used to be a good letter in the templates libary informing them that you can send to them to say you do not want a doorstep visit. I have edited citizenB's letter well really added to it


    Dear Sir






    On DATE & TIME an agent acting on behalf of your company attempted to force / forced his way into the property I am currently living in.


    1: This is not my home - I am a tenant

    2: Both the property owner and myself are vulnerable persons having both undergone/undergoing treatment for xxxx

    3: He did not identify himself

    4: No appointment had been made

    5: He was aggressive and attempted to push his way past the owner of the property.

    6: This account is maintained within the payment agreement and therefore there was no reason for the visit in any case.

    7: Both the property owner and myself have been left traumatised by this incident.




    Is a proper investigation into this man's actions, an apology and compensation for the distress caused.


    I am aware that if you do not properly respond to my Official Complaint I can refer my complaint to the Financial Ombudsman and the Office of Fair Trading for investigation.


    Furthermore, should it be your intention to arrange further “doorstep call's”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.


    There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.




    In Scotland change the last paragraph to :-


    There is only an implied license under Scots Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc. Therefore take note that I revoke license under Common Law for you, or your representatives, to visit me at my property and if you attempt to send such a collector to my home, you will also be reported for harassment and I shall seek damages for a delict of trespass. You would also be liable for conspiring in a delict of trespass by acting in defiance of my instructions and sending someone to visit me nevertheless. Should it be necessary, I will obtain an interdict from the Court to prevent you carrying out your threat.

  5. well u could get a bank account with a bank that isnt associated with bank of Scotland maybe try the co-operative's http://www.co-operativebank.co.uk/servlet/Satellite/1193206368743,CFSweb/Page/Bank-CurrentAccounts?WT.svl=copy to pay just ur standing orders its a basic bank account that even bankrupt people can get its what CAB tells people to go for. That way u can save ur post office fees and have bank statments showing u paid these idiots

  6. 2005 its now 2012 so its over the 6 years this is statue barred. The letter that was sent was a begging letter I have had one from a sister company of lowells in the past send them Letter M http://www.consumeractiongroup.co.uk/forum/content.php?590-Creditors-and-DCAs-Letter-Templates-Budget-Planner as this debt probely is statue barred lowell seem to specialize in this kind of debt they can generally buy it for 1p to the pound or even less i have heard so if they make even a few quid off it then they have made their money back. Fire off that letter PRINT do NOT sign your name and send it recorded delivery.

    print do not sign your name and stay off the phone they will try trick you on the phone into admiting that the debt is yours. I had a simular experince with Active Kaptil for a debt which wasnt mine i used this letter and they went away and had to pay me 50 pounds for my trouble

  9. Well here goes a shocker of a storey.


    In March 2010 I got a car on finance from a Blackhorse finance dealer.

    The car was worth £6500 I put £1000 down as a deposit and the rest £5500 on finance with BH.


    At the time my passport was in the passport office been renewed so the dealer got a faxed copy of my old passport not the original from BH

    and proceeded to doctor the passport to pass it off as the original one.


    I went for a year paying £156 pounds per month and then lost my job.


    I contacted BH and they offered to half my payments which I accepted.

    I went on for a few months like this and things began to get out of hand

    the very cold winter we had if anyone remembers it cost me a lot of money to stay warm

    and only been on benefit with no sight of a job.


    I decided just to hand back the car as I was struggling to keep my head above water.

    I had to stop paying them as I could not afford to keep going on it.


    The auctioned the car which had very low mileage and they got £5000 pounds for it.


    They made a total of £7232 that £5000 they got at auction plus £2232 they got from me.

    They made a nice little profit and I lost big time.


    The issue is after I returned the car they still wanted £3300 out of me.


    The car agreement £9360 over 5 years.


    I moved to a new address (outside of the UK or EU) and didn't update my details with them as I didn't want them to contact me again.


    2 weeks ago Mackenzie Hall sent a letter to my landlady on the envelope it said the resident and when you open it the letter was addressed to me.

    She then contacted my mother and it has caused major embarrassment for me now,

    my ex landlady is now demanding they stop sending letters and for me to do something about them.


    They sent another letter on Monday causing me even more stress.

    I do not want to give these people my new address nor do I think I should be punished more for a bad choice of judgement.


    At the time I took out the agreement I was a full time student in a part time job I don't think BH should have even lended to me

    and the dealer committed fraud to get his sale by providing fake documentation to get his sale which BH helped him with. (I have a 3rd party witness to the deal)


    Any ideas what I can do here?
