  1. No it was Dumfries and Galloway police, They did say it was the CID and it was in regard to an "incident" on the date which was shown on the speeding fine letter, the woman left her name and telephone number
  2. We have not replied to the letter sent by the police, as stated we have just got back from holiday. Its good to know that the CID have nothing better to do than to chase up people who have not replied to a NOIP letter. We have only had one letter and it just seems strange that they would call ? Maybe its just me, I have had speeding fines I have not replied to in the past and never had them ring me. I would get a second letter stating I had not replied and ti was a offence but never a phone from the CID.

My girlfriend recieved a speeding ticket through the post about 3-4 weeks ago, we have just come back from a long holiday and she recived a call this morning at home which her mum took from someone cliaming to be CID in relation to a speeding offence. She does not remember who was driving the car on the day the claimed offence took place. The question is can CID ring you at home and why do CID get invlolved when the ticket claims she was doing 86 in a motorway. They have left a number for her to call back ? Any suggestions ? Thanks
  4. Hi, HI have posted before on this matter but have had no response from anyone. I have closed my mortgage with Halifax last year and want to claim over £1100.00 in arrears charges from them. I received the details from them of the charges and calculated the ammount, I forwarded this in a letter asking for a refund of the charges as I believed they were penalities, I also sent the letter on here outlining the case of Castaneda and Others v Clydebank Engineering and Shipbuilding Co Ltd., (1902) 12 SLT 49. I also asked for them to detail their charges but they wrote back saying they beleived their costs were appiled in line with the terms and conditions of the mortgage account and they would not divulge the breakdown of charges as they were commercially sensitive. I do not now know how to proceed and really need some help to carry this forward. Ideally if there is a template letter somewhere that could be used it would be ideal. ( I have looked but cannot find one on the site) Any help would be greatly appreciated ! Thankyou.
  5. Hi, I have been trying to get halifax to repay the arrears charges on my mortgage account. I have now changed lenders and have calculated they have taken and extra £1200.00 off me during the course of the mortgage. I sent them a letter asking for the money to be repaid along which a schedule of what the fees were, when and for how much. I got a letter back today saying they have investigated the complaint and were happy the charges have been applied correctly with the terms and conditions of the mortgage account. I also asked for a breakdown of how their arrears costs are calculated and they said they could not divulge it as it is commercially sensitive. I told them in the letter to take it as an LBA if they did not refund my money. Whats do I do now ? Should I file a claim with the court ? if so has anyone else done this and won. I have no idea what to put on the court doc ! Any help would be really appreciated ! Thankyou
  6. Hi, Thankyou for the reply. I have read the atatched and already done that, I ahve itemized the late payment and added the interest, then forwarded a schedule of payments to Halifax requesting repayment but they wrote back refusing to refund the money. What I need to know is are there template letters thats should be sent now, and where are they, I have spent hours looking through the site but cannot seem to find template letter like there are for bank charges.   7. Hi I recently wrote to halifax asking for £1300 back for arrears, letters, calls etc during my mortgage with them.(now remortgaged elsewhere). Got a letetr back this morning refusing to pay any of the money back saying the fees where made clear in the information baout yuor mortgage bookelt that came with the offer. what do i do now ? Is there a template letter I can ssned to them adn does anyone know where it/ they are. Please help as I could really do with this money being refunded. Thankyou
  8. Hi, I have just cahnged lenders and got the details from my previous lend Halifax for the arrears/call etc on my account. There is £900 been added since 2005. Can I claim this back, Also is there a template letter on here I can use. Lastly I was charged £175.00 repayment administration fee can this also be claimed back. Any help would be appreciated
  9. Hi Yes I paid the extra charges. I already have a list of charges but I thought they could not charge a van fee if they had not done a levy of distress. I have written to them telling them they have overcharged me and I want my money back plus the bailiff lied about doing the levy in the first place. They say their fees are charged in accourdance with the council tax (Administration and Enforcement) regulations 1992 as ammended and I am due nothing back. This cannot be right, the guy has made up a levy which is both wrong and unsigned. This cannot be right, How can I prove to rossendales that he has got it totally wrong because he was going off memory and has fabricated the levy once questioned ?
  10. Hi, I had a bailiff from Rossendales call a few months ago regarding unpaid council Tax. I let him in and agreed that the bill needed paying but didnt have the £1600.00 he was asking for. I gave him £300 and he said i would have a payment schedule set up for me and left. 2 weeks later I had another guy at the door from rosendales asking to speak to me. He said he was here to collect the outstanding balance of £1500.00. I told him I did not have it and he said I had 48hrs to get the money or he would be back to remove my goods. he took down the reg of my car without saying anything and left. I then rang my local council and paid the ammount in full as I didnt want these people back at my door. I told the council that i felt threaterned and intimidated by this 2nd bailiff. I was then told I had been charged £202.00 for this visit which included an attaedance fee, a van fee and a levy fee (no levy was done on either visits) I wrote to Rossendales and advised them that as far as I was aware you cannot charge a van fee to uplift good if they have not been levied upon first and no levy was ever done. They wrote back inlcuding a levy which was totally wrong and unsigned , The bailiff had a had a quick look about in my room which i use as an office and included my computer which i use for work and a tv which he stated was a 50" plasma, I dont own a 50" plasma, and a large digital printer which he totally got the name wrong (the name that he put down does not existing in the printing world !) along with my car which is work £26k. He claims I refused to sign the levy or walking possession agreement so as not to incur the £12 charge. I have written to them 3 times now and have recived a letter from the complaints team leader saying the she has interviewed the bailiff and he is adament that these items were in my house when he attended and he did hand me a copy of the levy. This guy has baltently lied and I have explained to them that he has levied on things which dont exist. Its a point of order now that i get this £200 back from them, Should I issue proceedings against them ? Any and all help would be really appreciated

