Lowell Financial and T-Mobile Account
mr.ton replied to stationearth's topic in Debt Collection Agencies
Mobile accounts are not covered by a CCA unfortunately. However Lowells still have to prove it & having these statements sent to you proves nothing. Lowells have no legal authority to any money off you anyway, only a county court does - so tell them to get lost & if they refuse, report them to the authorities. -
Not sure what they think adding more charges on is going to achieve = fools
-
They will carry on ringing you if they sense that you are vunerable. Once they see they are getting nowhere, they'll soon give up.
-
What a load of waffle from Capquest. Report them to the OFT,trading standards & the info commissoner.
-
Hi welcome to CAG. Firstly stop speaking to them all on the phone & refuse to answer security questions if they ring you. None of them have any legal powers over you whatsoever - only a county court does. Others will be along with their suggestions/responses soon

Sainsburys CC-Robinson Way and now Westcot!
mr.ton replied to triumph2000's topic in Debt Collection Agencies
There is simply no proof of this debt, so i dont know why you are still paying. They've had their 12+2 days & their time is up = no excuses. They are now in default. Report them to the OFT & trading standards. -
It really is all going very badly wrong for ACS Law. The suprising thing is that they thought they could get away with it all in the 1st place. I think they will be held up in future as an example to anyone in how not to conduct large scale operations like this.

It makes me laugh how DCA's say that someone made an "attempted payment" You either paid or you didnt & if you did, they have to prove that as well - there is no such thing as an "attempted payment"

Its just standard nonsense from the desperate Leeds losers. If its stat barred, its stat barred = end of. Report them to the authorities. The companies you mentioned are just different desks in the Leeds threat centre.
-
No clown from Westcot will turn up, they'll have no powers & can simply be told to go away.

Yes of course it depends on individual circumstances. But with respect you are wrong Car - there is a "minuimum legal" in this country of £1 per month. You are correct in that if there is nothing left over then a suspended judgement will be made. Oh & just for the record..this is exactly what i said "Yes..i would imagine they are still repaying it all now at a rate of £1 per month" Nowhere there does it say "they will only have to be" as you accused me of saying

Not reckless at all, £1 per month is the miniumum legal in this country once all outgoings are catered for & if there near enough nothing left over afterwards. Of course, not all will repay that amount (depends on circumstances of course) - but lots can & will, if need be, based on the above.

Debt avoidance when you really do not have the money to repay is perfectly acceptable in my personal opinion - so long as its done through the correct legal channels etc.... There really is no point trying to extract blood out of a stone when it comes to that, no matter what moral argument is used. Debt avoidance when you do have the money to repay is wrong & not acceptable in my view.
-
That is the minimum legal in this country once all of a persons outgoings are taken into account etc...

Mysterious Postcard - Call 07959 524979
mr.ton replied to andydd's topic in Debt Collection Agencies
I would just ignore it completely. Why even bother wasting any of your money on a call or text to find out? -
Robinson Way & data: What are they up to?
mr.ton replied to DonkeyB's topic in Debt Collection Agencies
This so called "advanced" system is useless if everyone knows their rights etc... -
Only an hour to go till he's on

Bit by bit....their industry crumbles

As mentioned - having the BNP out in the open so to speak, is far better than them being driven underground again.

No do not contact them & refuse to answer security questions if they ring you. What you received is nothing but one of their run of the mill threatograms. Send them a prove it letter.