Hi, I wrote to Nat west over late payment fees on my 2 nat west cards ammounting to over £800.00 they refused to refund them, I have filed a cliam against them at court and today recieved mathcing letetrs from Cobbetts which I really dont understand, they cliam they are going to defend the case. They state that the particulars of Claim to recover Bank charges are not properly particularised and do not idsclose reasonable grounds for bring a claim. They also go on to say thats charges were debited to my back account. Im not claimed bank charges back its for a credit card late fees ! Is this just a standard reply that they have got wrong ? On my claim form i put in particulars for claim, "Claim for excess credit card charges" I think thats pretty self explanitory but they state "no admissions are made as to what charges have been debited to the cliament back account". I sent them a full breakdown of all the excess charges over the last 6 yrs which i recieved from them ! Any help on this would be much appreciated D

Hi Rob, Thanks for the reply, The offences are pnld code H5239, Contrary to (9) section 1and 5 of the road traffic regulation act 19844 and schedule 2 to the road traffic offence act 1988 And PNLD code H764 Contrary to section 59(1) of the vehicle Excise and regulation act 1994. I have just checked on the dvla site for registration marks and the details the officer has given in his statement is completly wrong, will this hold any weight ? Thanks
  14. The letter is not a fix penalty offer. It states that the court will pass sentence on you. Ther is no offer of how much it will cost. I still need confirmation that this letetr has been written in the correct time peroid as I believed that they should have written to me within 14 days of the offence, I need someone to confirm this, (I know this is true for speeding offences, as I have seen it on this forum). On the officers attatched statement it also states that the numbers were less than 1" apart, (The correct plates measured between the gaps are only 10mm not 1" = 25.4mm) he also stated in his statement that the letters were more than 2" apart which is also incorrect. He was with a community support officer (A pretend policeman !) and was quite simply showing off to this guy thinking i'm gonna do this guy. There is no mention that I was delivering goods to the shop across the road nor that i was there for 2 mins max and was returning to move the car. I feel really annoyed that this guy has gone out of his way to make my life hell for doing a job ! Clarification of the above by someone who know the legislation on this would be appreciated as the police statement is wrong ! Thanks

Hi, I recieved a letter today 18-06-08 from harrogate magistrates court stating that I have to appear in court in harrogate on the 3rd July to answer charges of parking on yellow lines while delivering goods to a shop for 2 mins . This happened on 16-4-08 and i also have to answer for incorrect number spacing on my registration (which at the time was correct) I remembered going out of the shop to the police officer who immedeatly cautioned me and told me I had been there for 10 mins which was total rubbish, he then informed me that my number plates were illegal and he was going to report me. I had heard nothing from them until today, They have offered me to plead guilty by post but have not said what the penalty will be ! This cannot be right can it ? I thought you had to be notified within 14 days of any intended prosecution HELP !!!

Hi, I wrote to Nat west over 6 months ago requesting statement of Charges applied to 2 cards I have with them, One was sent within a week which showed they had charded me £460.00 in charges and the other just did not appear, It has been 6 months now and After 15 phone calls to them (one included being told they were busy as the reason for not recieving the details on the other card) I eventually recieved the details. This card shows £356.00 in charges. I sent a lba letter from the first cards details only to recieve a letter back saying they would not pay the full amount but offered £137.00 as a goodwill gesture. I have not responded to it yet as I want to do both cards at the same time. I want to apply for interest on the cards aswell as the amounts, can anyone tell me how to calculate this as the fees are applied over a 4 yr period. I did this with MBNA as they owed me £490.00 asking for costs and interest and they sent me a cheque for £1380.00 (dont ask me to explain that one but it duly got banked ! Nat west seem to be playing hard ball and Im lost now as how to progress Thankyou

Hi, I have had a bit of a poor record paying my mortgage over the last year and Have letters and phonecalls from halifax almost weekly even though I have told them not to ring me, I am going to re-mortgage my house soon and asked in passing exactly how much I have been charged in charges on one of their last phonecalls, They told me in excess of £1200, £40 for a letter and phonecall seems really steep but they siad that was in their terms & Conditions which I signed so I'd have to pay them. Is this right and can I claim these daft charges back ? If so which letters do I forward to them Thankyou Dancer

Hi, I have just recieved a letter from Nat WEST cc after requesting £460 in charges back, They offered me £168 after I sent them a letter saying I would take them to court if they did not pay the full amount plus interest. What do I do now ? I sent the same letter to mbna before xmas and they paid in full straight away ! Which letter do I send now ! Sorry to be a pain to you guys but Im not sure where to go now Thankyou
  20. Hi Guys, Firstly I must say what a great job you are all doing on this site. I received a ticket from Car Parking Management Cumbria in October for parking for 2 mins one friday night in a car park owned by iceland. The ticket has Rossendales collect Ltd on the top of the ticket. I was with my friend whos van it was and agreed to cover the ticket as he was helping me with work.the ticket was for £80 or £40 if you paid within 10 days. To be honest i put the ticket in the draw and forgot about it ! We actually saw the guy who put the ticket on the van rush back to his 4x4 which he had parked right infront of our van and speed off when he saw us returning to the van (there was no-one else in the car park as it was about 8pm). My friend received a letter today from Rossendales debt collectors saying "We are instructed that you have igrored previous requests for payment and we intend to recover the outstanding debt immediately. Unless you pay us the debt amount in full within 7 days or contact us immediately with your proposals recovery action will commence" This is followed by an 0845 number to ring My friend says he has heard nothing from them untill today so what is all the rubbish about ignoring previous requests ? Any suggestions on what to do as I really dont fancy wasting £80 for 2 mins parking ! Thankyou
  21. Hi All, Well This is just a note to let you all know the outcome of my letter with Lba to Mbna. I received a letter back stating that they did not agree with the contents of my letter and they did not believe their costs were excessive ! They then went on to say they had credited my card with £232.00 and were prepared to send me a cheque for £1486.00 as a gesture of goodwill as I was such a good customer ! Bearing in mind I only asked for £880.00 this has completely thrown me ! Whey have they given me almost double what I requested back ? They said I would have a cheque in 10 days ! whats this all about ? I did ring up last week regarding the interest rate I was getting charged and was informed that I was being charged 34.9% ! I said I was unhappy with this rate and they said they would put me through to someone who could help ! They then transfered me through to a loan company who could not transfer me back to mbna, They wanted me to take a loan out with them. I went ballistic with the guy and he hung up on me ! All in all a great result I think with them ! I will pay the balance of my card off when I receive the cheque and have a ceremonial cutting up of the 34.9% mbna card and never have them darken my door again. Thankyou so much for your help regarding this Im basically £800 up after writing 2 letters ! Starting on my 2 Nat West cards now !! Im beginning to like this game !!

  23. Hi , I am brand new to the forum s please excuse me if I have posted this in the wrong place. I have written to MBNA bank who have just increased my credit card to 29.9% from the 16.9% it was a few years ago regarding the fees on the account and it came back that I had amassed £880 in charges for a card with a £500 limit on it ! I have written to MBNA and requested the £880 back and they have offered me £232 .00 being the difference between the £12 and the £30 I had been getting charged before the OFT ruling. I do not want to accept this and would be obliged if anyone has any idea where to go next and if any template letter is available to send to them rejecting the offer and requesting the full amount.
